A BILL FOR AN ACT

RELATING TO VEHICLE SAFETY.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

     SECTION 1.  Section 286-25, Hawaii Revised Statutes, is amended to read as follows:

     "§286-25  Operation of a vehicle or moped without a certificate of inspection.  Whoever operates, permits the operation of, causes to be operated, or parks any vehicle or moped on a public highway without a current official certificate of inspection, issued under section 286-26, shall be fined [not] no more than [$100.]:

     (1)  $150 for a first offense; and

     (2)  $250 for a second offense within ten years of a prior offense;

provided that the fine shall be no more than $           for any offense where the certificate of inspection is more than two years expired."

     SECTION 2.  This Act does not affect rights and duties that matured, penalties that were incurred, and proceedings that were begun before its effective date.

     SECTION 3.  Statutory material to be repealed is bracketed and stricken.  New statutory material is underscored.

     SECTION 4.  This Act shall take effect on July 1, 3000.

Madame:

     Your Committee on Transportation, to which was referred H.B. No. 227 entitled:

"A BILL FOR AN ACT RELATING TO VEHICLE SAFETY,"

begs leave to report as follows:

     The purpose of this measure is to establish a maximum fine for offenses where the certificate of inspection for vehicles or mopeds are expired for more than two years.

     Your Committee received testimony in support of this measure from the Department of Transportation.

     Your Committee finds that worn or faulty components on motor vehicles and mopeds may fail while in operation and that regular safety inspections minimize the potential for component failure and increase safety for drivers, passengers, and the public.  Your Committee further finds that existing penalties are insufficient to deter individuals from continuing to operate a vehicle or moped without a valid certificate of inspection.

     Your Committee has amended this measure by:

     (1)  Increasing the fines for the first offense and second offense within ten years of a prior offense to a maximum of $150 and $250, respectively;

     (2)  Inserting a savings clause;

     (3)  Changing the effective date to July 1, 3000, to encourage further discussion; and

     (4)  Making technical, nonsubstantive amendments for the purposes of clarity, consistency, and style.

     As affirmed by the record of votes of the members of your Committee on Transportation that is attached to this report, your Committee is in accord with the intent and purpose of H.B. No. 227, as amended herein, and recommends that it pass Second Reading in the form attached hereto as H.B. No. 227, H.D. 1, and be referred to your Committee on Judiciary & Hawaiian Affairs.
