RELATING TO PARKING.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. The legislature finds that the statewide parking program for persons with disabilities, was established to provide individuals with mobility disabilities the ability to travel and park in accessible parking spaces via the use of parking placards. However, improper use and insufficient enforcement impact access for legitimate program participants.
The legislature further finds that adoption of electric vehicles is a vital step in the State's efforts to combat climate change, reach the 2045 mandated carbon neutrality, and create a more sustainable future. The legislature has made efforts to encourage and facilitate the adoption of electric vehicles with tax credits and with designated charging parking spaces. These parking spaces not only encourage the adoption of electric vehicles but are a vital component to personal and statewide use. The ability to park in an electric vehicle space allows individuals to make sure they can continue to use their vehicle with ease and have the security to make it to their next destination with adequate fuel.
The legislature concludes that the use of these spaces by non-electric vehicles not only takes away an incentive granted to electric vehicle drivers but can imperil their transportation use by not allowing them the opportunity to recharge.
Therefore, the purpose of this Act is to authorize the counties to adopt ordinances to enforce the accessible parking space design requirements for parking for disabled persons and parking for electric vehicles and any respective administrative rules to ensure unimpeded access for program participants.
SECTION 2. Chapter 291, Hawaii Revised Statutes, is amended by adding a new section to part III to be appropriately designated and to read as follows:
"§291- Requirement to provide parking for persons with disabilities; ordinances to enforce. (a) Each county may adopt ordinances to:
(1) Enforce the design and construction requirements of this part, and any administrative rules adopted pursuant to this part, pertaining to the provision of parking spaces and access to parking spaces reserved for persons with disabilities, including but not limited to the number, location, design, and signage of these parking spaces; and
(2) Establish penalties for failure to comply with ordinances adopted pursuant to this section.
(b) An official appointed by a county may enter the property of a place of public accommodation to enforce any applicable ordinances adopted pursuant to this section.
(c) For the purposes of this section, "place of public accommodation" has the same meaning as in section 489-2."

a civil action."]

The legislature finds that the statewide parking program for persons with disabilities, was established under part III of chapter 291, Hawaii Revised Statutes, pursuant to the federal Uniform System for Parking for Persons with Disabilities, as adopted in title 23 Code of Federal Regulations section 1235, and administered by the disability and communication access board, provides individuals with mobility disabilities the ability to travel and park in accessible parking spaces via the use of parking placards. However, improper use and insufficient enforcement impact access for legitimate program participants.
The legislature further finds that adoption of electric vehicles is a vital step in the State's efforts to combat climate change, reach the 2045 mandated carbon neutrality, and create a more sustainable future. The legislature has made efforts to encourage and facilitate the adoption of electric vehicles with tax credits and with designated charging parking spaces. These parking spaces not only encourage the adoption of electric vehicles but are a vital component to personal and statewide use. Your Committee on Conference on the disagreeing vote of the Senate to the amendments proposed by the House of Representatives in S.B. No. 1008, H.D. 1, entitled:
"A BILL FOR AN ACT RELATING TO PARKING,"
having met, and after full and free discussion, has agreed to recommend and does recommend to the respective Houses the final passage of this bill in an amended form.
The purpose of this measure is to:
(1) Authorize the counties to adopt ordinances to enforce the accessible parking space requirements for parking spaces reserved for persons with disabilities and electric vehicles; and
(2) Repeal the requirement for any public or private entity that provides parking spaces reserved for persons with disabilities to comply with laws relating to parking for disabled persons.
Your Committee on Conference finds that there is insufficient enforcement for the improper use of electric vehicle parking and parking for persons with disabilities. Therefore, this measure will expand enforcement mechanisms available to the counties to demonstrate the State's commitment to sustainable and accessible transportation.
Your Committee on Conference has amended this measure by:
(1) Deleting language that would have repealed the requirement for any public or private entity that provides parking spaces reserved for persons with disabilities to comply with laws relating to parking for disabled persons, including penalties for noncompliance;
(2) Amending section 1 to reflect its amended purpose;
(3) Making it effective upon its approval; and
(4) Making technical, nonsubstantive amendments for the purposes of clarity and consistency.
As affirmed by the record of votes of the managers of your Committee on Conference that is attached to this report, your Committee on Conference is in accord with the intent and purpose of S.B. No. 1008, H.D. 1, as amended herein, and recommends that it pass Final Reading in the form attached hereto as S.B. No. 1008, H.D. 1, C.D. 1.

(1) Repeal the requirement that a public or private entity that provides a parking space for persons with disabilities comply with laws governing parking for disabled persons, including any penalties; and
(2) Authorize each county to adopt ordinances to enforce the accessible parking space requirements for parking spaces reserved for persons with disabilities and electric vehicles.
Your Committee finds that the designated parking program for individuals with disabilities was created to provide accessible parking for those with mobility challenges. However, widespread misuse and inadequate enforcement have made it difficult for legitimate users to access these spaces. Your Committee also finds that the State has taken significant steps to promote electric vehicle adoption as part of its broader sustainability goals and charging spaces are critical for electric vehicle users to ensure they have the necessary power to reach their destinations. When non-electric vehicles occupy these spaces, it not only removes a key incentive for clean energy transportation but also creates obstacles for drivers who depend on charging availability. To address these issues, this measure grants counties the authority to establish and enforce regulations that protect access to accessible parking and electric vehicle charging stations, ensuring they serve their intended purposes without obstruction.

The purpose of this measure is to:

Your Committee finds that the improper use and lack of enforcement of parking spaces reserved for persons with disabilities hinders access for individuals who rely on these spaces for mobility and independence. Similarly, the unauthorized use of electric vehicle charging spaces by non-electric vehicles disrupts transportation for electric vehicle users and undermines the State's efforts to promote sustainable transportation. This measure empowers counties to adopt ordinances enforcing accessibility and electric vehicle parking requirements, ensuring compliance with established standards and maintaining unimpeded access for program participants.
Your Committee has amended this measure by:
(1) Changing the effective date to July 1, 3000, to encourage further discussion; and
(2) Making technical, nonsubstantive amendments for the purposes of clarity, consistency, and style.

Your Committee received testimony in support of this measure from the Disability and Communication Access Board, NAIOP Hawaii, one member of the Maui County Council, and six individuals.
Your Committee received testimony in opposition to this measure from the Retail Merchants of Hawaii.
Your Committee finds that designated parking spaces for both electric vehicles and individuals with disabilities are necessary for the State's transportation infrastructure. The lack of parking enforcement is a pressing issue in the State, that has further impaired individuals ability to access necessary parking amenities. By allowing the counties to adopt ordinances to enforce accessible parking space requirements, this measure will ensure reserved parking spaces for persons with disabilities and drivers of electric vehicles.

Your Committees received testimony in support of this measure from the Disability and Communication Access Board, one member of the County of Maui, and four individuals.
Your Committees received comments on this measure from two individuals.
Your Committees find that the Disability and Communication Access Board, which administers the statewide program on parking for persons with disabilities, has received numerous complaints about places of public accommodation failing to comply with federal and state requirements for providing parking spaces reserved for persons with disabilities. This problem is largely because no authority has been designated to enforce and collect the legally established penalties for noncompliance. This measure resolves ambiguity regarding enforcement by authorizing the counties to adopt ordinances to enforce compliance with existing requirements.
