A BILL FOR AN ACT

RELATING TO THE ISSUANCE OF SPECIAL PURPOSE REVENUE BONDS TO ASSIST HAWAII ISLAND COMMUNITY HEALTH CENTER.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

     SECTION 1.  The legislature finds and declares that the issuance of special purpose revenue bonds under this Act is in the public interest and for the public health, safety, and general welfare.

     SECTION 2.  Pursuant to part II, chapter 39A, Hawaii Revised Statutes, the department of budget and finance, with the approval of the governor, is authorized to issue special purpose revenue bonds in a total amount not to exceed $80,000,000, in one or more series, for the purpose of assisting West Hawaii Community Health Center, Inc., a Hawaii nonprofit corporation doing business as Hawaii Island Community Health Center, in financing the costs of purchasing or leasing land and designing, constructing, improving, purchasing, and equipping primary care health care facilities on the island of Hawaii, including costs to:

     (1)  Purchase or lease land, and design, construct, furnish, and equip, including information technology equipment and solar panels, a forty-five thousand square feet medical, dental, behavioral health, pharmacy, specialty care campus to serve the residents of Kailua-Kona;

     (2)  Design, renovate, furnish, and equip, including information technology equipment and solar panels, a ten thousand square feet facility owned by Hawaii Island Community Health Center in downtown Hilo, transforming the facility from administrative space to a one-stop primary health care facility for women's health, pediatric care, and family medicine;

     (3)  Purchase or lease land, and design, construct, furnish, and equip, including information technology equipment and solar panels, a new ten thousand square feet primary health care facility to serve the residents of Pahoa and surrounding communities in the Puna District;

     (4)  Design, renovate, furnish, and equip a three thousand six hundred square feet building owned by Hawaii Island Community Health Center to house health care workers working at the Hawaii Island Community Health Center medical and dental clinic located in Naalehu, located in the Kau District; and

     (5)  Other related expansion projects.

     The legislature hereby finds and determines that the purchase or lease of land and the design, construction, improvement, purchase, and equipping of primary care health care facilities on the island of Hawaii by Hawaii Island Community Health Center constitute a project as defined in part II, chapter 39A, Hawaii Revised Statutes, and the financing thereof is assistance to not-for-profit corporations that provide health care facilities to the general public.

     SECTION 3.  The special purpose revenue bonds and the refunding special purpose revenue bonds issued under this Act shall be issued pursuant to part II, chapter 39A, Hawaii Revised Statutes, relating to the power to issue special purpose revenue bonds to assist not-for-profit corporations that provide health care facilities to the general public.

     SECTION 4.  The department of budget and finance is authorized, from time to time, including times subsequent to June 30, 2030, to issue special purpose revenue bonds in whatever principal amounts the department shall determine to be necessary to refund the special purpose revenue bonds authorized in section 2 and to refund special purpose revenue bonds authorized in this section, regardless of whether the outstanding special purpose revenue bonds or refunding special purpose revenue bonds have matured or are the subject of redemption or whether the refunding special purpose revenue bonds shall be bonds for the multi-project programs described in section 2.  In making this determination, the department shall comply with federal law relating to the exemption from federal income taxation of the interest on bonds of the nature authorized by this section.

     SECTION 5.  The authorization to issue special purpose revenue bonds under this Act shall lapse on June 30, 2030.

     SECTION 6.  This Act shall take effect on July 1, 2025.

     (3)  Purchase or lease land, and design, construct, furnish, and equip, including information technology equipment and solar panels, a new 10,000 square feet primary health care facility to serve the residents of Pahoa and surrounding communities in the Puna District;

     (4)  Design, renovate, furnish, and equip a 3,600 square feet building owned by Hawaii Island Community Health Center to house health care workers working at the Hawaii Island Community Health Center medical and dental clinic located in Naʻalehu, located in the Kaʻu District; and

     The legislature hereby finds and determines that the purchase or lease of land and the design, construction, improvement, purchase, and equipping of primary care health care facilities on the island of Hawaiʻi by Hawaii Island Community Health Center constitute a project as defined in part II, chapter 39A, Hawaii Revised Statutes, and the financing thereof is assistance to a not-for-profit corporations that provide health care facilities to the general public.

     Your Committee finds that limitations in health care infrastructure, whether due to geographic isolation, financial constraints, or other shortages, contribute to long-standing disparities in access to primary health care for residents on the island of Hawaii.  Your Committee further finds that the Hawaiʻi Island Community Health Center is a nonprofit, federally qualified health center located on the island of Hawaii that plays a critical role in providing comprehensive, affordable, and accessible health care to Hawaii island residents who often face significant barriers to receiving timely medical attention.  Your Committee additionally finds that through the issuance of special purpose revenue bonds to the Hawaiʻi Island Community Health Center, the State can help facilitate the construction of new and expanded primary care infrastructure without imposing undue financial strain on taxpayers.  This measure financially supports the Hawaiʻi Island Community Health Center to further address access to health care disparities through the expansion of health care infrastructure on the island of Hawaii.

     Your Committee has amended this measure by:

     (1)  Inserting an effective date of July 1, 2026; and

     (2)  Making a technical, nonsubstantive amendment for the purposes of clarity and consistency.

     Your Committee on Health, to which was referred H.B. No. 341 entitled:

"A BILL FOR AN ACT RELATING TO THE ISSUANCE OF SPECIAL PURPOSE REVENUE BONDS TO ASSIST HAWAII ISLAND COMMUNITY HEALTH CENTER,"

begs leave to report as follows:

     The purpose of this measure is to authorize the issuance of special purpose revenue bonds to assist the Hawai‘i Island Community Health Center purchase or lease land on the island of Hawaii to develop primary care health care facilities.  

     Your Committee received testimony in support of this measure from the Hawaiʻi Primary Care Association; Hawaiʻi Island Community Health Center; AlohaCare; and three individuals.  Your Committee received comments on this measure from the Department of Budget and Finance.

     Your Committee finds that the Hawaiʻi Island Community Health Center plays a critical role in providing comprehensive, affordable and accessible health care who often face significant barriers to receiving timely medical attention, whether due to geographical isolation, financial constraints, or other shortages.  Your Committee further finds that the issuance of special purpose revenues bonds to assist Hawaiʻi Island Community Health Center in purchasing or leasing land on the island of Hawaii will enable the State to increase access to primary care services for the residents of Hawaii island without imposing undue financial strain on taxpayers.

     Your Committee has amended this measure by:

     (1)  Changing the special purpose revenue bond issuance authorization amount to an unspecified amount;

     (2)  Changing the effective date to July 1, 3000, to encourage further discussion; and

     (3)  Making technical, nonsubstantive amendments for the purposes of clarity, consistency, and style.

     Your Committee respectfully requests your Committee on Finance, should it deliberate on this measure, to consider a special purpose revenue bond issuance authorization amount of $80,000,000.

     As affirmed by the record of votes of the members of your Committee on Health that is attached to this report, your Committee is in accord with the intent and purpose of H.B. No. 341, as amended herein, and recommends that it pass Second Reading in the form attached hereto as H.B. No. 341, H.D. 1, and be referred to your Committee on Finance.
