A BILL FOR AN ACT

\r\n\r\n

RELATING TO FIREWORKS.

\r\n\r\n

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

\r\n\r\n

\r\n\r\n
\r\n\r\n\r\n

\r\n\r\n

\xa0\xa0\xa0\xa0 SECTION 1.\xa0 The legislature finds that improved enforcement\r\nof the fireworks control laws is necessary, not only to protect property from avoidable\r\nfire damage, but also to protect the community from fire- and explosion-related\r\ninjuries, respiratory distress caused by the air pollution, and recurring trauma\r\nto afflicted persons due to loud explosions.

\r\n\r\n

\xa0\xa0\xa0\xa0 The legislature further finds that a more robust continuum of enforcement mechanisms must be established to promote compliance\r\nwith the fireworks control laws, including graduated penalties for repeat or felony\r\nlevel of'b'fenses, enhanced penalties for offenses that result in injury or death,\r\nand a dedicated adjudication system for fireworks infractions, similar to the existing\r\ntraffic infraction system.\xa0 Creating a fireworks\r\ninfractions system will allow law enforcement agencies and the judiciary to quickly\r\nand efficiently process low-level cases, while also allowing them to prioritize\r\nhigher-level cases as appropriate.

\r\n\r\n

\xa0\xa0\xa0\xa0 SECTION 2.\xa0 The Hawaii Revised Statutes\r\nis amended by adding to title 38 a new chapter to be appropriately designated and\r\nto read as follows:

\r\n\r\n

"CHAPTER

\r\n\r\n

ADJUDICATION OF FIREWORKS INFRACTIONS

\r\n\r\n

\xa0\xa0\xa0\xa0 \xa7\xa0\xa0 -1\xa0 Definitions.\xa0 As used in this chapter:

\r\n\r\n

\xa0\xa0\xa0\xa0 "Concurrent trial" means a trial proceeding held in the\r\ndistrict or family court in which the defendant is tried simultaneously in a civil\r\ncase for any charged fireworks infraction and in a criminal case for any related\r\ncriminal offense, with trials to be held in one court on the same date and at the\r\nsame time.

\r\n\r\n

\xa0\xa0\xa0\xa0 "Fireworks infraction" means any violation of chapter 132D,\r\nany rule adopted pursuant to chapter 132D, or any county ordinance or rule enacted\r\npursuant to chapter 132D, for which the prescribed penalties do not include imprisonment\r\nand that are not otherwise specifically excluded from coverage of this chapter.\r\n\r\n

\xa0\xa0\xa0\xa0 "Hearing" means a proceeding conducted by the district\r\ncourt pursuant to section\xa0\xa0\xa0 -7 at which the\r\ndefendant to whom a notice of infraction was issued either admits to the infraction,\r\ncontests the infraction, or admits to the infraction but offers an explanation to\r\nmitigate the monetary assessment imposed.

\r\n\r\n

\xa0\xa0\xa0\xa0 "Law enforcement officer" means any employee of any county,\r\nstate, federal, or military agency authorized by law to issue a notice of infraction.

\r\n\r\n

\xa0\xa0\xa0\xa0 "Notice of infraction" means the citation form that is\r\nissued to the defendant at or after the time of the fireworks infraction and notifies\r\nthe defendant of the infraction the defendant is charged with committing.

\r\n\r\n

\xa0\xa0\xa0\xa0 "Related criminal offense" means any criminal violation\r\nor crime, committed in the same course of conduct as a fireworks infraction, for\r\nwhich the defendant is arrested or charged.

\r\n\r\n

\xa0\xa0\xa0\xa0 "Trial" means a trial conducted by the district court pursuant\r\nto the rules of the district cour'b't and the Hawaii rules of evidence.

\r\n\r\n

\xa0\xa0\xa0\xa0 \xa7\xa0\xa0 -2\xa0 Applicability.\xa0 (a)\xa0 All\r\nfireworks infractions, including fireworks infractions committed by minors, shall\r\nbe adjudicated pursuant to this chapter, except as provided in subsection (b).\xa0 This chapter shall be applied uniformly throughout\r\nthe State and in all counties.\xa0 No penal sanction\r\nthat includes imprisonment shall apply to a violation of state statute or rule,\r\nor county ordinance or rule, that would constitute a fireworks infraction under\r\nthis chapter.\xa0 No fireworks infraction shall'b'\r\nbe classified as a criminal offense.

\r\n\r\n

\xa0\xa0\xa0\xa0 (b)\xa0 Where a defendant is charged\r\nwith a fireworks infraction and the fireworks infraction is committed in the same\r\ncourse of conduct as a criminal offense for which the offender is arrested or charged,\r\nthe fireworks infraction shall be adjudicated pursuant to this chapter; provided\r\nthat the court may schedule any initial appearance, hearing, or trial on the fireworks\r\ninfraction at the same date, time, and place as the arraignment, hearing, or trial\r\non the related criminal offense.

\r\n\r\n

\xa0\xa0\xa0\xa0 Notwithstanding this subsection or subsect'b'ion (c), the court shall\r\nnot schedule any initial appearance, hearing, or trial on the fireworks infraction\r\nat the same date, time, and place as the arraignment, hearing, or trial on the related\r\ncriminal offense where the related criminal offense is a felony or is a misdemeanor\r\nfor which the defendant has demanded a jury trial.

\r\n\r\n

\xa0\xa0\xa0\xa0 (c)\xa0 If the defendant requests\r\na trial pursuant to section\xa0\xa0\xa0 -11, the trial\r\nshall be held in the district court of the circuit in which the fireworks infraction\r\nwas committed.\xa0 If the court schedules a concurrent\r\ntrial pursuant to paragraph (1), the concurrent trial shall be held in the appropriate\r\ndistrict or family court of the circuit in which the fireworks i'b'nfraction was committed,\r\nwhichever has jurisdiction over the related criminal offense charged pursuant to\r\nthe applicable statute or rule of court; provided that:

\r\n\r\n

\xa0\xa0\xa0\xa0 (1)\xa0 The district or family court, for the purpose\r\nof trial, may schedule a civil trial on the fireworks infraction on the same date\r\nand at the same time as a criminal trial on the related criminal offense charged.\xa0 The court shall enter a civil judgment as to the\r\nfireworks infraction and a judgment of conviction or acquittal as to the related\r\ncriminal offense following the concurrent trial; and

\r\n\r\n

\xa0\xa0\xa0\xa0 (2)\xa0 If the trial on the fireworks infraction is held separately from and before trial\r\non any related criminal offense, the following shall be inadmissible in the prosecution\r\nor trial of the related criminal offense, except as expressly provided by the Hawaii\r\nrules of evidence:

\r\n\r\n

\xa0\xa0\xa0\xa0\xa0\xa0\xa0\xa0\xa0 (A)\xa0 Any written or oral statement made by the\r\ndefendant in proceedings conducted pursuant to section\xa0\xa0\xa0 'b'-6(b); and

\r\n\r\n

\xa0\xa0\xa0\xa0\xa0\xa0\xa0\xa0\xa0 (B)\xa0 Any testimony given\r\nby the defendant in the trial on the fireworks infraction.

\r\n\r\n

\xa0\xa0\xa0\xa0\xa0\xa0\xa0\xa0\xa0 These\r\nstatements or testimony shall not be deemed a waiver of the defendant\'s privilege\r\nagainst self-incrimination in connection with any related criminal offense.

\r\n\r\n

\xa0\xa0\xa0\xa0 (d)\xa0 In no event shall section\r\n701-109 preclude prosecution for a related criminal offense where a fireworks inf'b'raction\r\ncommitted in the same course of conduct has been adjudicated pursuant to this chapter.

\r\n\r\n

\xa0\xa0\xa0\xa0 (e)\xa0 If the defendant fails\r\nto appear at any scheduled court date before the date of trial or concurrent trial\r\nand:

\r\n\r\n

\xa0\xa0\xa0\xa0 (1)\xa0 The defendant\'s civil liability\r\nfor the fireworks infraction has not yet been adjudicated pursuant to section\xa0\xa0\xa0 -7, the court shall enter a judgment by default\r\nin favor of the State for the fireworks infraction unless the court determines that\r\ngood cause or excusable neglect exists'b' for the defendant\'s failure to appear; or

\r\n\r\n

\xa0\xa0\xa0\xa0 (2)\xa0 The defendant\'s civil liability\r\nfor the fireworks infraction has been adjudicated previously pursuant to section\xa0\xa0\xa0 -7, the judgment earlier entered in favor of\r\nthe State shall stand unless the court determines that good cause or excusable neglect\r\nexists for the defendant\'s failure to appear.

\r\n\r\n

\xa0\xa0\xa0\xa0 (f)\xa0 If the defendant fails\r\nto appear at any scheduled court date prior to concurrent trial or fails to appear\r\nfor concurrent trial scheduled pursuant to subs'b'ection (c)(1), the court shall enter\r\na disposition pursuant to the Hawaii rules of penal procedure for the criminal offense.

\r\n\r\n

\xa0\xa0\xa0\xa0 \xa7\xa0\xa0 -3\xa0 Venue and jurisdiction.\xa0 (a)\xa0 All\r\nfireworks infractions shall be adjudicated in the district and circuit where the\r\nalleged infraction occurred, except as otherwise provided by law.

\r\n\r\n

\xa0\xa0\xa0\xa0 (b)\xa0 Except as otherwise provided\r\nby law, jurisdiction is in the district court of the circuit 'b'where the alleged fireworks\r\ninfraction occurred.\xa0 Except as otherwise\r\nprovided in this chapter, district court judges shall adjudicate fireworks infractions.

\r\n\r\n

\xa0\xa0\xa0\xa0 \xa7\xa0\xa0 -4\xa0 Notice of infraction; form; determination final\r\nunless contested.\xa0 (a)\xa0 The notice of infraction shall include the summons\r\nfor the purposes of this chapter.\xa0 Whenever\r\na notice of infraction is issued, and to the extent practicable, the defendant\'s\r\nsignature, driver\'s license number or state identification number, current mailing\r\naddress, and electronic mail address shall be included on the notice.\xa0 If the defendant refuses to sign the notice of\r\ninfraction, or refuses to provide any other required information, the law enforcement\r\nofficer shall record this refusal on the notice and issue the notice to the defendant.\xa0 Anyone to whom a notice of infraction is issued\r\nunder this chapter need not be arraigned before the court, unless required by rule\r\nof the supreme court.

\r\n\r\n

\xa0\xa0\xa0\xa0 (b)\xa0 The form for the notice\r\nof infraction shall be prescribed by rules of the district court, which shall be\r\nuniform throughout the State; provided that each judicial circuit may include differing\r\nstatutory, rule, or ordinance provisions on its respective notice of infraction.

\r\n\r\n

\xa0\xa0\xa0\xa0 (c)\xa0 A notice of infraction\r\nthat is generated by the use of electronic equipment or that bears the electronically\r\nstored image of any defendant\'s signature, or both, shall be valid under this chapter.

\r\n\r\n

\xa0\xa0\xa0\xa0 (d)\xa0 The notice of infraction\r\nshall include the following:

\r\n\r\n

\xa0\xa0\xa0\xa0 (1)\xa0 A statement of the specific\r\nfireworks infraction for which the notice was issue'b'd;

\r\n\r\n

\xa0\xa0\xa0\xa0 (2)\xa0 A brief statement of the\r\nfacts;

\r\n\r\n

\xa0\xa0\xa0\xa0 (3)\xa0 A statement of the total\r\namount to be paid for each fireworks infraction, which amount shall include any\r\nfee, surcharge, or cost required by statute, ordinance, or rule, and any\r\nmonetary assessment established pursuant to section\xa0\xa0\xa0 -8, to be paid by the defendant to whom the\r\nnotice was issued, which shall be uniform throughout the State;

\r\n\r\n

\xa0\xa0\xa0\xa0 (4)\xa0 A statement of the options provided in\r\nsection\xa0\xa0\xa0 -5(b) for answering the notice\r\nand the procedures necessary to exercise the options;

\r\n\r\n

\xa0\xa0\xa0\xa0 (5)\xa0 A statement that the defendant to whom\r\nthe notice is issued shall answer, choosing one of the options specified in\r\nsection\xa0\xa0\xa0 -5(b), within twenty-one days\r\nof issuance of the notice;

\r\n\r\n

\xa0\xa0\xa0\xa0 (6)\xa0 A statement that failure to answer the\r\nnotice within twenty-one days of issuance shall result in the entry of judgment\r\nby default for the State and may result in the assessment of a late penalty;

\r\n\r\n

\xa0\xa0\xa0\xa0 (7)\xa0 A statement that, at a hearing\r\nrequested to contest the notice, pursuant to section\xa0\xa0\xa0 -7, no law enforcement officer shall be\r\npresent unless the defendant timely requests the court to have the law\r\nenforcement officer present, and that 'b'the standard of proof to be applied by\r\nthe court is whether a preponderance of the evidence proves that the specified\r\nfireworks infraction was committed;

\r\n\r\n

\xa0\xa0\xa0\xa0 (8)\xa0 A statement that, at a hearing\r\nrequested for the purpose of explaining mitigating circumstances surrounding\r\nthe commission of the fireworks infraction or in consideration of a written\r\nrequest for mitigation, the defendant shall be considered to have committed the\r\nfireworks infraction;

\r\n\r\n

\xa0\xa0\xa0\xa0 (9)\xa0 A space in which the signature of the\r\ndefendant to whom the notice of infraction was issued may be affixed; and

\r\n\r\n

\xa0\xa0\xa0 (10)\xa0 The date, time, and place at which the\r\ndefendant to whom the notice was issued shall appear in court, if the defendant is required by the notice to appear in person at the hearing.

\r\n\r\n

\xa0\xa0\xa0\xa0 (e)\xa0 A citation shall not be\r\ndismissed for failure to include any information described in subsection (d).

\r\n\r\n

\xa0\xa0\xa0\xa0 \xa7\xa0\xa0 -5\xa0 Answer required.\xa0 (a)\xa0 A defendant who receives a notice of infraction\r\nshall answer the notice within twenty-one days of the date of issuance of the notice.\xa0 There shall be included with the notice of infraction\r\na preaddressed envelope directed to the designated district court.

\r\n\r\n

\xa0\xa0\xa0\xa0 (b)\xa0 Provided that the notice\r\nof infraction does not require an appearance in person at a hearing as set forth\r\nin section\xa0\xa0\xa0 -4(d)(10), in answering a notice\r\nof infraction, a defendant shall have the following options:

\r\n\r\n

\xa0\xa0\xa0\xa0 (1)\xa0 Admit the commission of\r\nthe fireworks infraction in one of the following ways:

\r\n\r\n

\xa0\xa0\xa0\xa0\xa0\xa0\xa0\xa0\xa0 (A)\xa0 By mail or in person,\r\nby completing 'b'the appropriate portion of the notice of infraction or preaddressed\r\nenvelope and submitting it to the authority specified on the notice together with payment of the total amount stated on the notice of infraction.\xa0 Payment by mail shall be in the form of a check,\r\nmoney order, or by an approved credit or debit card.\xa0 Payment in person shall be in the form of United\r\nStates currency, check, money order, or by an approved credit or debit card; or

\r\n\r\n

\xa0\xa0\xa0\xa0\xa0\xa0\xa0\xa0\xa0 (B)\xa0 Via the I'b'nternet or by telephone, by submitting payment of the total amount\r\nstated on the notice of infraction.\xa0 Payment\r\nvia the Internet or by telephone shall be by an approved credit or debit card;

\r\n\r\n

\xa0\xa0\xa0\xa0 (2)\xa0 Deny the commission of\r\nthe fireworks infraction and request a hearing to contest the fireworks infraction\r\nby completing the appropriate portion of the notice of infraction or preaddressed\r\nenvelope and submitting it, either by mail or in person, to the authority specified\r\non the notice.\xa0 In lieu of appearing in person\r\nat a hearing, the defendant may submit a written statement of grounds on which the\r\ndefendant contests the notice of infraction, which shall be considered by the court\r\nas a statement given 'b'in court pursuant to section\xa0\xa0\xa0 -6(b)(2); or

\r\n\r\n

\xa0\xa0\xa0\xa0 (3)\xa0 Admit the commission of\r\nthe fireworks infraction and request a hearing to explain circumstances mitigating\r\nthe fireworks infraction by completing the appropriate portion of the notice of infraction or preaddressed envelope and submitting\r\nit, either by mail or in person, to the authority specified on the notice.\xa0 In lieu of appearing in person at a hearing, the\r\ndefendant may submit a written explanation of the mitigating circumstances, which\r\nshall be considered by the court as a statement given in court pursuant to section\xa0\xa0\xa0 -6(c)(2).

\r\n\r\n

\xa0\xa0\xa0\xa0 (c)\xa0 When answering the notice\r\nof infraction, the defendant shall affix the defendant\'s signature to the answer\r\nand shall state the address at which the defendant will accept future mailings from\r\nthe court.\xa0 No other response shall constitute\r\nan answer for purposes of this chapter.

\r\n\r\n

\xa0\xa0\xa0\xa0 \xa7\xa0\xa0 -6\xa0 Court action after answer or failure to answer.\xa0 (a)\xa0\r\nWhen an admitting answer is received, the court shall enter judgment in favor\r\nof the State in the total amount specified in the notice of infraction.

\r\n\r\n

\xa0\xa0\xa0\xa0 (b)\xa0 When a denying answer\r\nis received, the court shall proceed as follows:

\r\n\r\n

\xa0\xa0\xa0\xa0 (1)\xa0 In the case of a fireworks\r\ninfraction where the defendant requests a hearing at which the defendant will appear\r\nin person to contest the fireworks infraction, the court sh'b'all notify the defendant in writing of the date, time,\r\nand place of hearing to contest the notice of infraction.\xa0 The notice of hearing shall be mailed to the address\r\nstated in the denying answer, or if none was given, to the address stated on the\r\nnotice of infraction.\xa0 If no address was provided,\r\nan electronic copy of the notice of hearing may be sent to the electronic mail address\r\nstated on the notice of infraction.\xa0 The notification\r\nshall also advise the defendant that, if the defendant fails to appear at the hearing,\r\nthe court shall enter judgment by default in favor of the State, as of the date\r\nof the scheduled hearing, and that the total amount specified in the default judgment\r\nshall be paid within thirty days of entry of default judgment; and

\r\n\r\n

\xa0\xa0\xa0\xa0 (2)\xa0 When a denying answer is\r\naccompanied by a written statement of the grounds on which the defendant contests\r\nthe notice of infraction, the court shall proceed as provided in section\xa0\xa0\xa0 -7(a) and shall notify the defendant of its\r\ndecision, including the total amount assessed, if any, by mailing the notice of\r\nentry of judgment within forty-five days of the postmarked date of the answer to\r\nthe address provided by the defendant in the denying answer, or if none was given,\r\nto the address given when the notice of infraction was issued.\xa0 If no address was provided, an electronic copy\r\nof the notice of entry of judgment may be sent to the electronic mail address stated\r\non the notice of infraction.\xa0 The notice of\r\nentry of judgment shall also advise the defendant, if it is determined that the\r\nfirewo'b'rks infraction was committed and judgment is entered in favor of the State,\r\nthat the defendant has the right, within thirty days of entry of judgment, to request\r\na trial and shall specify the procedures for doing so.\xa0 The notice of entry of judgment shall also notify\r\nthe defendant, if an amount is assessed by the court for monetary assessments, fees,\r\nsurcharges, or costs, that if the defendant does not request a trial within the\r\ntime specified in this paragraph, the total amount assessed shall be paid within\r\nthirty days of entry of judgment.

\r\n\r\n

\xa0\xa0\xa0\xa0 (c)\xa0 When an answer admitting\r\ncommission of the firework infraction but seeking to explain mitigating circumstances\r\nis received, the court shall proceed as follows:

\r\n\r\n

\xa0\xa0\xa0\xa0 (1)\xa0 In the case of a fireworks\r\ninfraction where the defendant requests a hearing at which the defendant will appear\r\nin person to explain mitigating circumstances, the court shall notify the defendant\r\nin writing of the date, time, and place of the hearing to explain mitigating circumstances.\xa0 The notice of hearing shall be mailed to the address\r\nstated in the answer, or if none was given, to the address stated on the notice\r\nof infraction.\xa0 If no address was provided,\r\nan electronic copy of the notice of hearing may be sent to the electronic mail address\r\nstated on the notice of infraction.\xa0 The notification\r\nshall also advise the defendant that, if the defendant fails to appear at'b' the hearing,\r\nthe court shall enter judgment by default in favor of the State, as of the date\r\nof the scheduled hearing, and that the total amount stated in the default judgment\r\nshall be paid within thirty days of entry of default judgment; and

\r\n\r\n

\xa0\xa0\xa0\xa0 (2)\xa0 If a written explanation\r\nis included with an answer admitting commission of the fireworks infraction, the\r\ncourt shall enter judgment for the State and, after reviewing the explanation, determine\r\nthe total amount of the monetary assessments, fees, surcharges, or costs to be assessed,\r\nif any.\xa0 The court shall then notify the defendant\r\nof the total amount to be paid for the fireworks infraction, if any.\xa0 There shall be no appeal from the judgment.\xa0 If the court assesses an amount for monetary assessments,\r\nfees, surcharges, or costs, the court shall also notify the defendant that the total\r\namount shall be paid within thirty days of entry of judgment.

\r\n\r\n

\xa0\xa0\xa0\xa0 (d)\xa0 If the defendant fails\r\nto answer within twenty-one days of issuance of the notice of infraction, the court\r\nshall take action as provided in subsection (e).

\r\n\r\n

\xa0\xa0\xa0\xa0 (e)\xa0 Whenever judgment by default\r\nin favor of the State is entered, the court shall mail a notice of entry of default\r\njudgment to'b" the address provided by the defendant when the notice of infraction\r\nwas issued, or if none was provided, to the electronic mail address stated on the\r\nnotice of infraction.\xa0 The notice of entry\r\nof default judgment shall advise the defendant that the total amount specified in\r\nthe default judgment shall be paid within thirty days of entry of default judgment\r\nand shall explain the procedure for setting aside a default judgment.\xa0 Judgment by default for the State entered pursuant\r\nto this chapter may be set aside pending final disposition of the fireworks infraction\r\nupon written application of the defendant and posting of an appearance bond equal\r\nto the amount of the total amount specified in the default judgment and any other\r\nassessment imposed pursuant to section\xa0\xa0\xa0\r\n-8.\xa0 The application shall show good\r\ncause or excusable neglect for the defendant's fa"b"ilure to take action necessary\r\nto prevent entry of judgment by default.\xa0\r\nThereafter, the court shall determine whether good cause or excusable neglect\r\nexists for the defendant's failure to take action necessary to prevent entry of\r\njudgment by default.\xa0 If so, the application\r\nto set aside default judgment shall be granted, the default judgment shall be set\r\naside, and the notice of infraction shall be disposed of pursuant to this chapter.\xa0 If not, the application to set aside default judgment\r\nshall be denied, the appearance bond shall be forfeited and applied to satisfy amounts\r\ndue under the default judgment, and the notice of infraction shall be finally disposed.\xa0 In either case, the court shall determine the\r\nexistence of good cause or excusable neglect and notify the defendant of its decision\r\non the application in writing.<"b'/p>\r\n\r\n

\xa0\xa0\xa0\xa0 \xa7\xa0\xa0 -7\xa0 Hearings.\xa0 (a)\xa0 In proceedings to contest a notice of infraction\r\nwhere the defendant to whom the notice was issued has timely requested a hearing\r\nand appears at the hearing:

\r\n\r\n

\xa0\xa0\xa0\xa0 (1)\xa0 In lieu of the personal\r\nappearance by the law enforcement officer who issued the notice of infraction, the court shall consider the notice of infraction and any other relevant\r\nevidence, together with any oral or written statement by the defendant to whom the\r\nnotice of infraction was issued;

\r\n\r\n

\xa0\xa0\xa0\xa0 (2)\xa0 The court may compel by\r\nsubpoena the attendance of the officer who issued the notice of fireworks infraction and other witnesses from whom it may wish to hear;

\r\n\r\n

\xa0\xa0\xa0\xa0 (3)\xa0 The standard of proof to be applied by the court shall be whether, by a preponderance\r\nof the evidence, the court finds that the fireworks infraction was committed; and

\r\n\r\n

\xa0\xa0\xa0\xa0 (4)\xa0 After due consideration\r\nof the evidence and arguments, if any, the court shall determine whether commission\r\nof the infraction has been established.\xa0 Where\r\nthe commission of the fireworks infraction has not been established, judgment in\r\nfavor of the defendant, dismissing the notice of infraction or any count therein\r\nwith prejudice, shall be entered in the record.\xa0\r\nWhere it has been established tha'b't the fireworks infraction was committed,\r\nthe court shall enter judgment in favor of the State and shall assess a monetary\r\nassessment pursuant to section\xa0\xa0\xa0 -8, together\r\nwith any fees, surcharges, or costs.\xa0 The\r\ncourt also shall inform the person of the right to request a trial pursuant to section\xa0\xa0\xa0 -11.\xa0\r\nIf the person requests a trial at the time of the hearing, the court shall\r\nprovide the person with the trial date as soon as practicable.

\r\n\r\n

\xa0\xa0\xa0\xa0 (b)\xa0 In proceedings to explain\r\nmitigating circumstances where the person to whom the notice of infraction was issued\r\nhas timely requested a hearing and appears at the hearin'b'g:

\r\n\r\n

\xa0\xa0\xa0\xa0 (1)\xa0 The procedure shall be\r\nlimited to the issue of mitigating circumstances.\xa0 A person who requests to explain the\r\ncircumstances shall not be permitted to contest the notice of infraction;

\r\n\r\n

\xa0\xa0\xa0\xa0 (2)\xa0 After the court has received the\r\nexplanation, the court may enter judgment in favor of the State and may assess\r\na monetary assessment pursuant to section\xa0\xa0\xa0\r\n-8, together with any fees,'b' surcharges, or costs;

\r\n\r\n

\xa0\xa0\xa0\xa0 (3)\xa0 The court, after receiving the\r\nexplanation, may vacate the admission and enter judgment in favor of the\r\ndefendant, dismissing the notice of infraction or any count therein with\r\nprejudice, where the explanation establishes that the infraction was not committed;\r\nand

\r\n\r\n

\xa0\xa0\xa0\xa0 (4)\xa0 There shall\r\nbe no appeal from the judgment.

\r\n\r\n

\xa0\xa0\xa0\xa0 (c)\xa0 If a person, for whom\r\na hearing has been scheduled to contest the notice of infraction or to explain mitigating\r\ncircumstances, fails to appear at the hearing, the court shall enter judgment by\r\ndefault for the State and take action as provided in section\xa0\xa0\xa0 -6(e).

\r\n\r\n

\xa0\xa0\xa0\xa0 \xa7\xa0\xa0 -8\xa0 Monetary assessments.\xa0 (a)\xa0 A defendant\r\nfound to have committed a fireworks infraction shall be assessed a monetary assessment\r\nnot to exceed the maximum fine specified in the law or rule defining the fireworks\r\ninfraction.\xa0 The court shall consider the\r\ndefendant\'s financial circumstances, if disclosed, in determining the monetary assessment.

\r\n\r\n

\xa0\xa0\xa0\xa0 (b)\xa0 In addition to any monetary\r\nassessment imposed for a fireworks infraction, the court may impose additional assessments\r\nfor:

\r\n\r\n

\xa0\xa0\xa0\xa0 (1)\xa0 Failure to pay\r\na monetary assessment by t'b'he scheduled date of payment; and

\r\n\r\n

\xa0\xa0\xa0\xa0 (2)\xa0 The cost\r\nof service of a penal summons issued pursuant to this chapter.

\r\n\r\n

\xa0\xa0\xa0\xa0 (c)\xa0 In addition to any monetary\r\nassessment imposed for a fireworks infraction, the court shall impose administrative\r\ncosts of $20 for each fireworks infraction in which judgment is entered in favor\r\nof the State.\xa0 The clerk of the district court\r\nshall deposit the administrative costs collected into the judiciary computer system\r\nspecial fund pursuant to section 601-3.7.

\r\n\r\n

\xa0\xa0\xa0\xa0 (d)\xa0 Upon request of a defendant\r\nclaiming inability to pay a monetary assessment, the court may grant an extension\r\nof the period in which the monetary assessment shall be paid or may impose community\r\nservice in lieu thereof.

\r\n\r\n

\xa0\xa0\xa0\xa0 (e)\xa0 At any point before full\r\npayment of a monetary assessment, any person who suffers a change in financial circumstances\r\nmay requ'b'est a hearing to modify the monetary assessment or to request community\r\nservice in lieu thereof.

\r\n\r\n

\xa0\xa0\xa0\xa0 \xa7\xa0\xa0 -9\xa0 Time computation.\xa0 In computing any period of time prescribed or\r\nallowed by this chapter, the day of the act, event, or default from which the period\r\nof time begins to run shall not be included.\xa0\r\nThe last day of the period so computed shall be included, unless it is a\r\nSaturday, Sunday, or state holiday, in which event the period runs until the end\r\nof the next day that is not a Saturday, Sunday, or state holiday. Intermediate Saturdays,\r\nSundays, and state holidays shall be included.\xa0\r\nWhenever an act re'b'quired to be performed under this chapter may be accomplished\r\nby mail, the act shall be deemed to have been performed on the date of the postmark\r\non the mailed article.

\r\n\r\n

\xa0\xa0\xa0\xa0 \xa7\xa0\xa0 -10\xa0 Powers of the district court judge hearing cases\r\npursuant to this chapter.\xa0 (a)\xa0 A district court judge hearing cases pursuant\r\nto this chapter shall have all the powers of a district court judge under chapter\r\n604, including the following powers:

\r\n\r\n

\xa0\xa0\xa0\xa0 (1)\xa0 To conduct\r\nfireworks infraction hearings and impose monetary assessments;

\r\n\r\n

\xa0\xa0\xa0\xa0 (2)\xa0 To permit deferral of monetary\r\nassessments or impose community service in lieu thereof;

\r\n\r\n

\xa0\xa0\xa0\xa0 (3)\xa0 To dismiss a notice of infraction, with\r\nor without prejudice, or set aside a judgment for the State;

\r\n\r\n

\xa0\xa0\xa0\xa0 (4)\xa0 To issue penal summonses and bench\r\nwarrants and initiate contempt of court proceedings\r\nin proceedings conducted pursuant to section\xa0\xa0\xa0\r\n-11;

\r\n\r\n

\xa0\xa0\xa0\xa0 (5)\xa0 To issue penal summonses\r\nand bench warrants and initiate failure to appear proceedings in\r\nproceedings conducted pursuant to section\xa0\xa0\xa0\r\n-4(d)(10); and

\r\n\r\n

\xa0\xa0\xa0\xa0 (6)\xa0 To exercise other powers the court\r\nfinds necessary and appropriate to carry out the\r\npurposes of this chapter.

\r\n\r\n

\xa0\xa0\xa0\xa0 \xa7\xa0\xa0 -11\xa0 Trial and concurrent trial.\xa0 (a)\xa0 There\r\nshall be no right to trial unless the defendant contests the notice of infraction\r\npursuant to section\xa0\xa0\xa0 -7.\xa0 If, after proceedings to contest the notice of\r\ninfraction, a determination is made that the defendant committed the fireworks infraction,\r\njudgment shall enter in favor of the State.\xa0\r\nThe defendant may request a trial pursuant to the Hawaii rules of evidence\r\nand the rules of the district court; provided that any request for trial shall be\r\nmade within thirty days of entry of judgment.\xa0\r\nIf, after appearing in person at a hearing to contest the notice of infraction,\r\nthe defendant requests a trial at the conclusion of the hearing, the court shall\r\nprovide the defendant with the trial date as soon as practicable.

\r\n\r\n

\xa0\xa0\xa0\xa0 (b)\xa0 At the time of tri'b'al the\r\nState shall be represented by a prosecuting attorney of the county in which the\r\nfireworks infraction occurred.\xa0 The prosecuting\r\nattorney shall orally recite the charged fireworks infraction in court before commencement\r\nof the trial.\xa0 Proof of the defendant\'s commission\r\nof the fireworks infraction shall be by a preponderance of the evidence.

\r\n\r\n

\xa0\xa0\xa0\xa0 (c)\xa0 If trial on the fireworks\r\ninfraction is held before trial on any related criminal offense, the following shall\r\nbe inadmissible in the subsequent prosecution or trial of the related criminal offense:

\r\n\r\n

\xa0\xa0\xa0\xa0 (1)\xa0 Any written or oral statement\r\nmade by the defendant in proceedings conducted pursuant to section\xa0\xa0\xa0 -6(b); and

\r\n\r\n

\xa0\xa0\xa0\xa0 (2)\xa0 Any testimony\r\ngiven by the defendant in the trial on the fireworks infraction.

\r\n\r\n

The statement or testimony,\r\nor both, shall not be deemed a waiver of the defendant\'s privile'b'ge against self-incrimination\r\nin connection with any related criminal offense.

\r\n\r\n

\xa0\xa0\xa0\xa0 (d)\xa0 In any concurrent trial,\r\nthe State shall be represented by a prosecuting attorney of the county in which\r\nthe infraction and related crime occurred.\xa0\r\nProof of the defendant\'s commission of the infraction shall be by a preponderance\r\nof the evidence, and proof of the related criminal offense shall be by proof beyond\r\na reasonable doubt.\xa0 The concurrent trial\r\nshall be conducted pursuant to the rules of the appropriate court, Hawaii rules\r\nof evidence, and Hawaii rules of penal procedure.

\r\n\r\n

\xa0\xa0\xa0\xa0 \xa7\xa0\xa0 -12\xa0 Rules.\xa0\r\n(a)\xa0 The supreme court may adopt rules\r\nof procedure for the conduct of all proceedings pursuant to this chapter.

\r\n\r\n

\xa0\xa0\xa0\xa0 (b)\xa0 Chapter 626 shall not\r\napply in proceedings conducted pursuant to this chapter, except for the rules governing\r\nprivileged communications, and proceedings conducted under section\xa0\xa0\xa0 -11.

\r\n\r\n

\xa0\xa0\xa0\xa0 (c)\xa0 Notwithstanding section\r\n604-17, while the court is sitting in any matter pursuant to this chapter, the court\r\nshall not be required to preserve the testimony or proceedings, except proceedings\r\nconducted pursuant to section\xa0\xa0\xa0 -11 and proceedings\r\nin which the fireworks infraction is heard on the same date and time as any related\r\ncriminal offense.

\r\n\r\n

\xa0\xa0\xa0\xa0 (d)\xa0 The prosecuting attorney\r\nshall not participate in fireworks infraction proceedings conducted pursuant to\r\nthis chapter, except proceedings pursuant to section\xa0\xa0\xa0 -11 and proceedings in which a related criminal\r\noffense is scheduled for arraignment, hearing, or concurrent 'b'trial.

\r\n\r\n

\xa0\xa0\xa0\xa0 (e)\xa0 Chapter 91 shall not apply\r\nin proceedings before the court.

\r\n\r\n

\xa0\xa0\xa0\xa0 (f)\xa0 Except as otherwise provided\r\nin section\xa0\xa0\xa0 -2, chapter 571 and the Hawaii\r\nfamily court rules shall not apply in any proceedings conducted pursuant to this\r\nchapter."

\r\n\r\n

\xa0\xa0\xa0\xa0 SECTION 3.'b'\xa0 Chapter 132D, Hawaii\r\nRevised Statutes, is amended by adding seven new sections to be appropriately designated\r\nand to read as follows:

\r\n\r\n

\xa0\xa0\xa0\xa0 "\xa7132D-A\xa0\r\nGeneral fireworks or articles pyrotechnic prohibitions in the second degree.\xa0 (a)\xa0\r\nA person commits the offense of general fireworks or articles\r\npyrotechnic prohibitions in the second degree if the person intentionally, knowingly,\r\nor recklessly sets off, ignites, discharges, or otherwise\r\ncauses to explode any aerial devices, display fireworks, or articles pyrotechnic:

\r\n\r\n

\xa0\xa0\xa0\xa0 (1)\xa0 Within one thousand\r\nfeet of any operating hospital, licensed convalescent home, licensed home for the\r\nelderly, zoo, licensed animal shelter, or licensed animal hospital;

\r\n\r\n

\xa0\xa0\xa0\xa0 (2)\xa0 In any school\r\nbuilding, or on any school grounds or yards without first obtaining authorization\r\nfrom appropriate school officials;

\r\n\r\n

\xa0\xa0\xa0\xa0 (3)\xa0 On any highway,\r\nalley, street, sidewalk, or other public way;'b' in any park; on any public beach;\r\nin any officially designated forest or wildlife preserve; within fifty feet of a\r\ncanefield; or within one thousand feet of any building used for public worship during\r\nthe periods when services are held; or

\r\n\r\n

\xa0\xa0\xa0\xa0 (4)\xa0 Within five hundred\r\nfeet of any dwelling.

\r\n\r\n

\xa0\xa0\xa0\xa0 (b)\xa0 The state of mind requirement\r\nfor the offense under subsection (a)(1), (3), and (4) shall not be applicable to\r\nwhether the person was aware that the person was within the designated distance\r\nfrom an operating hospital, lice'b'nsed convalescent home, licensed home for the elderly,\r\nzoo, licensed animal shelter, or licensed animal hospital, canefield, building used\r\nfor public worship, or hotel.\xa0 A person shall\r\nbe strictly liable with respect to the attendant circumstance that the person was\r\nwithin the designated distance from a prohibited place, at the time of incident.

\r\n\r\n

\xa0\xa0\xa0\xa0 (c)\xa0 Except as provided\r\nin subsection (d), (e), and (f), the offense of general fireworks or articles\r\npyrotechnic prohibitions in the second degree shall be a misdemeanor.

\r\n\r\n

\xa0\xa0\xa0\xa0 (d)\xa0 The offense of general\r\nfireworks or articles pyrotechnic prohibitions in the second degree shall be a class\r\nC felony if the person has been convicted one or more times for any offense under\r\nthis chapter within ten years of the current offense.

\r\n\r\n

\xa0\xa0\xa0\xa0 (e)\xa0 The offense of\r\ngeneral fireworks or articles pyrotechnic prohibitions in the second degree shall\r\nbe a class B felony if any of the aerial devices, display\r\nfireworks, or articles pyrotechnic set off, ignited, discharged, or otherwise caused\r\nto explode in the commission of the offense cause substantial bodily injury to another\r\nperson.

\r\n\r\n

\xa0\xa0\xa0\xa0 (f)\xa0 The offense of\r\ngeneral fireworks or articles pyrotechnic prohibitions in the second degree shall\r\nbe a class A felony if any of the aerial devices, display fireworks, or articles\r\npyrotechnic set off, ignited, discharged, or otherwise caused to explode in the\r\ncommission of the offense cause serious bodily injury or death to another person.

\r\n\r\n

\xa0\xa0\xa0\xa0 (g)\xa0 The state of mind requirement\r\nfor subsections (e) and (f) shall not be applicable to whether the person was aware\r\nthe aerial devices, display fireworks, or articles pyrotechnic caused or would cause\r\nthe injury or death.\xa0 A person sha'b'll be strictly\r\nliable with respect to the result that the aerial devices, display fireworks, or\r\narticles pyrotechnic caused the injury or death.

\r\n\r\n

\xa0\xa0\xa0\xa0 \xa7132D-B\xa0 Sending\r\nor receiving fireworks or articles pyrotechnic by air delivery; prohibited.\xa0 (a)\xa0 A person commits the offense of sending or receiving\r\nfireworks or articles pyrotechnic by air delivery if the\r\nperson intentionally, knowingly, or recklessly sends or receives any amount of consum'b'er\r\nfireworks, aerial devices, display fireworks, or articles pyrotechnic via any form\r\nof air delivery, including but not limited to any private courier, commercial carrier,\r\nmail or postal services.

\r\n\r\n

\xa0\xa0\xa0\xa0 (b)\xa0 Except as provided\r\nin subsections (c) and (d), the offense of sending or receiving fireworks or\r\narticles pyrotechnic by air delivery shall be a class C felony.

\r\n\r\n

\xa0\xa0\xa0\xa0 (c)\xa0 The offense of sending\r\nor receiving fireworks or articles pyrotechnic by air delivery shall be a class\r\nB felony if:\r\n\r\n

\xa0\xa0\xa0\xa0 (1)\xa0 The person has\r\nbeen convicted one or more times for any offense under this chapter within ten years\r\nof the current offense; or

\r\n\r\n

\xa0\xa0\xa0\xa0 (2)\xa0 The total weight\r\nof the consumer fireworks, aerial devices, display fireworks, and articles pyrotechnic\r\nsent or received in the commission of the offense is five pounds or more but less\r\nthan twenty-five pounds.

\r\n\r\n

\xa0\xa0\xa0\xa0'b' (d)\xa0 The offense of sending\r\nor receiving fireworks or articles pyrotechnic by air delivery shall be a class\r\nA felony if the total weight of the consumer fireworks, aerial devices, display\r\nfireworks, and articles pyrotechnic sent or received in the commission of the\r\noffense is twenty-five pounds or more.

\r\n\r\n

\xa0\xa0\xa0\xa0 \xa7132D-C\xa0 Distributing\r\nfireworks or articles pyrotechnic to non-permit holder.\xa0 (a)\xa0 A person commits the offense of distributing\r\nfireworks or articles pyrotechnic to non-permit holder when 'b'the person, who holds\r\na valid license required pursuant to section 132D-7, intentionally, knowingly, or\r\nrecklessly distributes consumer fireworks, aerial devices, display fireworks, or\r\narticles pyrotechnic to another person who does not have a valid permit required\r\npursuant to sections 132D-10 and 132D-16.

\r\n\r\n

\xa0\xa0\xa0\xa0 (b)\xa0 Except as provided\r\nin subsection (c) and (d), the offense of distributing fireworks or articles\r\npyrotechnic to non-permit holder shall be a class C felony.

\r\n\r\n

\xa0\xa0\xa0\xa0 (c)\xa0 The offense of distributing\r\nfireworks or articles pyrotechnic to non-permit holder shall be a class B felony\r\nif:

\r\n\r\n

\xa0\xa0\xa0\xa0 (1)\xa0 The person has\r\nbeen convicted one or more times for any offense under this chapter within ten years\r\nof the current offense; or

\r\n\r\n

\xa0\xa0\xa0\xa0 (2)\xa0 Any of the consumer\r\nfireworks, aerial devices, display fireworks, or articles pyrotechnic\r\ndistributed in the commission of the offense cause substantial bodily injury to\r\nanother person.<'b'o:p>

\r\n\r\n

\xa0\xa0\xa0\xa0 (d)\xa0 The offense of\r\ndistributing fireworks or articles pyrotechnic to non-permit holder shall be a class\r\nA felony if any of the consumer fireworks, aerial devices, display fireworks, or\r\narticles pyrotechnic distributed in the commission of the offense cause serious\r\nbodily injury or death to another person.

\r\n\r\n

\xa0\xa0\xa0\xa0 (e)\xa0 The state of mind requirement\r\nfor subsections (c)(2) and (d) shall not be applicable to whether the person was\r\naware the consumer fireworks, aerial devices, display fireworks, or articles pyrotechnic\r\ncaused'b' or would cause the injury or death.\xa0\r\nA person shall be strictly liable with respect to the result that the consumer\r\nfireworks, aerial devices, display fireworks, or articles pyrotechnic caused the\r\ninjury or death.

\r\n\r\n

\xa0\xa0\xa0\xa0 \xa7132D-D\xa0 Removal or extraction of pyrotechnic contents;\r\nprohibited.\xa0 Any person who removes or\r\nextracts the pyrotechnic contents from any consumer fireworks'b', aerial devices, display\r\nfireworks, or articles pyrotechnic shall be guilty of a class C felony.

\r\n\r\n\r\n\r\n

\xa0\xa0\xa0\xa0 \xa7132D-E\xa0 Consumer\r\nfireworks prohibitions.\xa0 (a) It shall be unlawful for any person to:

\r\n\r\n

\xa0\xa0\xa0\xa0 (1)\xa0 Purchase, possess,\r\nset off, ignite, discharge, or otherwise cause to explode any consumer fir'b'eworks\r\nwithout a permit required pursuant to section 132D-10; or

\r\n\r\n

\xa0\xa0\xa0\xa0 (2)\xa0 Set off, ignite,\r\ndischarge, or otherwise cause to explode any consumer fireworks at any time not\r\nwithin the periods for use prescribed in section 132D-3.

\r\n\r\n

\xa0\xa0\xa0\xa0 (b)\xa0 It shall be unlawful\r\nfor any person to distribute consumer fireworks:

\r\n\r\n

\xa0\xa0\xa0\xa0 (1)\xa0 More than five\r\ncalendar days before the time periods for permissible use under section 132D-3;\r\nor

\r\n\r\n

\xa0\xa0\xa0\xa0 (2)\xa0 After 12:01 a.m.\r\non New Year\'s Day, 6:00 p.m. on Chinese New Year\'s Day, or 8:00 p.m. on the Fourth\r\nof July.

\r\n\r\n

\xa0\xa0\xa0\xa0 (c)\xa0 The state of mind requirement\r\nfor the offense under subsections (a)(2) and (b) shall not be applicable to whether\r\nthe person was aware of the date or time at the time of offense, or whether the\r\ndate and time of offense fell within the prohibited periods.\xa0 A person shall be strictly liable with respect\r\nto the date and time of any act proven to have occurred, and with respect to the\r\nattendant circumstance that the date and time fell within the prohibited dates and\r\ntimes provided in subsections (a)(2) and (b).

\r\n\r\n

\xa0\xa0\xa0\xa0 (d)\xa0 Any person who violates subsection (a) shall be\r\nsubject to a $200 fine; any person who violates subsection (b) shall be subject\r\nto a $1,000 fine; and any person who violates this section shall be subject to proceedings\r\nunder chapter\xa0\xa0\xa0 ; provided that nothing in\r\nthis section shall be construed to prohibit prosecution under section 132D-7, 132D-8.6,\r\nor any other provision under this chapt'b'er.

\r\n\r\n

\xa0\xa0\xa0\xa0 \xa7132D-F\xa0 Refusal to provide identification.\xa0 (a)\xa0\r\nExcept as provided in subsection (b), any person detained for violating this\r\nchapter shall provide the person\'s name and current mailing address, or any proof\r\nthereof, upon the lawful order or direction of any law enforcement officer in the\r\ncourse and scope of the officer\'s duties to enforce this chapter.

\r\n\r\n

\xa0\xa0\xa0\xa0 (b)\xa0 If the officer has reasonable grounds to believe\r\nthat the person is being deceptive or misleading in providing the person\'s name\r\nor address, the person shall provide proof thereof, upon the lawful order or direction\r\nof the law enforcement officer.

\r\n\r\n

\xa0\xa0\xa0\xa0 (c)\xa0 Refusal to provide identification pursuant to\r\nthis section shall be a petty misdemeanor.

\r\n\r\n

\xa0\xa0\xa0\xa0 \xa7132D-G\xa0 Requirements of carrier.\xa0 (a)\xa0 Any carrier or person shipping consumer fireworks,\r\naerial devices, display fireworks, or articles pyrotechnic:

\r\n\r\n

\xa0\xa0\xa0\xa0 (1)\xa0 Into the State shall notify the appropriate\r\ncounty official and designated state law enforcement agencies at the time the booking\r\nis made and, in any case, no later than fourteen days before arrival into the State;\r\nor

\r\n\r\n

\xa0\xa0\xa0\xa0 (2)\xa0 Interisland within the State shall notify the\r\nappropriate county official and designated state law enforcement agencies at the\r\ntime the booking is made and, in any case, no later than five days before departing\r\nfrom the island of origin;

\r\n\r\n

provided that the notification shall include, when applicable, but\r\nneed not be limited to the container identification number, manifest, bill of lading,\r\nconsignee, freight forwarder, sailing vessel name, route number, date of\r\ndeparture, and estimated date of arrival.

\r\n\r\n

\xa0\xa0\xa0\xa0 (b)\xa0 For a first offense, or any offense not committed\r\nwithin five years of a prior judgment for the State under this section, the carrier\r\nor person shall be subject to a $1,000 fine.

\r\n\r\n

\xa0\xa0\xa0\xa0 (c)\xa0 For a second offense committed within five years\r\nof a prior judgment for the State under this section, the carrier or person shall\r\nbe subject to a $2,000 fine.

\r\n\r\n

\xa0\xa0\xa0\xa0 (d)\xa0 For a third or subsequent offense committed within\r\nfive years of two or more prior judgements for the State under this section, the\r\ncarrier or person shall be subject to a $5,000 fine.

\r\n\r\n

\xa0\xa0\xa0\xa0 (e)\xa0 All violations of this section shall be subject\r\nto proceedings under chapter\xa0\xa0\xa0 .\xa0 Nothing in this section shall be construed to\r\nprohibit criminal prosecution under section 132D-'b'8.6 or any other section of this\r\nchapter."

\r\n\r\n\r\n\r\n

\xa0\xa0\xa0\xa0 SECTION\r\n4.\xa0 Section 132D-2, Hawaii Revised Statutes,\r\nis amended as follows:

\r\n\r\n

\xa0\xa0\xa0\xa0 1.\xa0 By adding five new definitions\r\nto be appropriately inserted and to read:

\r\n\r\n

\xa0\xa0\xa0\xa0 ""Carrier" means any shipper or anyone who transports\r\ngoods, 'b'merchandise, property, or people by rail car, aircraft, motor vehicle, or\r\nvessel.

\r\n\r\n

\xa0\xa0\xa0\xa0 "Distribute" or "distribution" means to sell,\r\ntransfer, deliver to another, give or deliver to another, or to leave, barter, exchange\r\nwith another, or to offer or agree to do the same.

\r\n\r\n

\xa0\xa0\xa0\xa0 "Dwelling" means a building that is used or usually\r\nused by a person for lodging.

\r\n\r\n

\xa0\xa0\xa0\xa0 &q'b'uot;Serious bodily injury" means bodily injury that creates\r\na substantial risk of death or which causes serious, permanent disfigurement, or\r\nprotracted loss or impairment of the function of any bodily member or organ.

\r\n\r\n

\xa0\xa0\xa0\xa0 "Substantial bodily injury" means bodily injury that\r\ncauses:

\r\n\r\n

\xa0\xa0\xa0\xa0 (1)\xa0 A major avulsion,\r\nlaceration, or penetration of the skin;

\r\n\r\n

\xa0\xa0\xa0\xa0 (2)\xa0 A burn of at\r\nleast second degree severity;

\r\n\r\n

\xa0\xa0\xa0\xa0 (3)\xa0 A bone fracture;

\r\n\r\n

\xa0\xa0\xa0\xa0 (4)\xa0 A serious concussion;\r\nor

\r\n\r\n

\xa0\xa0\xa0\xa0 (5)\xa0 A tearing, rupture,\r\nor corrosive damage to the esophagus, viscera, or other internal organs."

\r\n\r\n

\xa0\xa0\xa0\xa0 2.\xa0 By amending the definition\r\nof "aerial device" to read:

\r\n\r\n

\xa0\xa0\xa0\xa0 ""Aerial device" means any fireworks [~~containing\r\none hundred thirty milligrams or less of explosive materials that produces an audible\r\nor visible effect and is designed to rise~~] that upon ignition, discharge,\r\nor otherwise being set off rises more than twelve feet into the air and [~~explode\r\nor detonate~~] then combusts, explodes, deflagrates, or detonates in the\r\nair, shoots or emits flaming balls, or [~~to fly about above the ground,\r\nand that is prohibited for'b" use by any person who does not have a permit for display\r\nissued by a county under section 132D-16.\xa0\r\n"Aerial devices"~~] shoots or emits sparks.\xa0 Alternatively, "aerial device" may include\r\nbut is not limited to any device classified as fireworks under UN0336 and UN0337\r\nby the United States Department of Transportation as set forth in Title 49 Code\r\nof Federal Regulations [~~include~~], which contains one hundred thirty milligrams\r\nor less of explosive materials, including firework items commonly known as bottle\r\nrockets, sky rockets, missile-type rockets, helicopters, torpedoes, daygo bombs,\r\nroman candles, flying pigs, and jumping jacks that move about the ground farther\r\nthan a circle with a radius of twelve feet as measured from the point where the\r\nitem was placed and ignited, aerial shells, and mines."

\r\n\r\n

\xa0\xa0\xa0\xa0 3.\xa0 By amending the\r\ndefinition of "consumer fireworks" to read:

\r\n\r\n

\xa0\xa0\xa0\xa0 ""Consumer fireworks"\r\nmeans any fireworks [~~designed primarily for retail sale to the public during\r\nauthorized dates and times,~~] that upon ignition, discharge, or otherwise\r\nbeing set off produces visible or audible effects [~~by combustion~~], and\r\nthat [~~is designed to remain~~] remains on or near the ground and, while\r\nstationary or spinning rapidly on or near the ground, emits smoke, a shower of colored\r\nsparks, whistling effects, flitter sparks, or balls of colored sparks, and includes\r\ncombination it'b"ems that [~~contain~~] produce one or more of these effects.\xa0 [~~"Consumer fireworks" shall comply~~]\r\nAlternatively, "consumer fireworks" may include but are not limited\r\nto any fireworks that complies with the construction, chemical composition,\r\nand labeling regulations of the United States Consumer Product Safety Commission\r\nas set forth in Title 16 Code of Federal Regulations and fireworks classified as\r\nUN0336 and UN0337 by the United States Department of Transportation as set forth\r\nin Title 49 Code of Federal Regulations.\xa0\r\n"Consumer fireworks" include firework items commonly known as firecrackers\r\nthat are single paper cylinders not exceeding one and one-half inches in length\r\nexcluding the fuse and one-quarter of an inch in diameter [~~and contain a charge\r\nof not more than fifty milligrams of pyrotechnic composition~~], snakes, sparklers,\r\nfountains, and cylindrical or c"b'one fountains that emit effects up to a height not\r\ngreater than twelve feet above the ground, illuminating torches, bamboo cannons,\r\nwhistles, toy smoke devices, wheels, and ground spinners that when ignited remain\r\nwithin a circle with a radius of twelve feet as measured from the point where the\r\nitem was placed and ignited, novelty or trick items, combination items, and other\r\nfireworks of like construction that are designed to produce the same or similar\r\neffects."

\r\n\r\n

\xa0\xa0\xa0\xa0 4.\xa0 By amending the definition\r\nof "display fireworks" to read:

\r\n\r\n

\xa0\xa0\xa0\xa0 ""Display fireworks" means any fireworks designed\r\nprimarily for exhibition display by producing visible or audible effects and classified\r\nas display fireworks or contained in the regulations of the United States Department\r\nof Transportation and designated as UN0333, UN0334, or UN0335, and includes salutes\r\ncontaining more than two grains (one hundred and thirty milligrams) of explosive\r\nmaterials, aerial shells containing more than forty grams of pyrotechnic compositions,\r\nand other display pieces which exceed the limits of explosive materials for classification\r\nas "consumer fireworks".\xa0 This term\r\nalso includes fused [~~setpieces~~] set pieces containing components,\r\nwhich together exceed fifty milligrams of salute [~~power~~] powder.\xa0 The use of display fireworks shall be prohibited\r\nf'b'or use by any person who does not have a display permit issued by a county."

\r\n\r\n

\xa0\xa0\xa0\xa0 5.\xa0 By amending the definition\r\nof "fireworks" to read:

\r\n\r\n

\xa0\xa0\xa0\xa0 ""Fireworks"\r\nmeans any combustible or explosive composition, or any substance or combination\r\nof substances, [~~or article prepared for the purpose of producing~~] that\r\nproduces a visible or audible effect by combustion, explosion, deflagration,\r\nor detonation [~~and that meets t'b"he definition of aerial device or consumer or\r\ndisplay fireworks as defined by this section and contained~~], including but\r\nnot limited to aerial devices, consumer fireworks, or display fireworks, as defined\r\nby this article.\xa0 Fireworks also includes\r\nbut is not limited to aerial devices, consumer fireworks, or display fireworks,\r\nas defined in the regulations of the United States Department of Transportation\r\nas set forth in Title 49 Code of Federal Regulations.\xa0 The term "fireworks" shall not include\r\nany explosives or pyrotechnics regulated under chapter 396 or automotive safety\r\nflares, nor shall the term be construed to include toy pistols, toy cannons, toy\r\nguns, party poppers, pop-its, or [~~other~~] similar devices [~~which\r\ncontain twenty-five hundredths of a grain or less of explosive substance~~]."

\r\n\r\n

\xa0\xa0\xa0\xa0 6.\xa0 By amending the definition\r\nof "import" to read:

\r\n\r\n

\xa0\xa0\xa0\xa0 ""Import" (and any nounal, verbal,\r\nadjectival, adverbial, and other equivalent form of the term used interchangeably\r\nin this chapter) means to bring or attempt to bring [~~fireworks~~] into the\r\nState or to cause [~~fireworks~~] to be brought into the State[,] any\r\naerial devices, articles pyrotechnic, consumer fireworks, or display fireworks,\r\nas defined in this section or as defined by the United States Department of Transportation\r\nas set for'b'th in Title 49 Code of Federal Regulations, and includes [~~fireworks~~]\r\nany aerial devices, articles pyrotechnic, consumer fireworks, or display fireworks\r\nlabeled or designated as samples, even if not intended for retail sale."

\r\n\r\n

\xa0\xa0\xa0\xa0 7.\xa0 By amending the definition\r\nof "pyrotechnic composition" or "pyrotechnic contents" to read:

\r\n\r\n

\xa0\xa0\xa0\xa0 ""Pyrotechnic composition" or\r\n"pyrotechnic contents" means the combustible or explosive component of\r\nconsumer fireworks[.], aerial devices, display fireworks, and articles\r\npyrotechnic."

\r\n\r\n

\xa0\xa0\xa0\xa0 8.\xa0 By repealing the\r\ndefinition of "law enforcement or fire officer".

\r\n\r\n

\xa0\xa0\xa0\xa0 ["~~"Law enforcement or fire officer" means any law\r\nenforcement officer having police power or county fire department officer, includ'b'ing\r\nfirefighters.~~"]

\r\n\r\n

\xa0\xa0\xa0\xa0 SECTION 5.\xa0 Section 132D-5, Hawaii Revised\r\nStatutes, is amended to read as follows:

\r\n\r\n

\xa0\xa0\xa0\xa0 "\xa7132D-5\xa0 General fireworks\r\nor articles pyrotechnic prohibitions[.] in the\r\nfirst degree.\xa0 (a)\xa0 It shall be unlawful for any person [~~without\r\na permit issued under section 132D-10 b'b'y a county fire department~~] to:

\r\n\r\n

\xa0\xa0\xa0 [~~(1)~~\xa0 ~~Remove or extract\r\nthe pyrotechnic contents from any fireworks or articles pyrotechnics;~~

\xa0\xa0\xa0\xa0\xa0\xa0\xa0\xa0\xa0 ~~(D)~~\xa0 ~~Within one\r\nthousand feet of any operating hospital, licensed convalescent home, licensed home\r\nfor the elderly, zoo, licensed animal shelter, or licensed animal hospital;~~

\xa0\xa0\xa0\xa0\xa0\xa0\xa0\xa0\xa0 ~~(E)~~\xa0 ~~In any school\r\nbuilding, or on any school grounds and yards without first obtaining authorization\r\nfrom appropriate school officials;~~

\r\n\r\n

\xa0\xa0\xa0\xa0\xa0\xa0\xa0\xa0\xa0 ~~(F)~~\xa0 On any highway,\r\nalley, street, sidewalk, or other public way; in any park; on any public beach;\r\nin any officially designated forest or wildlife preserve; within fifty feet of a\r\ncanefield; or within one thousand feet of any building used for public worship during\r\nthe periods when services are held; and

\r\n\r\n

\xa0\xa0\xa0\xa0\xa0\xa0\xa0\xa0\xa0 ~~(G)~~\xa0 ~~Within five\r\nhundred feet of any hotel.~~

\r\n\r\n

\xa0\xa0\xa0\xa0\xa0\xa0\xa0\xa0\xa0 ~~(b)\xa0 It shall be unlawful\r\nto purchase consumer fireworks more than five calendar days before the time periods\r\nfor permissible use under section 132D-3.~~

\r\n\r\n

\xa0\xa0\xa0\xa0 ~~(c)\xa0 It shall be unlawful\r\nto sell consumer fireworks after 12:01 a.m. on New Year\'s Day, 6:00 p.m. on Chinese\r\nNew Year\'s Day, and 8:00 p.m. on the Fourth of July.~~] or

\r\n\r\n

\xa0\xa0\xa0\xa0\xa0\xa0\xa0\xa0\xa0 (C)\xa0 In any building;\r\nprovided that firecrackers shall be permitted if used in accordance with sections\r\n132D-3 and 132D-10 and all other applicable state and county laws, ordinances, and\r\nrules.

\r\n\r\n

\xa0\xa0\xa0\xa0 (b)\xa0 Except as provided\r\nin subsections (c) and (d), the offense of general fireworks or pyrotechnic prohibitions\r\nin the first degree shall be a class C felony.

\r\n\r\n

\xa0\xa0\xa0\xa0 (c)\xa0 If, in the commission\r\nof th'b'e offense of general fireworks or articles pyrotechnic prohibitions in the\r\nfirst degree, the person negligently causes substantial bodily injury to another\r\nperson, the person shall be guilty of a class B felony.

\r\n\r\n

\xa0\xa0\xa0\xa0 (d)\xa0 If, in the commission\r\nof the offense of general fireworks or articles pyrotechnic prohibitions in the\r\nfirst degree, the person negligently causes serious bodily injury or death to another\r\nperson, the person shall be guilty of a class A felony."

\r\n\r\n

\xa0\xa0\xa0\xa0 SECTION 6.\xa0 Section 132D-6,\r\nHawaii Revised Statutes,'b' is amended to read as follows:

\r\n\r\n

\xa0\xa0\xa0\xa0 "\xa7132D-6\xa0 Exceptions.\xa0 The prohibitions in [~~section~~] sections 132D-5, 132D-A, and 132D-D\r\ndo not apply to:

\r\n\r\n

\xa0\xa0\xa0\xa0 (1)\xa0 The use of flares, noisemakers,\r\nor signals for warning[,] or pest control, or for illumination\r\npurposes by police and fire departments, utility companies, transportation agencies,\r\nand o'b'ther governmental or private agencies or persons, including agricultural operations,\r\nin connection with emergencies, their duties, or business;

\r\n\r\n

\xa0\xa0\xa0\xa0 (2)\xa0 The sale or use of blank\r\ncartridges for a show or theater, or for signal, commercial, or institutional purposes\r\nin athletics or sports;

\r\n\r\n

\xa0\xa0\xa0\xa0 (3)\xa0 The purchase and use of\r\nconsumer fireworks, aerial devices, display fireworks, or articles pyrotechnic:

\r\n\r\n

\xa0\xa0\xa0\xa0\xa0\xa0\xa0\xa0\xa0 (A)\xa0 In a movie, television\r\nproduction, or theatrical production for which valid permits have been issued by\r\na county pursuant to section 132D-10; and

\r\n\r\n

\xa0\xa0\xa0\xa0\xa0\xa0\xa0\xa0\xa0 (B)\xa0 In a movie or television\r\nproduction for which valid permits have been issued by the department of business,\r\neconomic development, and tourism pursuant to section 201-14, or for which permits\r\nhave been approved by the authority having jurisdiction; and

\r\n\r\n

\xa0\xa0\xa0\xa0 (4)\xa0 The testing, disposal,\r\nor destructi'b'on of [~~illegal~~] any fireworks or articles pyrotechnic\r\nby an agency with authority to enforce this chapter."

\r\n\r\n

\xa0\xa0\xa0\xa0 SECTION 7.\xa0 Section 132D-7,\r\nHawaii Revised Statutes, is amended to read as follows:

\r\n\r\n

\xa0\xa0\xa0\xa0 "\xa7132D-7\xa0 License or\r\npermit required.\xa0 A person shall not:

\r\n\r\n

\xa0\xa0\xa0\xa0 (1)\xa0 Import, store, [~~offer\r\nto sell, or sell,~~] or distribute, including at wholesale or retail, any\r\naerial devices, display fireworks, articles pyrotechnic, or consumer fireworks\r\nunless the person has a valid license issued [~~by the county;~~] pursuant\r\nto this chapter; or

\r\n\r\n

\xa0\xa0\xa0\xa0 (2)\xa0 Possess any aerial\r\ndevices, display fireworks, or articles pyrotechnic without a valid license to import,\r\nstore, or [~~sell~~] distribute aerial devices, display fireworks, or\r\narticles pyrotechnic, or a valid display permit [~~as provided for in~~] issued\r\npursuant to this chapter."

\r\n\r\n

<'b'span style=\'mso-bidi-font-family:"Courier New";\r\ncolor:black\'>\xa0\xa0\xa0\xa0 SECTION 8.\xa0 Section 132D-8.6, Hawaii Revised Statutes, is\r\namended by amending subsection (a) to read as follows:

\r\n\r\n

\xa0\xa0\xa0\xa0 "(a)\xa0 Any person\r\nwho has obtained a license [~~under~~] required pursuant to section 132D-7\r\nand ships fireworks or articles pyrotechnic into the State shall:

\r\n\r\n

\xa0\xa0\xa0\xa0 (1)\xa0 Clearly designate the types\r\nof fireworks or articles pyrotechnic in each shipment on the bill of lading or shipping\r\nmanifest with specificity;

\r\n\r\n

\xa0\xa0\xa0\xa0 (2)\xa0 Declare\r\non the bill of lading or shipping manifest the gross weight of consumer fireworks,\r\ndisplay fireworks, articles pyrotechnic, and aerial devices to be imported in each\r\nshipment and the location of the storage facility, if applicable, in which the fireworks\r\nor articles pyrotechnic are to be stored;

\r\n\r\n

\xa0\xa0\xa0\xa0 (3)\xa0 [~~Prior to~~] Before\r\nshipment and when booking each shipment\r\nof fireworks, display fireworks, articles pyrotechnic, or aerial devices notify\r\nthe [~~appropriate county official as determined by the county~~] Hawaii\r\nstate fire marshal regarding whether the shipment will be distributed from:

\r\n\r\n

\xa0\xa0\xa0\xa0\xa0\xa0\xa0\xa0\xa0 (A)\xa0 Pier\r\nto pier;

\r\n\r\n

\xa0\xa0\xa0\xa0\xa0\xa0\xa0\xa0\xa0 (B)\xa0 Pier to warehouse\r\nor storage facility; or

\r\n\r\n

\xa0\xa0\xa0\xa0\xa0\xa0\xa0\xa0\xa0 (C)\xa0 Pier to\r\nredistribution;

\r\n\r\n

\xa0\xa0\xa0\xa0 (4)\xa0 [~~Prior to~~] Before\r\nbooking the shipment, provide to the [~~applicable county fire chief:~~] Hawaii\r\nstate fire marshal:

\r\n\r\n

\xa0\xa0\xa0\xa0\xa0\xa0\xa0\xa0\xa0 (A)\xa0 Written documentation\r\nregarding the proposed display event or events and related contact information to\r\nallow the fire chief to validate the importation of a three-month or six-month inventory\r\nunder section 132D-8.5; and

<'b'span\r\nstyle=\'mso-bookmark:_Hlk187675138\'>\xa0\xa0\xa0\xa0\xa0\xa0\xa0\xa0\xa0 (B)\xa0 An inventory\r\nbreakdown for each proposed display; and

\r\n\r\n

\xa0\xa0\xa0\xa0 (5)\xa0 At the time shipping is\r\nbooked, the importer or consignee shall notify the [~~appropriate county official\r\nas determined by the county~~] Hawaii state fire marshal in writing of\r\nthe expected shipment\'s landing da'b'te[.]; provided that:

\r\n\r\n

\xa0\xa0\xa0\xa0\xa0\xa0\xa0\xa0\xa0 (A)\xa0 Notifications\r\nshall be made through a system designated by the Hawaii state fire marshal; and

\r\n\r\n

\xa0\xa0\xa0\xa0\xa0\xa0\xa0\xa0\xa0 (B)\xa0 If a licensee\r\nfails to notify the Hawaii state fire marshal two or more times within one year\r\nof the issuance of a license, the license may be revoked."

\r\n\r'b'\n\r\n\r\n

\xa0\xa0\xa0\xa0 SECTION 9.\xa0 Section 132D-10,\r\nHawaii Revised Statutes, is amended to read as follows:

\r\n\r\n

\xa0\xa0\xa0\xa0 "\xa7132D-10\xa0 Permits.\xa0\r\n(a)\xa0 A permit shall be required for the purchase and use of:

\r\n\r\n

\xa0\xa0\xa0\xa0 (1)\xa0 Any\r\nconsumer fireworks commonly known as firecrackers upon payment of a fee of $25;

\r\n\r\n

\xa0\xa0\xa0\xa0 (2)\xa0 Any\r\naerial devices, display fireworks, or articles pyrotechnic for the purposes of section\r\n132D-16 upon payment of a fee of $110; and

\r\n\r\n

\xa0\xa0\xa0\xa0 (3)\xa0 Any\r\nconsumer fireworks [~~for the purposes of section 132D-5 or~~] for cultural uses\r\nthat occur at any time other than during the periods prescribed in section 132D-3(1)\r\nupon a payment of a fee of $25.

\r\n\r\n

\xa0\xa0\xa0\xa0 (b)\xa0\r\nEach person may purchase a maximum of fifty permits per year."

\r\n\r\n

\xa0\xa0\xa0\xa0 SECTION 10.\xa0 Section 132D-12,\r\nHawaii Revised Statutes, is amended to read as f'b'ollows:

\r\n\r\n

\xa0\xa0\xa0\xa0 "\xa7132D-12\xa0 [~~Sale~~]\r\nDistribution to minors; [~~sale by minors;~~] prohibited.\xa0 (a)\xa0\r\nIt shall be unlawful for any person to [~~offer for sale, sell, or give~~]\r\ndistribute any consumer fireworks, aerial devices, display fireworks,\r\nor articles pyrotechnic to minors, [~~and for any minor to possess, purchase, sell,\r\nor set off, ignite, or otherwise cause to explode any fireworks or articles pyrotechnic,~~]\r\nexcept as provided in section 132D-13.

\r\n\r\n

\xa0\xa0\xa0\xa0 (b)\xa0 A person who violates\r\nthis section shall be guilty of a class C felony."

\r\n\r\n

\xa0\xa0\xa0\xa0 SECTION 11.\xa0 Section 132D-13,\r\nHawaii Revised Statutes, is amended to read as follows:

\r\n\r\n

\xa0\xa0\xa0\xa0 "\xa7132D-13\xa0 Liability\r\nof parents or guardians.\xa0 [~~The parents,~~]\r\n(a)\xa0 Except as provided in subsection (b),\r\nit shall be unlawful for a parent, guardian, [~~and~~] or other [~~persons]\r\nperson having the custody or control of any minor[~~, who~~] to\r\nknowingly permit the minor to [~~possess,~~]:~~

\xa0\xa0\xa0\xa0 (2)\xa0 Set off,\r\nignite, discharge, or otherwise\r\ncause to explode any [~~fireworks~~] consumer fireworks, aerial devices, display\r\nfireworks, or articles pyrotechnic[~~, shall be deemed to be in violation of\r\nthis chapter and shall be subject to the penalties thereunder, except~~].
\r\n\r\n
\xa0\xa0\xa0\xa0 (b)\xa0 [~~the parents~~]\r\nThe parent or guardian may allow the minor to use consumer fireworks while\r\nunder the immediate supervision and control of the parent or guardian, or under\r\nthe immediate supervision and control of another adult.
\r\n\r\n
\xa0\xa0\xa0\xa0 (c)\xa0 Separate and apart\r\nfrom any civil liability that may result from this or any related incident, and\r\nexcept as provided in subsections (d) and (e), the violation of subsection (a) shall\r\nbe a misdemeanor.
\r\n\r\n
\xa0\xa0\xa0\xa0 (d)\xa0 If any of the consumer\r\nfireworks, aerial devices, display fireworks, or articles pyrotechnic set off, ignited,\r\ndischarged, or otherwise caused to explode in violation of subsection (a)(2) cause\r\nsubstantial bodily injury to another person, the violation of subsection (a) shall\r\nbe a class C felony.
\r\n\r\n
\xa0\xa0\xa0\xa0 (e)\xa0 If any of the consumer\r\nfireworks, aerial devices, display fireworks, or articles pyrotechnic set off, ignited,\r\ndischarged, or otherwise caused to explode in violation of subsection (a)(2) cause\r\nserious bodily injury or death to another person, the violation of subsection (a)\r\nshall be a class B felony.
\r\n\r\n
\xa0\xa0\xa0\xa0 (f)\xa0 The state of mind requirement\r\nfor subsection (d) and (e) shall not be applicable to whether the person was aware\r\nthat the consumer fireworks, aerial devices, display fireworks, or articles pyrotechnic\r\ncaused or would cause the injury or death.\xa0\r\nA person shall be strictly liable with respect to the result that the consumer\r\nfireworks, aerial devices, display fireworks, or articles pyrotechnic cau'b'sed the\r\ninjury or death."
\r\n\r\n
\xa0\xa0\xa0\xa0 SECTION 12.\xa0 Section 132D-14,\r\nHawaii Revised Statutes, is amended to read as follows:
\r\n\r\n
\xa0\xa0\xa0\xa0 "\xa7132D-14\xa0 Penalty.\xa0 (a)\xa0 [~~Any~~]\r\nExcept as provided in subsections (b) and (c), any person:
\r\n\r\n
\xa0\xa0\xa0\xa0 (1)\xa0 Importing, storing, or distributing consumer fireworks, aerial devices, display fireworks, or articles pyrotechnic without\r\nhaving a valid license [~~under~~] as required pursuant to section 132D-7\r\n[~~shall be~~]:

\xa0\xa0\xa0\xa0\xa0\xa0\xa0\xa0\xa0 (A)\xa0 Shall be\r\nguilty of a class C felony; and
\r\n\r\n
\xa0\xa0\xa0\xa0\xa0\xa0\xa0\xa0\xa0 (B)\xa0 Notwithstanding\r\nsubparagraph (A), if the total weight of the consumer fireworks, aerial devices,\r\ndisplay fireworks, and articles pyrotechnic is twenty-five pounds or more, shall\r\nbe guilty of a class B felony;
\r\n\r\n
\xa0\xa0\xa0\xa0 (2)\xa0 Purchasing, possessing, setting off, igniting, [or] discharging, or\r\notherwise causing to explode aerial devices, display fireworks, or articles\r\npyrotechnic without a valid permit [~~under~~] required pursuant to sections\r\n132D-10 and 132D-16, [or storing, selling, or possessing aerial devices, display\r\nfireworks, or articles pyrotechnic without a valid license'b' under section 132D-7,\r\nor allowing an individual to possess, set off, ignite, discharge, or otherwise cause\r\nto explode any aerial device in violation of section 132D-14.5]:
\r\n\r\n
\xa0\xa0\xa0\xa0\xa0\xa0\xa0\xa0\xa0 (A)\xa0 If the total\r\nweight of the aerial devices, display fireworks, and articles pyrotechnic is fifty\r\npounds or more, shall be guilty of a class B felony;
\r\n\r\n
\xa0\xa0\xa0\xa0\xa0\xa0\xa0 [~~(A)~~]\xa0 (B)\xa0 If the total weight of the aerial devices, display\r\nfireworks, [or] and articles pyrotechnic is twenty-'b'five pounds or\r\nmore, shall be guilty of a class C felony; [or
\r\n\r\n
\xa0\xa0\xa0\xa0\xa0\xa0\xa0\xa0 ~~(B)~~]\xa0 (C)\xa0 If the total weight of the aerial devices, display\r\nfireworks, [or] and articles pyrotechnic is [~~less than twenty-five\r\npounds,~~] five pounds or more, shall be guilty of a misdemeanor;
\r\n\r\n
\xa0\xa0\xa0\xa0\xa0\xa0\xa0\xa0\xa0 (D)\xa0 If the total\r\nweight of the aerial devices, display fireworks, or articles pyrotechnic is less\r\nthan five pounds, and if the total weight cannot be determined, shall be 'b'fined\r\n$300 and subject to proceedings under chapter\xa0\xa0\xa0\r\n.
\r\n\r\n
\xa0\xa0\xa0 [~~(3)~~\xa0 Who transfers\r\nor sells aerial devices, display fireworks, or articles pyrotechnic to a person\r\nwho does not have a valid permit under sections 132D-10 and 132D-16, shall be guilty\r\nof a class C felony; and
\r\n\r\n
\xa0\xa0\xa0\xa0 ~~(4)~~\xa0 ~~Who removes or\r\nextracts the pyrotechnic contents from any fireworks\xa0~~ ~~or articles pyrotechnic and uses the contents\r\nto construct fireworks, articles pyrotechnic, or a fir'b'eworks or articles pyrotechnic\r\nrelated device shall be guilty of a misdemeanor.~~]
\r\n\r\n
\xa0\xa0\xa0\xa0 (b)\xa0 Any person who would\r\notherwise be subject to sentencing for a criminal offense under subsection (a) shall\r\nbe guilty of an offense one class or grade higher, as the case may be, than that\r\nprovided in subsection (a) if:
\r\n\r\n
\xa0\xa0\xa0\xa0 (1)\xa0 The person has\r\nbeen convicted one or more times for any offense under this chapter within ten years\r\nof the instant offense; or
\r\n\r\n
\xa0\xa0\xa0\xa0 (2)\xa0 Any of the consumer\r\nfireworks, aerial devices, display fireworks, or articles pyrotechnic imported,\r\nstored, distributed, purchased, possessed, set off, ignited, discharged, or otherwise\r\ncaused to explode in the commission of the offense under subsection (a) cause substantial\r\nbodily injury to another person.
\r\n\r\n
\xa0\xa0\xa0\xa0 (c)\xa0 Any person who would\r\notherwise be subject to sentencing for a criminal offense under subsection (a) shall\r\nbe guilty of an offense two classes or grades higher, as the case may be, than that\r\nprovided in subsection (a) if any of the consumer fireworks, aerial devices, display\r\nfi'b'reworks, or articles pyrotechnic imported, stored, distributed, purchased, possessed,\r\nset off, ignited, discharged, or otherwise caused to explode in the commission of\r\nthe offense under subsection (a) cause serious bodily injury or death to another\r\nperson.\xa0 For an offense already classified\r\nas a class B felony, the person shall be guilty of a class A felony if any of the\r\nconsumer fireworks, aerial devices, display fireworks, or articles pyrotechnic imported,\r\nstored, distributed, purchased, possessed, set off, ignited, discharged, or otherwise\r\ncaused to explode in the commission of the offense under subsection (a) cause serious\r\nbodily injury or death to another person.
\r\n\r\n
\xa0\xa0\xa0\xa0 (d)\xa0 The state of mind requirement\r\nfor subsection'b's (b) and (c) shall not be applicable to whether the person was aware\r\nthat any of the consumer fireworks, aerial devices, display fireworks, or articles\r\npyrotechnic caused or would cause the injury or death.\xa0 A person shall be strictly liable with respect\r\nto the attendant circumstance that the consumer fireworks, aerial devices, display\r\nfireworks, or articles pyrotechnic caused the injury or death.
\r\n\r\n
\xa0\xa0\xa0\xa0 [~~(b)~~] (e)\xa0 Except\r\nas provided in subsection (a), (b), or (c), or as otherwise specifically\r\nprovided for in this chapter, any person violating any other provision of this chapter,\r\nshall be guilty of a violation and fined no less than $500 and no\r\nmore than $5,000 for each violation.\xa0 [~~Notwithstanding\r\nany provision to the contrary in this section, any person violating section 132D-14.5\r\nshall be fined at least $500 and no more than $5,000.~~]
\r\n\r\n
\xa0\xa0\xa0\xa0 [~~(c)~~] (f)\xa0 The\r\ncourt shall collect the fines imposed in subsections (a) [~~and~~], (b),\r\n(c), and (e) for violating this chapter and, of the fines collected, shall pay\r\ntwenty per cent to the State and eighty per cent to the county in which the fine\r\nwas imposed, which shall be expended by the county for law enforcement purposes.
\r\n\r\n
\xa0\xa0\xa0\xa0 [~~(d)~~] <'b'u>(g)\xa0 Notwithstanding\r\nany penalty set forth herein, violations of subsection (a)(1) [~~or (3)~~] may\r\nbe subject to nuisance abatement proceedings provided in part V of chapter 712.
\r\n\r\n
\xa0\xa0\xa0\xa0 [~~(e)\xa0~~ ~~For the purposes of this section:~~
\r\n\r\n
\xa0\xa0\xa0\xa0 ~~(1)~~\xa0 ~~Each type of prohibited firework imported, purchased,\r\nsold, possessed, set off, ignited, or discharged shall constitute a separate violation\r\nfor each unopened package; and~~
\r\n\r\n
\xa0\xa0\xa0\xa0 ~~(2)~~\xa0 ~~Each separate firework imported, purchased,\r\nsold, possessed, set off, ignited, or discharged shall be a separate violation if\r\nthe package is opened or the firework is not in a package.~~
\r\n\r\n
\xa0\xa0\xa0\xa0 ~~(f)\xa0\xa0~~ ~~For the purposes of this section, "package":~~
\r\n\r\n
\xa0\xa0\xa0\xa0 ~~(1)~~\xa0 ~~Means any aerial device, display firework, or\r\narticle pyrotechnic:~~
\r\n\r\n
\xa0\xa0\xa0\xa0\xa0\xa0\xa0\xa0\xa0 ~~(A)~~\xa0 ~~Enclosed in a container or wrapped in any manner\r\nin advance of wholesale or retail sale; and~~
\r\n\r\n
\xa0\xa0\xa0\xa0\xa0\xa0\xa0\xa0\xa0 ~~(B)~~\xa0 ~~With a weight or measure determined in advance\r\nof wholesale or retail sale; and~~
\r\n\r\n
\xa0\xa0\xa0\xa0 ~~(2)~~\xa0 ~~Does not mean:~~
\r\n\r\n
\xa0\xa0\xa0'b'\xa0\xa0\xa0\xa0\xa0\xa0 ~~(A)~~\xa0 ~~Inner wrappings not intended to be individually\r\nsold to the customer;~~

\xa0\xa0\xa0\xa0\xa0\xa0\xa0\xa0\xa0 ~~(D)~~\xa0 ~~Containers used for retail tray pack displays\r\nwhen the container itself is not intended to be sold; or~~
\r\n\r\n
\xa0\xa0\xa0\xa0\xa0\xa0\xa0\xa0\xa0 ~~(E)~~\xa0 Open carriers and transparent wrappers or carriers\r\nfor containers when the wrappers or carriers do not bear printed matter pertaining\r\nto any particular aerial devices, display fireworks, or articles pyrotechnic.]"
\r\n\r\n
\xa0\xa0\xa0\xa0 SECTION 13.\xa0 Section 132D-14.5,\r\nHawaii Revised Statutes, is amended to read as follows:
\r\n\r\n
\xa0\xa0\xa0\xa0 "[[]\xa7132D-14.5[]]\xa0 Liability of homeowner, renter, or person otherwise\r\nresponsible for real property.\xa0 (a)\xa0 A homeowner,\r\nrenter, or person otherwise responsible for [~~the~~] real property who\r\nintentionally, knowingly, [or] recklessly [~~allows~~], or negligently:
\r\n\r\n
\xa0\xa0\xa0\xa0 (1)\xa0 Allows\r\nan individual, while on the real property, to possess, set off, ignite, discharge,\r\nor otherwis'b'e cause to explode any aerial [~~device~~] devices, display fireworks,\r\nor articles pyrotechnic without a permit issued pursuant to this chapter shall\r\nbe [~~deemed to be in violation of this chapter and shall be subject to the penalties\r\nspecified in section 132D-14(a)(2) and (b).~~] guilty of a petty misdemeanor;
\r\n\r\n
\xa0\xa0\xa0\xa0 (2)\xa0 Allows\r\nany aerial devices, display fireworks, articles pyrotechnic, or pyrotechnic composition\r\nto be stored in the real property without a lic'b'ense issued pursuant to this chapter\r\nshall be guilty of a misdemeanor; and
\r\n\r\n
\xa0\xa0\xa0\xa0 (3)\xa0 Notwithstanding\r\nparagraph (2), allows aerial devices, display fireworks, articles pyrotechnic, or\r\npyrotechnic composition to be stored in the real property, if the total weight of\r\nthe aerial devices, display fireworks, articles pyrotechnic, and pyrotechnic composition\r\nis twenty-five pounds or more without a license issued pursuant to this\r\nchapter, shall be guilty of a class C felony.
\r\n\r\n
\xa0\xa0\xa0\xa0 (b)\xa0 Any person who would\r\notherwise be subject to sentencing under subsection (a) shall be guilty of an offense\r\none class or grade higher, as the case may be, than that provided in subsection\r\n(a) if:
\r\n\r\n
\xa0\xa0\xa0\xa0 (1)\xa0 The person has\r\nbeen convicted one or more times for any offense under this chapter within ten years\r\nof the instant offense; or

\xa0\xa0\xa0\xa0 (c)\xa0 Any person who would\r\notherwise be subject to sentencing under subsection (a) shall be guilty of an offense\r\ntwo classes or grades higher, as the case may be, than that provided in subsection\r\n(a) if any of the aerial devices, display fireworks, articles pyrotechnic, or pyrotechnic\r\ncomposition possessed, set off, ignited, discharged, otherwise\r\ncaused to explode, or stored in the violation of subsection (a) cause serious bodily\r\ninjury or death to another person.
\r\n\r\n
\xa0\xa0\xa0\xa0 (d)\xa0 The state of mind requirement for subsections\r\n(b) and (c) shall not be applicable to whether the person was aware\xa0 that any of the aerial devices, display fireworks,\r\narticles pyrotechnic or pyrotechnic\r\ncomposition caused or would cause the injury or death.\xa0 A person shall be strictly liable with respect\r\nto the attendant circumstance that the aerial devices, display fireworks, or articles\r\npyrotechnic caused the injury or death."
\r\n\r\n
\xa0\xa0\xa0\xa0 SECTION 14.\xa0 Section 132D-15,\r\nHawaii Revised Statutes, is amended to read as follows:
\r\n\r\n
\xa0\xa0\xa0\xa0 "[[]\xa7132D-15[]]\xa0 Notice requirements.\xa0 Each licensed retail outlet shall post adequate\r\nnotice that clearly cautions each person purchasing consumer fireworks of\r\nthe prohibitions, liabilities, and penalties incorporated in sections 132D-12, 132D-13,\r\n[~~and~~] 132D-14[.], and 132D-E."
\r\n\r\n
\xa0\xa0\xa0\xa0 SECTION 15.\xa0 Section 132D-17.5,\r\nHawaii Revised Statutes, is amended to read as follows:
\r\n\r\n
\xa0\xa0\xa0\xa0 "[[]\xa7132D-17.5[]]\xa0 County ordinances.\xa0 (a)\xa0\r\nNothing in this chapter shall be construed to supersede or in any manner\r\naffect a county fireworks ordinance; provided that the ordinance is at least as\r\nstringent in the control or prohibition of consumer fireworks, aerial\r\ndevices, display fireworks, and articles pyrotechnic as the law under this chapter.
\r\n\r\n
\xa0\xa0\xa0\xa0 (b)\xa0 Nothing in this chapter\r\nshall prohibit a county from enacting ordinances that are more stringent in the\r\ncontrol or prohibition of consumer fireworks, aerial devices, display\r\nfireworks, and articles pyro'b'technic than this chapter."
\r\n\r\n
\xa0\xa0\xa0\xa0 SECTION 16.\xa0 Section 132D-21, Hawaii\r\nRevised Statutes, is amended to read as follows:
\r\n\r\n
\xa0\xa0\xa0\xa0 "\xa7132D-21\xa0 Health care\r\nfacilities; report of fireworks and articles pyrotechnic incidents.\xa0 Health care facilities in this State shall report\r\nall incidents of serious injuries and fatalities caused by legal and illegal consumer\r\nfireworks, aeri'b'al devices, display fireworks, or articles pyrotechnic to\r\nthe department of health and the police department of the county in which the person\r\nwas attended or treated.\xa0 All reports shall\r\nbe in writing or in the manner specified by the department of health.
\r\n\r\n
\xa0\xa0\xa0\xa0 As used in this section, "health care facilities" includes\r\nany outpatient clinic, emergency room, or physician\'s office, private or public,\r\nwhether organized for profit or not, used, operated, or designed to provide medical\r\ndiagnosis, treatment, nursing, rehabilitative, or preventive care to any person\r\nor persons.\xa0 The term includes but is not\r\nlimited to health care facilities that are commonly referred to as hospitals, extended\r\ncare and rehabilitation cente'b'rs, nursing homes, skilled nursing facilities, intermediate\r\ncare facilities, hospices for the terminally ill that require licensure or certification\r\nby the department of health, kidney disease treatment centers, including freestanding\r\nhemodialysis units, outpatient clinics, organized ambulatory health care facilities,\r\nemergency care facilities and centers, home health agencies, health maintenance\r\norganizations, and others providing similarly organized services regardless of nomenclature."
\r\n\r\n
\xa0\xa0\xa0\xa0 SECTION\r\n17.\xa0\xa0 Section 132D-22, Hawaii Revised\r\nStatutes, is amended to read as follows:
\r\n\r\n
\xa0\xa0\xa0\xa0 "[[]\xa7132D-22[]]\xa0 Entry onto premises; inspection of premises, books,\r\nand records; obstructing [~~law enforcement or fire department~~] inspector\r\noperations; penalty.\xa0 (a)\xa0 Any [~~law enforcement or fire officer~~] inspector\r\nmay, at reasonable hours, enter and inspect the premises of a licensee or permittee\r\nand any relevant books or records therein to verify compliance with this chapter\r\nand the conditions of the license or permit.
\r\n\r\n
\xa0\xa0\xa0\xa0 (b)\xa0 Upon a request by any\r\n[~~law 'b'enforcement or fire officer~~] inspector to enter and inspect the\r\npremises of a licensee or permittee at reasonable hours, the licensee, the permittee,\r\nor an employee of the licensee or permittee shall make available for immediate inspection\r\nand examination the premises and all relevant books and records therein.
\r\n\r\n
\xa0\xa0\xa0\xa0 (c)\xa0 Any licensee or permittee\r\nwho refuses the [~~law enforcement or fire officer~~] inspector entry\r\nor access to the premises, books, or records shall be in violation of the conditions\r\nof the license or permit.\xa0 After a hearing,\r\nthe issuing department shall suspend or revoke the license or permit for refusing\r\nentry or access or for violations of any other requirement or condition of the license\r\n'b"or permit or any provision of this chapter or rule adopted pursuant to this chapter.\xa0 The issuing department shall provide the licensee\r\nor permittee with a written notice and order describing the basis for the suspension\r\nor revocation.\xa0 Any person aggrieved by the\r\nsuspension or revocation determination may request a contested case hearing pursuant\r\nto chapter 91.\xa0 To request a contested case\r\nhearing, the person shall submit a written request to the issuing department within\r\nthirty calendar days of the date of the notice and order of the suspension or revocation.\xa0 Appeal to the circuit court under section 91-14,\r\nor any other applicable statute, shall only be taken from the issuing department's\r\nfinal order pursuant to a contested case.
\r\n\r\n
\xa0\xa0\xa0\xa0 (d)\xa0 Any licensee, permittee,\r\nemployee of a licensee or permittee, or other person who:
\r\n\r\n
\xa0\xa0\xa0\xa0 (1)\xa0 Threatens with the use\r\nof violence, force, or physical interference or obstacle, or hinders, obstructs,\r\nor prevents any [~~law enforcement or fire officer,~~] inspector, or any\r\nperson assisting [~~a law enforcement or fire officer,~~] an inspector,\r\nfrom entering into the premises of the licensee or permittee; or
\r\n\r\n
\xa0\xa0\xa0\xa0 (2)\xa0 Opposes, obstructs, or\r\nmolests [~~a law enforcement or fire officer~~] an inspector in the officer\'s\r\nenforcement of this chapter,
\r\n\r\n
shall be guilty of a misdemeanor, punishable by a fine of no more than $2,000\r\nor imprisonment for no more than one year, or both.
\r\n\r\n
\xa0\xa0\xa0\xa0 (e)\xa0 If any [~~law enforcement\r\nor fire officer~~] inspector, having demanded admittance onto the premises\r\nof a licensee or permittee and declared the [~~officer\'s~~] inspector\'s\r\nname and office'b', is not admitted by the licensee, permittee, or person in charge\r\nof the premises, the [~~officer~~] inspector may use force to enter the\r\npremises.
\r\n\r\n
\xa0\xa0\xa0\xa0 (f)\xa0 For purposes of this section[,]:
\r\n\r\n
\xa0\xa0\xa0\xa0 "Inspector" means any county fire department officer,\r\nincluding firefighters.
\r\n\r\n
\xa0\xa0\xa0\xa0 [~~"premises~~] "Premises of a licensee 'b'or permittee"\r\ndoes not include the licensee\'s or permittee\'s private residence or a dwelling that\r\nis considered to be the person\'s [~~home,~~] dwelling, including a [~~single\r\nfamily~~] single-family house, apartment unit, condominium, townhouse,\r\nor cooperative unit."
\r\n\r\n
\xa0\xa0\xa0\xa0 SECTION 18.\xa0 Section 571-41,\r\nHawaii Revised Statutes, is amended by amending subsection (f) to read as follows:
\r\n\r\n
\xa0\xa0\xa0\xa0 "(f)\xa0 The judge, or the\r\nsenior judge if there is more than one, may by order confer concurrent jurisdiction\r\non a d'b'istrict court created under chapter 604 to hear and dispose of cases of violation\r\nof traffic laws, traffic ordinances, [or] emergency period rules,\r\nor fireworks infractions established pursuant to chapter\xa0\xa0\xa0 , by children, provision to the contrary\r\nin section 571-11 or elsewhere notwithstanding.\xa0\r\nThe exercise of jurisdiction over children by district courts shall, nevertheless,\r\nbe considered noncriminal in procedure and result in the same manner as though the\r\nmatter had been adjudicated and disposed of by a family court."
\r\n\r\n
\xa0\xa0\xa0\xa0 SECTION 19.\xa0 Section 601-3.7,\r\nHawaii Revised Statutes, is amended by amending subsection (a) to read as follows:
\r'b'\n\r\n
\xa0\xa0\xa0\xa0 "(a)\xa0 There is established\r\nin the state treasury a special fund to be known as the judiciary computer system\r\nspecial fund, which shall contain the following:
