The legislature also finds that the three projects are connected on their makai sides by a former cane haul road that runs from north to south on land owned by the Hawaii housing finance and development corporation. At its northern end, the former cane haul road connects to Leialii parkway and intersects with Wahikuli road and Fleming road as it heads south. The legislature notes that before reaching Keawe street, the former cane haul road crosses lands owned by Keawe Street Investment LLC (TMK 4-5-011-011-0000) and West Maui Venture Group (por. of TMK 4-5-010-034-0000).
Accordingly, the purpose of this Act is to require the department of transportation to obtain the necessary portions of the former cane haul road to build a new access road from Keawe street to the Kilohana and Kalaiola sites.
SECTION 2. To support the development of permanent housing by the Hawaii housing finance and development corporation on the Kilohana and Kalaiola sites, the department of transportation shall institute proceedings for the condemnation of the necessary portions of the Keawe Street Investment, LLC, and West Maui Venture Group parcels, pursuant to chapter 101, Hawaii Revised Statutes, to build a new access road from Keawe street to the Kilohana and Kalaiola sites, complying with the requirements necessary to dedicate the road to the county of Maui.
SECTION 3. There is appropriated out of the major disaster fund the sum of $ or so much thereof as may be necessary for fiscal year 2025-2026 for appraisals and other preparations to institute the condemnation proceedings pursuant to section 2 of this Act.
The sum appropriated shall be expended by the department of transportation for the purposes of this Act.
SECTION 4. This Act shall take effect on July 1, 3000.

At its northern end, the former cane haul road connects to Laialii parkway and intersects with Waihikuli road and Fleming road as it heads south. The legislature notes that before reaching Keawe street, the former cane haul road crosses lands owned by Keawe Street Investment LLC (TMK 4-5-011-011-0000) and West Maui Venture Group (por. of TMK 4-5-010-034-0000).
Accordingly, the purpose of this Act is to obtain the necessary portions of the former cane haul road to build a new access road from Keawe street to the Kilohana and Kalaiola sites.
SECTION 2. Your Committee on Finance, to which was referred S.B. No. 414, S.D. 2, H.D. 2, entitled:
"A BILL FOR AN ACT RELATING TO RESTORING ACCESS TO DISASTER-AFFECTED AREAS,"

The purpose of this measure is to:
(1) Require the Department of Transportation to institute proceedings to condemn portions of certain lands in Lahaina to build a new access road from Keawe Street to the Kilohana and Kalaiola sites developed in the Villages of Leialii; and
(2) Appropriate funds out of the Major Disaster Fund for appraisals and other preparations necessary to institute the condemnation proceedings.

The purpose of this measure is to:
(1) Require the Hawaii Housing Finance and Development Corporation to institute proceedings to condemn certain lands in Lahaina to build a new access road from Keawe Street to the Kilohana and Kalaiola sites developed in the Villages of Leialii; and
(2) Appropriate funds out of the Major Disaster Fund for appraisals and other preparations necessary to institute the condemnation proceedings.
Your Committee finds that the emergency temporary housing for survivors of the 2023 Maui wildfires is constructed above existing residential subdivisions. Your Committee further finds that significant community concern exists about increased traffic and congestion in these areas. Your Committee also finds that this measure would enhance transportation efficiency and public safety.
Your Committee has amended this measure by:
(1) Requiring the Department of Transportation, rather than the Hawaii Housing Finance and Development Corporation, to institute the condemnation proceedings; and
(2) Making technical, nonsubstantive amendments for the purposes of clarity, consistency, and style.

Your Committee finds that improved infrastructure is essential to supporting the long-term redevelopment of Lahaina following the 2023 Maui wildfires. Establishing a new access road from Keawe Street to the new rental housing projects at the Kilohana and Kalaiola sites will ensure safe and efficient transportation for future residents and facilitate the development of permanent housing. This measure enables the Hawaii Housing Finance and Development Corporation to acquire the necessary land and proceed with road construction, enhancing connectivity and community resilience in West Maui.
Your Committee has amended this measure by changing the effective date to July 1, 3000, to encourage further discussion.
Your Committee respectfully requests your Committee on Finance, should it deliberate on this measure, to consider an appropriation amount of $250,000 to initiate the condemnation proceedings required to fulfill the intent of this measure.

The purpose and intent of this measure is to require the Hawaii Housing Finance and Development Corporation to institute proceedings for the condemnation of certain roadways on the island of Maui for the construction of an access road.
Your Committees received written comments in support of this measure from the Department of Human Services, Hawaii Housing Finance and Development Corporation, and Maui Chamber of Commerce.
Your Committees find that the permanent housing developments expected for the Kilohana and Kalaiola sites on Maui are predicted to increase traffic in the surrounding areas. Your Committees believe that adding an access road will add connection points for drivers that will help to provide congestion relief while increasing the efficiency and safety of the area.
Your Committees have amended this measure by:
(1) Appropriating an unspecified sum out of the Major Disaster Fund;
(2) Deleting the appropriations into and out of the Dwelling Unit Revolving Fund; and
(3) Changing the effective date to July 1, 2050, to encourage further discussion on the measure.

(2) Appropriate funds into and out of the Dwelling Unit Revolving Fund for the appraisals and other preparations for the condemnation proceedings.
Your Committee received testimony in support of this measure from the Hawaii Housing Finance and Development Corporation, Department of Human Services, Maui Chamber of Commerce, and one individual.
Your Committee finds that following the 2023 Maui wildfires, three rental housing projects have been developed on the southern side of Leialii: Kalaiola, Kilohana, and Kukuia as temporary housing sites for survivors of the wildfires. Comprised of four hundred fifty housing units, the temporary housing at Leialii is intended to become permanent housing once temporary homes for the 2023 Maui wildfire survivors are no longer needed. However, with the addition of three housing developments, the community has raised concerns regarding congestion and traffic flow at the site of the former Cane Haul Road that connects the temporary housing to Leialii Parkway with Waihikuli Road and Fleming Road. Your Committee further finds that to address public safety and traffic mitigation, the HHFDC will need to acquire the former Cane Haul Road through eminent domain. Accordingly, this measure empowers HHFDC to begin the process of eminent domain in order to dedicate the proposed road to Maui County to ensure adequate and safe access for the new housing developments.
Your Committee has amended this measure by making technical, nonsubstantive amendments for the purposes of clarity and consistency.
