A BILL FOR AN ACT
MAKING EMERGENCY APPROPRIATIONS FOR LAW ENFORCEMENT PERSONNEL COSTS.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 2. The legislature finds that section 3 of Act 164, Session Laws of Hawaii 2023, as amended by Act 230, Session Laws of Hawaii 2024, appropriated general funds to the department of accounting and general services in fiscal year 2024-2025 for an interdepartmental transfer to the department of law enforcement for payroll costs of sheriffs. Similarly, section 3 of Act 70, Session Laws of Hawaii 2023, as amended by Act 233, Session Laws of Hawaii 2024, appropriated general funds in fiscal year 2024-2025 to the judiciary for an interdepartmental transfer to the department of law enforcement for payroll costs of sheriffs.
While appropriations for payroll costs out of the general fund exclude fringe benefit costs, fringe benefits must be included if an appropriation for an interdepartmental transfer is used to fund positions. Because these aforementioned appropriation amounts did not include fringe benefits, a critical funding shortage exists, and additional funds must be appropriated to cover fringe benefit costs for affected law enforcement personnel of the department of law enforcement.
The purpose of this Act is to make emergency appropriations to the department of accounting and general services and the judiciary to provide funds to cover payroll and fringe benefits of affected law enforcement personnel.
SECTION 3. There is appropriated out of the general revenues of the State of Hawaii the sum of $2,480,509 or so much thereof as may be necessary in fiscal year 2024-2025 for an interdepartmental transfer from the department of accounting and general services to the department of law enforcement for personnel costs, including payroll and fringe benefits.
The sum appropriated shall be expended by the department of accounting and general services for the purposes of this Act.
SECTION 4. There is appropriated out of the general revenues of the State of Hawaii the sum of $4,673,616 or so much thereof as may be necessary in fiscal year 2024-2025 for an interdepartmental transfer from the judiciary to the department of law enforcement for personnel costs, including payroll and fringe benefits.
The sum appropriated shall be expended by the judiciary for the purposes of this Act.
SECTION 5. There is appropriated out of interdepartmental transfer funds the sum of $7,154,125 or so much thereof as may be necessary for fiscal year 2024-2025 for personnel costs, including payroll and fringe benefits.
The sum appropriated shall be expended by the department of law enforcement.
SECTION 6. In accordance with section 9 of article VII of the Constitution of the State of Hawaii and sections 37-91 and 37-93, Hawaii Revised Statutes, the legislature has determined that at the beginning of the regular session of 2025, the general fund expenditure ceiling for fiscal year 2024-2025 was exceeded by $8,551,795, or one per cent. The appropriations contained in Act 1, Session Laws of Hawaii 2025, caused the general fund expenditure ceiling for fiscal year 2024-2025 to be further exceeded by an additional $30,334,159. Therefore, the general fund expenditure ceiling for fiscal year 2024-2025 has already been exceeded by $38,885,954, or one per cent.
The appropriations contained in this Act will cause the general fund expenditure ceiling for fiscal year 2024-2025 to be further exceeded by $7,154,125, or one per cent. This declaration takes into account the additional general fund appropriations authorized for fiscal year 2024-2025 in this Act only. The reasons for exceeding the general fund expenditure ceiling are that the appropriations made in this Act are necessary to serve the public interest and to meet the needs addressed by this Act.
SECTION 7. This Act shall take effect upon its approval.

Your Committee received written comments in support of this measure from the Judiciary, Department of Accounting and General Services, and Department of Budget and Finance.
Your Committee finds that moneys were appropriated to the Department of Accounting and General Services and Judiciary in fiscal year 2024-2025 for interdepartmental transfers to the Department of Law Enforcement for payroll costs of sheriffs. However, the appropriation amounts did not include fringe benefits, creating a critical funding shortage. Your Committee further finds that the emergency appropriations made by this measure will pay for these fringe benefit costs.
Your Committee has amended this measure by:
(1) Amending the declaration that the state general fund expenditure ceiling for fiscal year 2024-2025 has been exceeded to reflect the amounts by which the ceiling has been exceeded;
(2) Changing the effective date to July 1, 2050, to facilitate further discussion on the measure; and
(3) Making technical nonsubstantive amendments for purposes of clarity, consistency, and style.
Your Committee respectfully requests that your Committee on Conference, should it convene to deliberate on this measure, consider the testimony of the Department of Budget and Finance, which recommended that this measure be amended by:
(1) Appropriating $2,408,509 for the Department of Accounting and General Services and $4,673,516 for the Judiciary; and
(2) Inserting a new section that makes a commensurate appropriation of $7,154,125 in interdepartmental transfer funds for fiscal year 2024-2025, to be expended by the Department of Law Enforcement for personnel costs, including payroll and fringe benefits.
As affirmed by the record of votes of the members of your Committee on Ways and Means that is attached to this report, your Committee is in accord with the intent and purpose of H.B. No. 1045, H.D. 1, as amended herein, and recommends that it pass Third Reading in the form attached hereto as H.B. No. 1045, H.D. 1, S.D. 1.
Respectfully submitted on behalf of the members of the Committee on Ways and Means,

STAND. COM. REP. NO. 1124
Honolulu, Hawaii
RE: H.B. No. 1045
H.D. 1
Honorable Ronald D. Kouchi
President of the Senate
Thirty-Third State Legislature
Regular Session of 2025
State of Hawaii
Sir:
Your Committee on Public Safety and Military Affairs, to which was referred H.B. No. 1045, H.D. 1, entitled:
"A BILL FOR AN ACT MAKING EMERGENCY APPROPRIATIONS FOR LAW ENFORCEMENT PERSONNEL COSTS,"
begs leave to report as follows:
The purpose and intent of this measure is to make emergency appropriations for fiscal year 2024-2025 to the Department of Accounting and General Services and the Judiciary for payroll and fringe benefits of affected Department of Law Enforcement personnel.
Your Committee received testimony in support of this measure from the Judiciary, Department of Accounting and General Services, Department of Budget and Finance, Department of Law Enforcement, and one individual.
Your Committee finds that section 3 of Act 164, Session Laws of Hawaii 2023, as amended by Act 230, Session Laws of Hawaii 2024, appropriated funds to the Department of Accounting and General Services for fiscal year 2024-2025 for transfer payments to the Department of Law Enforcement for payroll costs of sheriffs. Similarly, section 3 of Act 70, Session Laws of Hawaii 2023, as amended by Act 233, Session Laws of Hawaii 2024, appropriated general funds for fiscal year 2024-2025 to the Judiciary for transfer payments to the Department of Law Enforcement for payroll costs of sheriffs. While appropriations out of the general fund of the State exclude fringe benefit costs, fringe benefits must be included if an appropriation from a non-general fund is used to fund positions.
Your Committee further finds that because these aforementioned appropriations did not include fringe benefits, a critical funding shortage exists. This measure will address this shortage by appropriating additional funds to cover fringe benefit costs.
Your Committee notes that this measure contains an unspecified appropriation amount. Should your Committee on Ways and Means choose to deliberate on this measure, your Committee respectfully requests that it consider inserting:
(1) An appropriation amount of $2,480,509 in fiscal year 2024-2025 for an interdepartmental transfer from the Department of Accounting and General Services to the Department of Law Enforcement for personnel costs, including payroll and fringe benefits; and
(2) An amount of $4,673,616 in fiscal year 2024-2025 an interdepartmental transfer from the Judiciary to the Department of Law Enforcement for personnel costs, including payroll and fringe benefits.
Your Committee further notes that this measure contains an unspecified monetary amount and an unspecified percentage in excess of the state general fund expenditure ceiling for fiscal year 2024-2025. Should your Committee on Ways and Means choose to deliberate on this measure, your Committee respectfully requests that it consider a inserting monetary amount of $8,551,795 or one percent for the amount by which the state general fund expenditure ceiling for fiscal year 2024-2025 will be exceeded.
As affirmed by the record of votes of the members of your Committee on Public Safety and Military Affairs that is attached to this report, your Committee is in accord with the intent and purpose of H.B. No. 1045, H.D. 1, and recommends that it pass Second Reading and be referred to your Committee on Ways and Means.
Respectfully submitted on behalf of the members of the Committee on Public Safety and Military Affairs,
