What does this bill do?

The bill requires county governments to accept ownership, license, or dedication of sewer transmission lines and related sewer systems that serve Hawaiian Home Lands after the Department of Hawaiian Home Lands (DHHL) brings them into compliance, and counties must accept them within 60 days of receiving a completed maintenance request. It also makes DHHL responsible for bringing older lines (existing before July 7, 2014) that counties deem not meeting environmental rules into compliance before acceptance, and says systems completed after that date must meet all federal, state, and county environmental, design, and construction rules before a county will accept them.

SECTION 1. Section 46-20.1, Hawaii Revised Statutes, is amended by amending subsection (b) to read as follows:

"(b) Upon demand by the department of Hawaiian home lands, each county shall accept the license or dedication and ownership of any and all sewer transmission lines and other sewerage facilities servicing Hawaiian home lands and that are not subject to subsection (a), as may be identified by the department of Hawaiian home lands; provided that:

(1) Any sewer lines or other sewerage facilities:

(A) Not subject to subsection (a);

(B) Existing before [[]July 7, 2014[]]; and

(C) That the appropriate county determines are not in substantial compliance with environmental laws, rules, and regulations pertaining to the dedication or license of the sewers to the counties at the time of their construction,

shall be brought into compliance with those laws, rules, and regulations by the department of Hawaiian home lands [~~prior to~~] before acceptance by the county; provided further that all sewer transmission lines and related sewerage facilities servicing Hawaiian home lands brought into compliance shall be accepted by a county within sixty days after the receipt by the appropriate county agency of a completed application for maintenance request; and

(2) Sewer transmission lines and other sewerage facilities completed after [[]July 7, 2014,[]] shall comply with all applicable federal, state, and county environmental, design, and construction requirements [~~prior to~~] before acceptance by a county."

Your Committees received written comments in support of this measure from the Department of Hawaiian Home Lands.

Your Committees find that the Department of Hawaiian Home Lands manages sewer transmission lines that are to be transferred to the various counties for long-term management and maintenance. Your Committees further find that this measure will ensure that compliant sewer transmission lines are transferred to the counties in a timely manner.

Your Committees have amended this measure by changing the effective date to July 1, 2050, to facilitate further discussion on the measure.

Your Committee received testimony in support of this measure from the Department of Hawaiian Home Lands.

Your Committee finds that the Department of Hawaiian Home Lands manages sewer transmission lines that are to be transferred to the various counties for long term management and maintenance. The Department of Hawaiian Home Lands is currently in the process of ensuring that all sewer transmission lines serving Hawaiian home lands are in compliance or are brought into compliance with all applicable federal, state, and county environmental, design, and construction requirements. This measure will ensure that these sewer transmission lines are transferred to the various counties in a timely manner. The timely transfer of sewer lines from the Department of Hawaiian Home Lands to the appropriate counties will provide cost savings to the Department, allowing for more lots to be developed for applicants on the Department of Hawaiian Home Lands waiting list and other maintenance needs for lessees who reside on Hawaiian home lands.

The purpose of this measure is to require a county to accept, within 60 days after receipt of a completed application for maintenance request, license or dedication of all sewer transmission lines and other sewerage facilities servicing Hawaiian Home Lands that are brought into compliance by the Department of Hawaiian Home Lands.

Your Committee received testimony in support of this measure from the Department of Hawaiian Home Lands.

Your Committee finds that the Department of Hawaiian Home Lands manages sewer transmission lines that are to be transferred to the various counties for long-term management and maintenance. Your Committee further finds that this measure will help to ensure that these sewer transmission lines are transferred to the counties in a timely manner. Your Committee also finds that the cost savings for the Department of Hawaiian Home Lands from not having to manage and maintain sewer transmission lines would allow for more lots to be developed for applicants on the Department's waiting list and other maintenance needs for lessees who reside on Hawaiian Home Lands.

Your Committee has amended this measure by:

(1) Clarifying that a county is required to accept, within 60 days after receipt of a completed application for maintenance request, license or dedication of all sewer transmission lines and related sewerage facilities servicing Hawaiian Home Lands that are brought into compliance by the Department of Hawaiian Home Lands; and

(2) Making technical, nonsubstantive amendments for the purposes of clarity, consistency, and style.

As affirmed by the record of votes of the members of your Committee on Judiciary & Hawaiian Affairs that is attached to this report, your Committee is in accord with the intent and purpose of H.B. No. 1091, as amended herein, and recommends that it pass Second Reading in the form attached hereto as H.B. No. 1091, H.D. 1, and be placed on the calendar for Third Reading.
