Your Committee on Conference on the disagreeing vote of the Senate to the amendments proposed by the House of Representatives in S.B. No. 1526, S.D. 2, H.D. 1, entitled:
"A BILL FOR AN ACT RELATING TO THE DRUG AND ALCOHOL TOXICOLOGY TESTING LABORATORY,"
having met, and after full and free discussion, has agreed to recommend and does recommend to the respective Houses the final passage of this bill in an amended form.
The purpose of this measure is to extend the timeline for the establishment and maintenance of the drug and alcohol toxicology testing laboratory.
Your Committee on Conference finds that a toxicology testing laboratory is an essential resource that will assist the Department of Law Enforcement in its efforts to combat drug- and alcohol-related offenses. Your Committee on Conference further finds that the establishment of a toxicology laboratory will facilitate the efficient processing of evidence by reducing testing backlogs and providing crucial forensic support to law enforcement agencies across the State. This measure extends the funding timeline to ensure that there is adequate time to properly plan, build, and equip the toxicology laboratory.
Your Committee on Conference has amended this measure by changing its effective date to June 29, 2025.
As affirmed by the record of votes of the managers of your Committee on Conference that is attached to this report, your Committee on Conference is in accord with the intent and purpose of S.B. Your Committee received testimony in support of this measure from the Department of Transportation; Department of Health; Department of Law Enforcement; Department of the Prosecuting Attorney of the County of Maui; Hawaiʻi Police Department; Honolulu Police Department; and Oahu Metropolitan Planning Organization.
Your Committee finds that impaired driving remains a serious threat to public safety, with a significant percentage of traffic fatalities involving alcohol or drugs. Currently, the State relies on out-of-state laboratories for toxicology testing, which can delay investigations and increase prosecution costs. Establishing an in-state drug and alcohol toxicology testing laboratory will enhance the efficiency and reliability of forensic testing, providing law enforcement and the Judiciary with timely and accurate results. This measure will extend the lapse date for funds previously appropriated and extend the timeline for the establishment of an in-state testing laboratory.
Your Committee has amended this measure by:
(1) Changing the effective date to July 1, 3000, to encourage further discussion; and
(2) Making a technical, nonsubstantive amendment for the purposes of clarity, consistency, and style.

The purpose and intent of this measure is to extend the timeline for the establishment and maintenance of the drug and alcohol toxicology testing laboratory.
Your Committee received written comments in support of this measure from the Department of Transportation, County of Hawaii Police Department, Honolulu Police Department, Maui County Department of the Prosecuting Attorney, Oahu Metropolitan Planning Organization, and one individual.
Your Committee finds that the establishment of a state laboratory for drug and alcohol testing requires close coordination between the Department of Health and county governments to ensure the statewide availability of timely, accurate, and reliable toxicology testing services. Your Committee further finds that additional time is required to develop this laboratory and the administrative framework to support its operations.

The purpose and intent of this measure is to extend the lapse date for funds appropriated out of the Drug and Alcohol Toxicology Testing Laboratory Special Fund for fiscal years 2023-2024 and 2024-2025 for the establishment and maintenance of a drug and alcohol toxicology testing laboratory.
Your Committees received testimony in support of this measure from the Department of Law Enforcement, Department of the Prosecuting Attorney of the County of Maui; Office of the Prosecuting Attorney of the County of Kauaʻi, Hawaiʻi Police Department, and one individual.
Your Committees received comments on this measure from the Department of Health.
Your Committees find that a dedicated toxicology testing facility is essential for effective law enforcement operations, particularly in addressing driving under the influence, workplace incidents, and other situations requiring precise toxicology analysis. The laboratory established by this measure will reduce dependencies on external testing facilities, potentially decreasing processing times and costs while maintaining chain of custody standards crucial for law enforcement purposes. Establishing consistent testing standards and procedures will significantly improve the quality and reliability of evidence in criminal investigations and prosecutions.
Your Committees find that this measure is crucial for enhancing the State's capability to conduct timely and accurate drug and alcohol testing, directly impacting law enforcement operations and public safety. Extending the funding timeline until June 30, 2028, ensures adequate time for establishing and implementing the laboratory infrastructure.
