The purpose of this Act is to enhance irrigation water access by appropriating funds to the department of agriculture for a non-potable water wells pilot program to prepare an environmental impact statement or environmental assessment for the drilling of non-potable water wells in Panaewa, Hawaii.
SECTION 2. Any non-potable water well or improvement on individual parcels at Panaewa agricultural park and Panaewa farm lots, under the department of agriculture, that is completed according to the environmental impact statement or environmental assessment under this Act shall revert back to the State upon the lease expiration date.
SECTION 3. Madam and Sir:
Your Committee on Conference on the disagreeing vote of the House of Representatives to the amendments proposed by the Senate in H.B. No. 1365, H.D. 2, S.D. 2, entitled:
"A BILL FOR AN ACT RELATING TO THE DEPARTMENT OF AGRICULTURE,"
having met, and after full and free discussion, has agreed to recommend and does recommend to the respective Houses the final passage of this bill in an amended form.
The purpose of this measure is to:
(2) Require the Department of Agriculture to consult and coordinate with the Department of Hawaiian Home Lands on the location and distribution of water from non-potable water wells before and after the completion of the environmental impact statement or environmental assessment; and
(3) Require any non-potable water well or improvement on individual parcels at Panaewa Agricultural Park and Panaewa farm lots that is completed according to the environmental impact statement or environmental assessment to revert to the State upon the lease expiration date.
Your Committee on Conference has amended this measure by:
(1) Removing the requirement that the Department of Agriculture consult and coordinate with the Department of Hawaiian Home Lands on the location and distribution of water from non-potable water wells;
(2) Clarifying that the non-potable water wells or improvements that shall revert to the State are those on individual parcels under the Department of Agriculture;
(3) Inserting an appropriation amount of $300,000 for the Non-Potable Water Wells Pilot Program;
(4) Changing the effective date to July 1, 2025; and
(5) Making technical, nonsubstantive amendments for the purposes of clarity, consistency, and style.

The purpose and intent of this measure is to enhance access to non-potable irrigation water.
Specifically, this measure:
(1) Establishes a non-potable water wells pilot program to prepare an environmental impact statement or environmental assessment for the drilling of non-potable water wells in Panaewa, Hawaii;
(2) Requires the Department of Agriculture to consult with the Department of Hawaiian Home Lands on the location and distribution of water from non-potable water wells before and after the environmental study;
(3) Provides for the reversion to the State of any non-potable water well or improvement completed according to the environmental impact statement or assessment at the lease expiration date; and
(4) Appropriates moneys to the Department of Agriculture for the pilot program.
Your Committee received written comments in support of this measure from The Chamber of Commerce Hawaii, Hawaii Farm Bureau, and one individual.
Your Committee received written comments on this measure from the Department of Agriculture.
Your Committee finds that access to affordable and reliable irrigation water is essential to support sustainable agriculture in the State. Your Committee further finds that increasing the availability of non-potable water for agricultural uses will help conserve the potable water supply
Your Committee has amended this measure by removing the appropriation for fiscal year 2026-2027, as the expenses of the pilot program established by this measure are not intended to be recurring costs.

The purpose and intent of this measure is to enhance irrigation water access by appropriating funds to the Department of Agriculture for a Non-Potable Water Wells Pilot Program to prepare an environmental impact statement or environmental assessment for the drilling of non-potable water wells on individual parcels at Panaewa Agricultural Park and Panaewa farm lots.
Your Committees received testimony in support of this measure from the Department of Agriculture, Department of Hawaiian Home Lands, Hawaiʻi Farm Bureau, Maui County Farm Bureau, Chamber of Commerce Hawaii, Hawaiʻi Food+ Policy, Hawaii Floriculture and Nursery Association, and five individuals.
Your Committees find that a key factor contributing to the decline of agricultural production in the State is the lack of dedicated access to water. Your Committees recognize that developing non-potable water wells could free up potable water for residential use and provide a more cost-effective and sustainable water source for agricultural operations. This measure therefore seeks to support and encourage local agricultural production and the State's self-sustainability goals.
According to testimony received by your Committees, the Panaewa farm lots referenced in this measure consists of parcels or property under the jurisdiction of the Department of Hawaiian Home Lands and that lessee beneficiaries with existing cesspools within proximity of the Panaewa farm lots referenced could potentially contaminate nearby wells and the aquifer. Amendments to this measure are therefore necessary to address this issue.
Accordingly, your Committees have amended this measure by:
(1) Requiring the Department of Agriculture to consult and coordinate with the Department of Hawaiian Home Lands on the location and distribution of water from non-potable water wells before and after the completion of an environmental impact statement or environmental assessment to drill non-potable water wells on individual parcels at Panaewa Agricultural Park and Panaewa farm lots; and
(2) Making technical, nonsubstantive amendments for the purposes of clarity and consistency.
Your Committees note that this measure contains an unspecified appropriation amount. Should your Committee on Ways and Means choose to deliberate on this measure, your Committees respectfully request that it consider inserting an appropriation amount of $1,500,000 for each fiscal year of the biennium for a Non-Potable Water Wells Pilot Program to prepare an environmental impact statement or environmental assessment for the drilling of non-potable water wells on individual parcels at Panaewa Agricultural Park and Panaewa farm lots.
