A BILL FOR AN ACT

RELATING TO CAPITAL ADVANCEMENT CONTRACTS.

\r\n\r\n

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

\r\n\r\n

\r\n\r\n
\r\n\r\n\r\n

\r\n\r\n

\xa0\xa0\xa0\xa0 SECTION 1.\xa0 Section\r\n266-19.5, Hawaii Revised Statutes, is amended by amending subsection (d) to\r\nread as follows:

\r\n\r\n

\xa0\xa0\xa0\xa0 "(d)\xa0\r\nThe department of transportation may execute capital advancement\r\ncontracts pursuant to subsection (a) with a total contract value of [~~$2,000,000~~]\r\n$5,000,000 or less without legislative approval.\xa0 [If the total value of a capi'b"tal\r\nadvancement contract pursuant to subsection (a) is greater than $2,000,000 then\r\nthe department of transportation shall obtain legislative approval in the form\r\nof the adoption of a concurrent resolution affirming the purpose, project, and\r\ncontract issuance prior to executing the capital advancement contract.]\xa0 The total aggregate value of all capital\r\nadvancement contracts entered into by the department pursuant to this section\r\nshall not exceed [~~$5,000,000~~] $20,000,000 in any [~~calendar~~]\r\nfiscal year.\xa0 The department\r\nshall submit a report to the legislature of all executed capital advancement\r\ncontracts for the previous twelve month period from July 1 to June 30 no later\r\nthan twenty days prior to the convening of the regular session of 2026 and each\r\nregular session thereafter."
