A BILL FOR AN ACT

RELATING TO THE EARLY LEARNING BOARD.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

     SECTION 1.  Section 302L-1.6, Hawaii Revised Statutes, is amended by amending subsection (b) to read as follows:

     "(b)  The board shall consist of the following voting members:

     (1)  One voting member from the county of Hawaii;

     (2)  One voting member from the county of Maui;

     (3)  One voting member from the county of Kauai;

     (4)  Three voting members from the city and county of Honolulu; and

     (5)  Three at-large voting members[.];

provided that one voting member shall have experience as a local provider of early childhood education and development services.

     The superintendent of education, director of human services, director of health, [and] president of the [University] university of Hawaii, and director of the Hawaii head start state collaboration office shall serve as ex officio, nonvoting members of the board.

     The board shall invite the chief executive officer of Kamehameha Schools [and], the executive director of the Hawaii Association of Independent Schools, and president of the Head Start Association of Hawaii, or their designees, to serve as ex officio, [non-voting] nonvoting members of the board."

     SECTION 2.  Statutory material to be repealed is bracketed and stricken.  New statutory material is underscored.

     SECTION 3.  This Act shall take effect upon its approval.

     Your Committee on Conference on the disagreeing vote of the Senate to the amendments proposed by the House of Representatives in S.B. No. 423, S.D. 1, H.D. 2, entitled:

"A BILL FOR AN ACT RELATING TO THE EARLY LEARNING BOARD,"

having met, and after full and free discussion, has agreed to recommend and does recommend to the respective Houses the final passage of this bill in an amended form.

     The purpose of this measure is to:

     (1)  Require one voting member of the Early Learning Board to have experience as a local provider of early childhood education and development services;

     (2)  Add the Director of the Hawaii Head Start State Collaboration Office as an ex officio, nonvoting member to the Early Learning Board; and

     (3)  Require the Early Learning Board to invite the President of the Head Start Association of Hawaii, or their designee, to serve as an ex officio, nonvoting member of the Board.

     Your Committee on Conference finds that the Early Learning Board provides critical perspective in shaping early childhood education policy in the State.  However, as the Early Learning Board serves as Hawaii's State Advisory Council on Early Childhood Education and Care for the federal Head Start Act, the board must include representation from a Head Start program operating in the State to remain compliant with existing federal requirements.  Accordingly, this measure updates the composition of the Early Learning Board to conform with requirements of the federal Head Start Act while ensuring a high level of expertise among the appointed members.

     Your Committee on Conference has amended this measure by:

     (1)  Making it effective upon its approval; and

     (2)  Making a technical, nonsubstantive amendment for the purposes of clarity and consistency.

     As affirmed by the record of votes of the managers of your Committee on Conference that is attached to this report, your Committee on Conference is in accord with the intent and purpose of S.B.      Your Committee finds that the federal Head Start Act mandates each state to establish a State Advisory Council on Early Childhood Education and Care, which in Hawaii is the Early Learning Board.  To comply with federal requirements, the Early Learning Board must include representation from Head Start programs operating in Hawaii.  This measure updates state law by adding the Head Start State Collaboration Office Director as an ex officio, nonvoting member of the Early Learning Board and inviting the President of the Head Start Association of Hawaii, or the President's designee, to serve on the Board in a nonvoting capacity.

     Your Committee has amended this measure by:

     (1)  Deleting language that would have required the Early Learning Board to invite a representative of local providers of early childhood education and development services to serve as an ex officio, nonvoting member if no voting member fulfills that role;

     (2)  Requiring one voting member of the Early Learning Board to have experience as a local provider of early childhood education and development services; and

     (3)  Making technical, nonsubstantive amendments for the purposes of clarity, consistency, and style.

Your Committee further finds that the State Advisory Council in Hawaii is the Early Learning Board.  This measure will align state law with the federal Head Start Act by adding the Head Start State Collaboration Office Director as an ex officio member of the Early Learning Board and inviting the President of the Head Start Association of Hawaii, or the President's designee, to join the Board in a non-voting capacity.

     Your Committee has amended this measure by:

     (1)  Changing the effective date to July 1, 3000; and

     (2)  Making technical, nonsubstantive amendments for the purposes of clarity, consistency, and style.

     (1)  Add the Director of the Hawaii Head Start State Collaboration Office, or their designee, as an ex officio, non-voting member to the Early Learning Board; and

     (2)  Require the Early Learning Board to invite the President of the Head Start Association of Hawaii, or their designee, to serve as an ex officio, non-voting member of the Board.

     Your Committee received testimony in support of this measure from the Early Learning Board, Executive Office on Early Learning, and one individual.

     Your Committee finds that the Early Learning Board is responsible for the formulation of statewide policy relating to early childhood education.  As the Early Learning Board encompasses expertise from various aspects of early childhood education needs, the inclusion of two additional members will enhance the effectiveness and knowledge of the Board to direct the Executive Office on Early Learning.  Therefore, this measure advances the State's early childhood education goals while ensuring the Early Learning Board's membership remains compliant with existing law.

     Your Committee has amended this measure by:

     (1)  Requiring the Early Learning Board to invite a representative of local providers of early childhood education and development services to serve as an ex officio, non-voting member if no voting member fulfills this role; and

     (2)  Inserting an effective date of July 1, 2050, to encourage further discussion.

     As affirmed by the record of votes of the members of your Committee on Education that is attached to this report, your Committee is in accord with the intent and purpose of S.B.
