A BILL FOR AN ACT
RELATING TO PUBLIC SCHOOL LAND TRANSFER.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
Accordingly, the purpose of this Act is to:
(1) Revise certain tax map key numbers set forth in section 2 of Act 307, Session Laws of Hawaii 2022, for accuracy or due to a change in circumstances; and
(2) Revise the process by which properties were, or may in the future, be conveyed to the department of education pursuant to Act 307, Session Laws of Hawaii 2022.
SECTION 2. Act 307, Session Laws of Hawaii 2022, is amended by amending section 2 to read as follows:
"SECTION 2. (a) Notwithstanding any other law to the contrary, the fee simple interest to the parcels of land set forth in this section, together with the existing improvements thereon, but not including submerged land, accreted land, or any land makai of the legal shoreline (collectively, the properties), shall be conveyed by their respective owner or owners to the department of education as grantee, as is, where is. The department of education shall accept the properties in their existing condition. All claims and liabilities against the grantors, if any, that the department of education has, may have had, or may have in the future, regarding any injury, loss, cost, damage, or liability, including reasonable attorney's fees, concerning the physical, environmental, soil, economic, and legal conditions of the properties, shall be released, waived, and extinguished.
(b) The transfer of the properties pursuant to
this Act shall be effective by operation of law as of July 1, 2022. The respective owner or owners of the
properties shall prepare, execute, and record, in the [land court or bureau
of conveyances,] office of the assistant registrar of the land court of
the State of Hawaii or the State of Hawaii bureau of conveyances, as
appropriate, a quitclaim deed [to convey each of] or other conveyance
instrument to evidence and formally document the conveyance of each of the
properties together with all existing improvements. [Work to initiate the conveyance of the
properties shall commence no later than December 31, 2022. As an alternative to conveyance instruments
for each parcel of state or county owned land, the transfer of such lands shall
be completed by operation of law.] Where
applicable and in the discretion of the department of education, the department
of education may elect to obtain all or a portion of each parcel identified by
this Act. If the department of education
elects to obtain a portion or portions of any parcel identified by this Act,
then the parties to the conveyance shall take all actions necessary to legally
effect the same.
(c) As these are conveyances in which the county and the State and its agencies are the only parties, the tax imposed by section 247-1, Hawaii Revised Statutes, shall not apply.
(d) Effective [on the date of transfer,] as
of July 1, 2022, every reference to the titleholder of the properties shall
be construed as a reference to the department of education[.] irrespective
of whether a quitclaim deed or other conveyance document has been recorded in
the office of the assistant registrar of the land court of the State of Hawaii
or the State of Hawaii bureau of conveyances, as applicable.
(e) Parcels to be conveyed by the county of Kauai, identified by tax map key number, are as follows:

A BILL FOR AN ACT
RELATING TO PUBLIC SCHOOL LAND TRANSFER.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
Accordingly, the purpose of this Act is to:
(1) Revise certain tax map key numbers set forth in section 2 of Act 307, Session Laws of Hawaii 2022, for accuracy or due to a change in circumstances; and
(2) Revise the process by which properties were, or may in the future, be conveyed to the department of education pursuant to Act 307, Session Laws of Hawaii 2022.
SECTION 2. Act 307, Session Laws of Hawaii 2022, is amended by amending section 2 to read as follows:
"SECTION 2. (a) Notwithstanding any other law to the contrary, the fee simple interest to the parcels of land set forth in this section, together with the existing improvements thereon, but not including submerged land, accreted land, or any land makai of the legal shoreline (collectively, the properties), shall be conveyed by their respective owner or owners to the department of education as grantee, as is, where is. The department of education shall accept the properties in their existing condition. All claims and liabilities against the grantors, if any, that the department of education has, may have had, or may have in the future, regarding any injury, loss, cost, damage, or liability, including reasonable attorney's fees, concerning the physical, environmental, soil, economic, and legal conditions of the properties, shall be released, waived, and extinguished.
(b) The transfer of the properties pursuant to
this Act shall be effective by operation of law as of July 1, 2022. The respective owner or owners of the
properties shall prepare, execute, and record, in the [land court or bureau
of conveyances,] office of the assistant registrar of the land court of
the State of Hawaii or the State of Hawaii bureau of conveyances, as
appropriate, a quitclaim deed [to convey each of] or other conveyance
instrument to evidence and formally document the conveyance of each of the
properties together with all existing improvements. [Work to initiate the conveyance of the
properties shall commence no later than December 31, 2022. As an alternative to conveyance instruments
for each parcel of state or county owned land, the transfer of such lands shall
be completed by operation of law.] Where
applicable and in the discretion of the department of education, the department
of education may elect to obtain all or a portion of each parcel identified by
this Act. If the department of education
elects to obtain a portion or portions of any parcel identified by this Act,
then the parties to the conveyance shall take all actions necessary to legally
effect the same.
(c) As these are conveyances in which the county and the State and its agencies are the only parties, the tax imposed by section 247-1, Hawaii Revised Statutes, shall not apply.
(d) Effective [on the date of transfer,] as
of July 1, 2022, every reference to the titleholder of the properties shall
be construed as a reference to the department of education[.] irrespective
of whether a quitclaim deed or other conveyance document has been recorded in
the office of the assistant registrar of the land court of the State of Hawaii
or the State bureau of conveyances, as applicable.

A BILL FOR AN ACT
RELATING TO PUBLIC SCHOOL LAND TRANSFER.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
Accordingly, the purposes of this Act are to:
(1) Revise certain tax map key numbers set forth in section 2 of Act 307, Session Laws of Hawaii 2022, for accuracy or changed circumstances; and
(2) Revise the process by which properties were, or may in the future be conveyed to the department of education pursuant to Act 307, Session Laws of Hawaii 2022.
SECTION 2. Act 307, Session Laws of Hawaii 2022, is amended by amending section 2 to read as follows:
"SECTION 2. (a) Notwithstanding any other law to the contrary, the fee simple interest to the parcels of land set forth in this section, together with the existing improvements thereon, but not including submerged land, accreted land, or any land makai of the legal shoreline (collectively, the properties), shall be conveyed by their respective owner or owners to the department of education as grantee, as is, where is. The department of education shall accept the properties in their existing condition. All claims and liabilities against the grantors, if any, that the department of education has, may have had, or may have in the future, regarding any injury, loss, cost, damage, or liability, including reasonable attorney's fees, concerning the physical, environmental, soil, economic, and legal conditions of the properties, shall be released, waived, and extinguished.
(b) The
transfer of the properties pursuant to this Act shall be effective by operation
of law as of July 1, 2022. The
respective owner or owners of the properties shall prepare, execute, and
record, in the [land court or bureau of conveyances,] office of the
assistant registrar of the land court of the State of Hawaii or the State of
Hawaii bureau of conveyances, as appropriate, a quitclaim deed [to
convey each of] or other conveyance instrument to evidence and formally
document the conveyance of each of the properties together with all
existing improvements. [Work to
initiate the conveyance of the properties shall commence no later than December
31, 2022. As an alternative to
conveyance instruments for each parcel of state or county owned land, the
transfer of such lands shall be completed by operation of law.] Where applicable and in the discretion of the
department of education, the department of education may elect to obtain all or
a portion of each parcel identified by this Act. If the department of education elects to
obtain a portion or portions of any parcel identified by this Act, then the
parties to the conveyance shall take all actions necessary to legally effect
the same.
(c) As these are conveyances in which the county and the State and its agencies are the only parties, the tax imposed by section 247-1, Hawaii Revised Statutes, shall not apply.
(d) Effective
[on the date of transfer,] as of July 1, 2022, every reference to
the titleholder of the properties shall be construed as a reference to the
department of education[.] irrespective of whether a quitclaim deed
or other conveyance document has been recorded in the office of the assistant
registrar of the land court of the State of Hawaii or the State bureau of
conveyances.

Your Committee on Water & Land, to which was referred H.B. No. 2294, H.D. 1, entitled:
"A BILL FOR AN ACT RELATING TO PUBLIC SCHOOL LAND TRANSFER,"
begs leave to report as follows:
Your Committee received testimony in support of this measure from the Department of Education. Your Committee received comments on this measure from the Hawaiʻi State Public Library System.
Your Committee finds that the primary goal of this measure is to ensure the orderly and legal transfer of fee simple title to certain lands owned by the Department of Land and Natural Resources, County of Kauai, and County of Maui to the Department of Education. Your Committee further finds that this measure provides necessary technical corrections or revisions to Tax Map Key numbers that have changed due to further verification of information, parcel consolidation or subdivision, or changes in circumstances since the passage of Act 307. Your Committee also finds that this measure eliminates ambiguity regarding the Department's authority over these parcels by specifying that these transfers are effective by operation of law as of July 1, 2022, the effective date of Act 307.
Your Committee notes that the Hawaii State Public Library System has sole responsibility of all public libraries in the State, including public and school libraries located on or adjacent to school campuses. However, the Hawaii State Public Library System is overseen by the Board of Education and State Librarian, not within the Department of Education. Accordingly, the transfers to the Department of Education of lands on which public libraries are situated are inappropriate and conflict with the separate oversight provided to the Hawaii State Public Library System.
Accordingly, your Committee has amended this measure by:
(1) Specifying that lands beneath public libraries are exempt from the transfer to the Department of Education and shall remain with the Department of Land and Natural Resources; and
(2) Making a technical, nonsubstantive amendment for the purposes of clarity, consistency, and style.
Your Committee respectfully requests your Committee on Finance, should it deliberate on this measure, to examine the parcels on which a public library is situated that should be specifically modified or excluded from the transfer to the Department of Education.
As affirmed by the record of votes of the members of your Committee on Water & Land that is attached to this report, your Committee is in accord with the intent and purpose of H.B. No. 2294, H.D. 1, as amended herein, and recommends that it be referred to your Committee on Finance in the form attached hereto as H.B. No. 2294, H.D. 2.

Your Committee received testimony in support of this measure from the Department of Education.
Your Committee finds that, to consolidate the ownership of all land under existing public schools to be held by the Department of Education, Act 307, Session Laws of Hawaii 2022 (Act 307), was enacted to direct the conveyance of the fee simple title to certain lands owned by the Department of Land and Natural Resources, County of Kauai, and County of Maui to the Department of Education. Your Committee further finds that, since the enactment of Act 307, further verification of information and changes in circumstances require the revision of certain tax map key numbers. This measure revises the tax map keys numbers in Act 307 to update the list of properties to be conveyed.
Additionally, this measure also allows more flexibility in the conveyance of these lands and provides that all transfers of the listed properties in Act 307 were effective by operation of law on the date Act 307 was enacted.
Your Committee has amended this measure by:
(1) Transferring Wilcox Elementary School from the Department of Education to the County of Kauai rather than from the County of Kauai to the Department of Education;
(2) Changing the effective date to July 1, 3000; and
(3) Making technical, nonsubstantive amendments for the purposes of clarity, consistency, and style.
As affirmed by the record of votes of the members of your Committee on Education that is attached to this report, your Committee is in accord with the intent and purpose of H.B. No. 2294, as amended herein, and recommends that it pass Second Reading in the form attached hereto as H.B. No. 2294, H.D. 1, and be referred to your Committee on Water & Land.
