RELATING TO THE DEPARTMENT OF LAND AND NATURAL RESOURCES.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. The legislature finds that the people of Hawaii have significant concerns about the effects of over-tourism, including impacts to the environment, and particularly the proliferation of rental kayaks and stand-up paddleboards statewide. The legislature further finds that it is beneficial for the residents and natural resources of the State to regulate commercial rentals where a state park is the location of the watercraft activity. The legislature additionally finds that Wailua river state park on Kauai, Kealakekua bay state historical park on Hawaii island, and Ahupuaa O Kahana state park on Oahu are the only navigable waters within a state park.
Therefore, the purpose of this Act is to require:
(1) The registration and numbering of rental vessels before they are rented or leased, or offered for rent or lease, to the public for transiting the navigable waters of a state park; and
(2) The registration fees to be deposited into the state parks special fund.
SECTION 2. Chapter 184, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:
"§184- Registration required for rental vessels; registration number; fees. (a) Beginning January 1, 2026, no person shall rent or lease, or offer for rent or lease, a vessel to the public for transiting the navigable waters of a state park, unless the rental vessel is registered and numbered with the division of state parks of the department in accordance with rules adopted by the department pursuant to chapter 91 or authorized by a special use permit.
(b) Beginning January 1, 2026, every rental vessel rented or leased, or offered for rent or lease, to the public for transiting the navigable waters of a state park shall have a registration number affixed to the rental vessel.
(c) The department may adopt rules pursuant to chapter 91 to establish conditions of use for rental vessels transiting the navigable waters of a state park and reasonable fees for the initial registration, annual renewal registration, and ancillary decals of those rental vessels, to be deposited to the credit of the state parks special fund.
(d) For the purposes of this section, "vessel" has the same meaning as in section 200-6 and includes but is not limited to barges, boats, canoes, catamarans, charter boats, cruisers, ferryboats, fishing boats, flatboats, floating cabanas, houseboats, jet skis, kayaks, motor vessels, motorboats, party boats, powerboats, rafts, rowboats, sailboats, scows, ships, stand-up paddleboards, towboats, tugs, windsurfers, or any similar buoyant devices permitting or capable of free flotation."
SECTION 3. Section 184-3.4, Hawaii Revised Statutes, is amended by amending subsection (a) to read as follows:
"(a) There is established within the state treasury a fund to be known as the state parks special fund, into which shall be deposited all proceeds collected by the state parks programs involving park user fees, any leases or concession agreements, any fees collected pursuant to section 184- , the sale of any article purchased from the department to benefit the state parks programs, or any gifts or contributions; provided that proceeds derived from the operation of Iolani Palace shall be used to supplement its educational and interpretive programs."

Your Committee on Conference on the disagreeing vote of the House of Representatives to the amendments proposed by the Senate in H.B. No. 1316, H.D. 2, S.D. 1, entitled:

The purpose and intent of this measure is to regulate rental vessels in state parks.
More specifically, this measure requires:
(1) The registration and numbering of rental vessels before they are rented or leased, or offered for rent or lease, to the public for transiting the navigable waters of a state park; and
(2) Registration fees to be deposited into the state parks special fund.
Your Committees received written comments in support of this measure from the Department of Land and Natural Resources Division of State Parks and Kayak Adventures, Inc.
Your Committees find that it would be beneficial for both the State's residents and its natural resources if commercial vessels rented for use on a state park's navigable waters were regulated.
If a Committee on Conference is convened on this measure, your Committees respectfully request the Committee consider the Department of Land and Natural Resources' proposed amendment to authorize the Department to establish conditions of use for rental vessels by special use permit, in addition to the adoption of rules, to facilitate the Department's ability to respond to overcrowding and overuse at state parks.

Your Committee received testimony in opposition to this measure from Scotty's Surf Co. and one individual.
Your Committee finds that residents of the State harbor significant concerns about the effects of over-tourism at state parks with navigable water features. Your Committee further finds that while rental kayaks and stand-up paddleboards provide visitors to state parks with a unique experience of the scenic views and nature, the increased commercial activity can cause overcrowding and overuse of these resources. Your Committee also finds that conflicts often arise between visitors and residents seeking to use these resources, particularly on the weekends when the majority of residents have time to recreate. Accordingly, this measure will provide the Department of Land and Natural Resources with an additional mechanism to ensure that residents and visitors alike may continue to enjoy state parks.
Your Committee has amended this measure by:
(1) Inserting an effective date of July 1, 2040, to encourage further discussion; and
(2) Making technical, nonsubstantive amendments for the purposes of clarity and consistency.

The purpose of this measure is to require the registration and numbering of rental vessels before they are provided or offered to the public for transiting the navigable waters of a state park.
Your Committee finds that the commercial operation of rental kayaks and stand-up paddleboards allow visitors to experience the state parks in a unique manner by enjoying the scenic views and nature. However, the increased commercial activity often leads to extensive disruptions in state parks caused by human activity, including litter and overcrowding. While permitted vendors ensure that the use of rental kayaks and stand-up paddleboards are operated safely and in accordance with the Department of Land and Natural Resources' rules, this measure provides another mechanism for the Department to adequately protect the natural resources of state parks.
Your Committee has amended this measure by:
(1) Specifying that the fees for the initial registration, annual renewal registration, and ancillary decals for rental vessels shall be deposited in the State Parks Special Fund; and
(2) Making technical, nonsubstantive amendments for the purposes of clarity, consistency, and style.

The purpose of this measure is to require the registration and numbering of rental watercraft before they are provided or offered to the public for transiting the navigable waters of a state park.
Your Committee finds that there is a robust market of rental kayaks and stand-up paddleboards serving the visitor industry across the State. Your Committee further finds that visitors often enjoy kayaking and stand-up paddleboarding on the navigable waters in the Wailua River State Park on Kauai, Kealakekua Bay State Historic Park on Hawaii island, and Ahupuaa O Kahana State Park on Oahu, which are the only state parks with navigable waters. However, the use of these rental kayaks and stand-up paddleboards, particularly for rented kayaks and stand-up paddleboards that are rented from vendors outside of the park boundaries, can create overuse of these waterways, leading to conflicts with local resident users. Your Committee believes that instituting a permitting process for rented water vessels will reduce these conflicts and ensure visitors and residents are able to enjoy the State's natural resources.
Your Committee has amended this measure by:
(1) Replacing the word "watercraft" with "vessel" to better align with existing regulations;
(2) Authorizing the Department of Land and Natural Resources to adopt rules to establish conditions of use for rental vessels;
(3) Changing the effective date to July 1, 3000, to encourage further discussion; and
(4) Making technical, nonsubstantive amendments for the purposes of clarity, consistency, and style.
