What does this bill do?
The bill lets the Governor’s appointee serve both the remainder of a vacant legislative term and the following full term for state senators and representatives. It applies when the seat becomes vacant because the incumbent died or became permanently incapacitated after the filing deadline but before the primary, and the incumbent was the only name on the ballot for that seat.
The summary is provided by generative AI which can make mistakes. For original language, please view the details in the table below.
Establishes that if the death or permanent incapacitation of the prior incumbent leaves a legislative seat vacant before a primary election, but after the close of filing for candidacy in that election, and the prior incumbent's name was the only name on any ballot for that seat for that election, the Governor's appointment of a replacement shall be valid for both the unexpired term and the succeeding term.
