What does this bill do?

The bill lets the Department of Education skip the state electronic procurement process when buying local edible produce and packaged local food. It applies to purchases of any size if the local items cost no more than 5% more than non‑local alternatives, and those buys must be made using at least three written quotes instead of the electronic system.

SECTION 1. Section 302A-1317, Hawaii Revised Statutes, is amended to read as follows:

"[[]§302A-1317[]] Local edible produce and packaged food products procurement; small purchases. Notwithstanding section 103D-305(c) and any other law to the contrary, procurements of [~~less~~]:

(1) Less than $250,000 for local edible produce and packaged food products for the department; or

(2) Any amount for local edible produce and packaged food products for the department that cost no more than five per cent more than non-local alternatives,

shall be exempt from the requirement to conduct procurements through an electronic system and shall instead be subject to no [~~less~~] fewer than three written quotes; provided that if the department is unable to receive the required number of written notifications as required by this section, written justification shall be provided and kept by the department.

For the purposes of this section, "non-local alternatives" means food products that do not meet the definition of "fresh local agricultural products" or "local value-added, processed, agricultural, or food products" as defined in section 27-8."

SECTION 2. Statutory material to be repealed is bracketed and stricken. New statutory material is underscored.

SECTION 3. This Act shall take effect on July 1, 3000.

The purpose and intent of this measure is to increase the availability of local edible produce and packaged food products in public school meals.

Specifically, this measure exempts from the requirement to conduct procurement through an electronic system the procurement of local edible produce and packaged food products for the Department of Education that cost not more than five per cent more than non-local alternatives.

Your Committee received written comments in support of this measure from the Hawaii Farm Bureau, Hawaii Farmers Union, and Agriculture Stewardship Hawai`i.

Your Committee received written comments on this measure from the Department of Education and State Procurement Office.

Your Committee finds that increasing the availability of locally produced food for use in school meals will support the State's agriculture industry and increase food production sustainability. Your Committee further finds that this measure facilitates the Department of Education's purchase of local edible produce and packaged food products by exempting these procurements from certain requirements of the Hawaii Public Procurement Code.

The purpose and intent of this measure is to exempt from the Hawaii Public Procurement Code procurements by the Department of Education of any amount of local edible produce and packaged food products that do not cost more than five percent of non-local alternatives.

Your Committee received testimony in support of this measure from the Department of Education, Hawaiʻi Farm Bureau, and three individuals.

Your Committee received comments on this measure from the Department of the Attorney General and State Procurement Office.

Your Committee finds that increasing the percentage of locally sourced products used for the Department of Education's school meal program is integral to achieving the State's food system sustainability and public health goals. While locally sourced products often cost more than imported alternatives, their procurement for school meals supports local agricultural production and healthier foods for students. By simplifying the procurement process, this measure can help reduce the cost and increase the feasibility of procuring more locally sourced foods for school meals.

Your Committee acknowledges the concerns raised in testimony by the Department of the Attorney General that the term "non-local alternatives" is not defined in this measure or the Hawaii Revised Statutes, which may cause confusion. Therefore, amendments to this measure are necessary to address this matter.

Accordingly, your Committee has amended this measure by:

(1) Inserting a definition for "non-local alternatives"; and

(2) Making technical, nonsubstantive amendments for the purposes of clarity and consistency.

As affirmed by the record of votes of the members of your Committee on Education that is attached to this report, your Committee is in accord with the intent and purpose of S.B. No. 3063, as amended herein, and recommends that it pass Second Reading in the form attached hereto as S.B. No. 3063, S.D. 1, and be referred to your Committee on Ways and Means.
