What does this bill do?

This amendment changes the bill to say the State’s general fund spending limit for fiscal year 2024–2025 will be exceeded by 2 percent (about $105,698,787) because of the bill’s appropriations, rather than the previously stated 1 percent.

SECTION 1. House Bill No. 1026, H.D. 1, S.D. 1, C.D. 1, section 12, is amended by declaring that the appropriations in this measure will cause the general fund expenditure ceiling for fiscal year 2024-2025 to be further exceeded by 2 percent, rather than 1 percent, to read as follows:

"SECTION 12. In accordance with section 9 of article VII of the Constitution of the State of Hawaii and sections 37-91 and 37-93, Hawaii Revised Statutes, the legislature has determined that at the beginning of the regular session of 2025, the general fund expenditure ceiling for fiscal year 2024-2025 was exceeded by $8,551,795 or one per cent. The appropriations contained in Act 1, Session Laws of Hawaii 2025 caused the general fund expenditure ceiling for fiscal year 2024-2025 to be further exceeded by an additional $30,334,159. Therefore, the general fund expenditure ceiling for fiscal year 2024-2025 has already been exceeded by $38,885,954 or 1 per cent.

The appropriations contained in this Act will cause the general fund expenditure ceiling for fiscal year 2024-2025 to be further exceeded by $105,698,787, or 2 per cent. This declaration takes into account the additional general fund appropriations authorized for fiscal year 2024-2025 in this Act only. The reasons for exceeding the general fund expenditure ceiling are that the appropriations made in this Act are necessary to serve the public interest and to meet the needs addressed by this Act."

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

PART I

SECTION 1. This Act is recommended by the governor for immediate passage in accordance with section 9 of article VII of the Constitution of the State of Hawaii.

PART II

SECTION 2. There is appropriated from the sources of funding indicated below to collective bargaining statewide (BUF 102) the following sum or so much thereof as may be necessary to fund for fiscal biennium 2023‑2025 all collective bargaining cost items in the agreement negotiated with the exclusive representative of collective bargaining units (2), (3), (4), (8), (9), (10), (13), and (14) and their excluded counterparts. These amounts are in addition to the amounts provided in Act 49, Session Laws of Hawaii 2024:

SECTION 3. Funds appropriated by this part shall be allotted by the director of finance to the appropriate state departments for expenditure in the respective fiscal year for the purposes of this part.

SECTION 4. There are appropriated or authorized from the sources of funding indicated below to collective bargaining statewide (BUF102) the following sums or so much there of as may be necessary to fund for fiscal biennium 2023-2025 all collective bargaining cost items in the agreement negotiated with the exclusive representative of collective bargaining units (1) and (10) and their excluded counterparts. These are for separate arbitration awards for the department of education, the University of Hawaii, and other state departments:

There is appropriated from the source of funding indicated below to Hawaii health systems corporation – corporate office (HTH 210) the following sum or so much thereof as may be necessary to fund for fiscal year 2023‑2025 the collective bargaining cost items in the agreement negotiated with the exclusive representative of collective bargaining units (1) and (10) who are assigned to the Hawaii health systems corporation:

SECTION 7. Funds appropriated by this part shall be allotted by the director of finance to the Hawaii health systems corporation for expenditure in the respective fiscal year for the purposes of this part.

SECTION 8. There are appropriated or authorized from the sources of funding indicated below to collective bargaining statewide (BUF 102) the following sums or so much thereof as may be necessary to fund for fiscal biennium 2023-2025 all collective bargaining cost items in the agreement negotiated with the exclusive representative of collective bargaining unit (11) and their excluded counterparts:

SECTION 9. Funds appropriated or authorized by this part shall be allotted by the director of finance to the appropriate state departments for expenditure in the respective fiscal year for the purposes of this part.

Part VI

SECTION 10. Salary increases and cost adjustments provided in this Act for any officer or employee whose compensation is paid, in whole or in part, from federal, special, or other funds shall be paid wholly or proportionately, as the case may be, from the respective funds, provided that if the respective funds are unable to support such payments, appropriations from other means of financing may be used with the approval of the Governor.

SECTION 11. Funds appropriated or authorized by this Act that are not expended or encumbered by June 30, 2026, shall lapse as of that date.

SECTION 12. In accordance with section 9 of article VII of the Constitution of the State of Hawaii and sections 37-91 and 37-93, Hawaii Revised Statutes, the legislature has determined that at the beginning of the regular session of 2025, the general fund expenditure ceiling for fiscal year 2024-2025 was exceeded by $8,551,795 or one per cent. Part V

SECTION 8. Salary increases and cost adjustments provided in this Act for any officer or employee whose compensation is paid, in whole or in part, from federal, special, or other funds shall be paid wholly or proportionately, as the case may be, from the respective funds.

SECTION 9. Notwithstanding any provision of this Act, with the approval of the governor, the director of finance may transfer between parts II and IV of this Act the unrequired balances as may be available from the appropriated funds of parts II and IV of this Act as necessary.

SECTION 10. Funds appropriated or authorized by this Act that are not expended or encumbered by June 30, 2025, shall lapse as of that date.

SECTION 11. Your Committee on Conference on the disagreeing vote of the House of Representatives to the amendments proposed by the Senate in H.B. No. 1026, H.D. 1, S.D. 1, entitled:

"A BILL FOR AN ACT MAKING EMERGENCY APPROPRIATIONS FOR PUBLIC EMPLOYMENT COST ITEMS,"

having met, and after full and free discussion, has agreed to recommend and does recommend to the respective Houses the final passage of this bill in an amended form.

The purpose of this measure is to make emergency appropriations for collective bargaining cost items for the members of Bargaining Units (1), (2), (3), (4), (8), (9), (10), (13), and (14) and their excluded counterparts, including the cost of salary adjustments negotiated between the State and the bargaining unit representative for fiscal year 2024-2025.

Your Committee on Conference has amended this measure by:

(1) Inserting the appropriate figures for fiscal biennium 2023-2025 based upon the amounts for Collective Bargaining Units (1), (2), (3), (4), (8), (9), (10), (13), and (14) as indicated in the Governor's Message dated April 24, 2025;

(2) Changing the effective date to upon approval; and

(3) Making technical, nonsubstantive amendments for clarity, consistency, and style.

As affirmed by the record of votes of the managers of your Committee on Conference that is attached to this report, your Committee on Conference is in accord with the intent and purpose of H.B. Your Committee received written comments in support of this measure from the Department of Budget and Finance, University of Hawaii System, United Public Workers, Hawaii Government Employees Association, and Hawaii Health Systems Corporation.

Your Committee finds that this measure serves as a legislative vehicle that may be used to make emergency appropriations for negotiated cost items due to arbitration awards and temporary hazard pay settlements.

Your Committee respectfully requests that if a Committee on Conference is convened to hear this measure, the Committee on Conference consider the testimony of the Hawaii Health Systems Corporation, which requests an appropriation of general funds to pay for certain unfunded costs.

Your Committee received testimony in support of this measure from the Department of Budget and Finance; University of Hawaiʻi System; United Public Workers AFSCME Local 646, AFL-CIO; Hawaii Government Employees Association AFSCME Local 152, AFL-CIO; and Hawaii Health Systems Corporation.

Your Committee finds that Act 49, Session Laws of Hawaii 2024, (Act 49), which made emergency appropriations for collective bargaining cost items, public employment cost items, and cost adjustments for agencies excluded from collective bargaining, was based on estimated amounts. Based on the first payments made in October and November of 2024, the estimates within Act 49 are insufficient to cover necessary funding costs. Your Committee further finds that multiple arbitration awards and settlement agreements, including an agreement reached with the Hawaiʻi Firefighters, have exacerbated the need for additional funding. Accordingly, this measure will ensure the effective operation of the State by providing appropriations for negotiated cost items due to arbitration awards and temporary hazard pay settlements. This measure serves as a legislative vehicle that may be used to make emergency appropriations upon the Legislature's receipt of the final appropriation amounts.

Your Committee has amended this measure by:

(1) Inserting an effective date of July 1, 2050, to encourage further discussion; and

(2) Making technical, nonsubstantive amendments for the purposes of clarity and consistency.
