A BILL FOR AN ACT
MAKING APPROPRIATIONS FOR CLAIMS AGAINST THE STATE, ITS OFFICERS, OR ITS EMPLOYEES.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. The following sums or so much thereof as may be necessary for fiscal year 2024-2025 are appropriated out of the general revenues of the State of Hawaii to the department of the attorney general for the purpose of satisfying claims for legislative relief as to the following named persons, firms, corporations, and entities, for claims against the State or its officers or employees, for the overpayment of taxes, or for refunds, reimbursements, payments of judgments or settlements, or other liabilities, in the amounts set forth opposite their names:

PART IV
SECTION 4. In accordance with section 9 of article VII of the Constitution of the State of Hawaii and sections 37-91 and 37-93, Hawaii Revised Statutes, the legislature has determined that at the beginning of the regular session of 2025, the general fund expenditure ceiling for fiscal year 2024-2025 was exceeded by $8,551,795, or one per cent. The appropriations contained in Act 1, Session Laws of Hawaii 2025, caused the general fund expenditure ceiling for fiscal year 2024-2025 to be further exceeded by an additional $30,334,159. Therefore, the general fund expenditure ceiling for fiscal year 2024-2025 has already been exceeded by $38,885,954, or one per cent.
The appropriations contained in this Act will cause the general fund expenditure ceiling for fiscal year 2024-2025 to be further exceeded by $7,023,343.07, or one per cent. This declaration takes into account the additional general fund appropriations authorized for fiscal year 2024-2025 in this Act only. The reasons for exceeding the general fund expenditure ceiling are that the appropriations made in this Act are necessary to serve the public interest and to meet the needs addressed by this Act.
PART V
SECTION 5. The sums hereinabove may be paid to the respective persons, firms, corporations, or entities for the satisfaction or settlement of the respectively identified cases, and in several amounts hereinabove set forth or in lesser amounts deemed appropriate, upon checks issued by the comptroller; provided that departments shall obtain the approval of the attorney general before payment of any claim may be made.
SECTION 6. Notwithstanding the sums hereinabove stated as interest upon judgments against the State, payment of interest shall be limited to the period from the date of the judgment, if applicable, to thirty days after the effective date of this Act, as provided in section 662-8, Hawaii Revised Statutes, for those cases to which the statute applies.
SECTION 7. All unexpended and unencumbered balances of the appropriations made in this Act as of the close of business on June 30, 2026, shall lapse.
SECTION 8. If any provision of this Act, or the application thereof to any person or circumstance, is held invalid, the invalidity does not affect other provisions or applications of the Act that can be given effect without the invalid provision or application, and to this end the provisions of this Act are severable.
SECTION 9. This Act shall take effect upon its approval.

PART IV
SECTION 4. In accordance with section 9 of article VII of the Constitution of the State of Hawaii and sections 37-91 and 37-93, Hawaii Revised Statutes, the legislature has determined that the state general fund expenditure ceiling for fiscal year 2024-2025 has already been exceeded by $8,551,795, or one per cent. In addition, the appropriations contained in this Act will cause the state general fund expenditure ceiling for fiscal year 2024-2025 to be further exceeded by $ , or per cent. The reasons for exceeding the general fund expenditure ceiling are that the appropriation made in this Act is necessary to serve the public interest and to meet the needs addressed by this Act.
PART V
SECTION 5. The sums hereinabove may be paid to the respective persons, firms, corporations, or entities for the satisfaction or settlement of the respectively identified cases, and in several amounts hereinabove set forth or in lesser amounts deemed appropriate, upon checks issued by the comptroller; provided that departments shall obtain the approval of the attorney general before payment of any claim may be made.
SECTION 6. Notwithstanding the sums hereinabove stated as interest upon judgments against the State, payment of interest shall be limited to the period from the date of the judgment, if applicable, to thirty days after the effective date of this Act, as provided in section 662-8, Hawaii Revised Statutes, for those cases to which the statute applies.
SECTION 7. All unexpended and unencumbered balances of the appropriations made in this Act as of the close of business on June 30, 2026, shall lapse.
SECTION 8. If any provision of this Act, or the application thereof to any person or circumstance, is held invalid, the invalidity does not affect other provisions or applications of the Act that can be given effect without the invalid provision or application, and to this end the provisions of this Act are severable.
SECTION 9. This Act shall take effect on July 1, 3000.

Madam and Sir:
Your Committee on Conference on the disagreeing vote of the House of Representatives to the amendments proposed by the Senate in H.B. No. 990, H.D. 2, S.D. 1, entitled:
"A BILL FOR AN ACT MAKING APPROPRIATIONS FOR CLAIMS AGAINST THE STATE, ITS OFFICERS, OR ITS EMPLOYEES,"
having met, and after full and free discussion, has agreed to recommend and does recommend to the respective Houses the final passage of this bill in an amended form.
The purpose of this measure is to satisfy several claims against the State, its officers, or its employees.
Your Committee on Conference has amended this measure by:
(1) Appropriating:
(A) $69,113.33 in general funds for a claim by Gilbert Collins;
(B) $166,492.00 in general funds for a claim by National Commerce Bank Service;
(C) $50,210.67 in general funds for a claim by Olinda Country Estates, Inc.;
(D) $22,674.17 in general funds for a claim by Sofia Lerman Estate;
(E) $100,000.00 in general funds for a settlement in the case of Donna Opulento v. State of Hawaii Department of Public Safety;
(F) $100,000.00 in general funds for a settlement in the case of D.O. v. State of Hawaii, Department of Education;
(G) $140,000.00 in general funds for a settlement in the case of Leonard Ramboyon v. Esther Kanehailua;
(H) $50,000.00 in general funds for a settlement in the case of Jon R. Chung v. State of Hawaii;
(I) $298,000.00 in general funds for a settlement in the tort claim by Kamaka Air, LLC;
(J) $512,700.83 in general funds for a judgment in the case of John Roe No. 121 v. State of Hawaii;
(K) $115,000.00 in general funds for a settlement in the case of Anela Aplaca v. State of Hawaii;
(L) $125,000.00 in general funds for a settlement in the case of Stacy J. Bruhn v. State of Hawaii;
(M) $26,771.00 in general funds for a judgment in the case of Healoha Carmichael v. Board of Land and Natural Resources;
(N) $18,000.00 in general funds for a settlement in the case of Kona Mike's Surf Adventures, LLC v. Dawn N.S. Chang; and
(O) $70,000.00 out of the state highway fund for a settlement in the case of Susanna Sigal v. State of Hawaii;
(2) Amending the amount and percentage of exceedance of the appropriations over the general fund expenditure ceiling for fiscal year 2024-2025;
(3) Changing the effective date to upon approval; and
(4) Making technical, nonsubstantive amendments for the purposes of clarity, consistency, and style.
As affirmed by the record of votes of the managers of your Committee on Conference that is attached to this report, your Committee on Conference is in accord with the intent and purpose of H.B. No. 990, H.D. 2, S.D. 1, as amended herein, and recommends that it pass Final Reading in the form attached hereto as H.B. No. 990, H.D. 2, S.D. 1, C.D. 1.

The purpose and intent of this measure is to make appropriations and approve payments for claims against the State, state officers, and state employees.
Your Committee received written comments in support of this measure from the Department of Transportation, Department of Education, Attorney General, and Department of Hawaiian Home Lands.
Your Committee finds that appropriating moneys and authorizing the efficient settlement of claims will promote financial responsibility and allow state agencies to focus on their core missions.
As affirmed by the record of votes of the members of your Committee on Ways and Means that is attached to this report, your Committee is in accord with the intent and purpose of H.B. No. 990, H.D. 2, S.D. 1, and recommends that it pass Third Reading.

Your Committee on Judiciary, to which was referred H.B. No. 990, H.D. 2, entitled:
"A BILL FOR AN ACT MAKING APPROPRIATIONS FOR CLAIMS AGAINST THE STATE, ITS OFFICERS, OR ITS EMPLOYEES,"
begs leave to report as follows:
The purpose and intent of this measure is to appropriate moneys to satisfy various claims against the State, its officers, or its employees, including claims for judgments against the State, settlements, and other miscellaneous claims.
Your Committee received testimony in support of this measure from the Department of the Attorney General, Department of Transportation, Department of Education, and one individual.
Your Committee finds that timely passage of this measure will minimize the State's obligation to pay interest on the amounts owed by the State. Your Committee further finds that the written testimony submitted by the Department of the Attorney General requests the inclusion of funds to cover two additional claims that have been resolved since this measure was introduced.
Your Committee has amended this measure by:
(1) Correcting the description of the claims for Billy Peter v. Anne E. Lopez; and Child Evangelism Fellowship of Hawaii, Inc. v. Hawaii State Department of Education; to indicate that the claims were resolved by judgment, rather than settlement;
(2) Adding funding to cover a miscellaneous claim of $514.00 for the reissuance of an outdated check that was misplaced or lost;
(3) Adding $70,000.00 for the settlement of Lisa Ann Daguro v. State of Hawaii;
(4) Changing the effective date to April 23, 2057, to facilitate further discussion on the measure; and
(5) Making technical nonsubstantive amendments for the purposes of clarity and style.
As affirmed by the record of votes of the members of your Committee on Judiciary that is attached to this report, your Committee is in accord with the intent and purpose of H.B. No. 990, H.D. 2, as amended herein, and recommends that it pass Second Reading in the form attached hereto as H.B. No. 990, H.D. 2, S.D. 1, and be referred to your Committee on Ways and Means.

(C) $28,500 in general funds for a settlement in the case of Billy Peter v. Anne E. Lopez;
(D) $275,000 in general funds for a settlement in the case of James Sean Shields v. State of Hawaii;
(E) $330,000 in general funds for a settlement in the case of B.R., M.A., and F.R. v. State of Hawaii;
(F) $100,000 in general funds for a settlement in the case of Child Evangelism Fellowship of Hawaii, Inc. v. Hawaii State Department of Education;
(G) $1,750,000 in general funds for a settlement in the case of Brenda Persinger, Individually and as a Personal Representative of the Estate of Michael Ambrose, Deceased v. State of Hawaii, Department of Education;
(H) $75,000 in general funds for a settlement in the case of Jake Ferreira v. State of Hawaii, Department of Education; and
(I) $750,000 in general funds for a settlement in the case of Cresencia Espejo v. State of Hawaii;
(2) Inserting expenditure ceiling language;
(3) Changing the effective date to July 1, 3000, to encourage further discussion; and
(4) Making technical, nonsubstantive amendments for the purposes of clarity, consistency, and style.
