Requires any equity purchased by HHFDC under the Dwelling Unit Revolving Fund Equity Pilot Program to be in a for sale housing development project within a transit oriented development zone.

    The CD1 extends the program until 2031, and it includes a new definition of a TOD zone. It mean TOD zone means for a county with a population of 500,000 or more, a transit oriented development infrastructure improvement program area pursuant to Section 206E-243 HRS, or for a county with a population of less than 500,000, a county designated transit area, an area situated along major bus routes, or an area within one half mile radius of a bus stop as defined by the respective county.

The, funding request, the amount the pilot program can spend is capped at $20,000,000, and the effective date has been changed to upon approval.

This bill amends the down payment loan assistance program by removing the prohibition on combined loan to value ratios, clarifying the Hawaii Housing Finance and Development Corporation's authority to establish interest rates and allow payment waivers and interest forgiveness, authorizing financial institutions, mortgage lenders, and other loan originators to originate down payment loans, and reducing the borrower's required personal contribution towards the down payment.

The changes in the draft that are ongoing was based partially on county feedback.

    And then, WHAM, in a lot of ways, I think, made the bill better when it went through that committee and that they took out a lot of the the harsher language. And what the bill really is asking now is just for sort of disclosure on how a county got to their affordable housing requirements. And so I think what we're amending the preamble just to reflect that the bill has changed significantly, and and it's really just a disclosure and transparency study bill.

    Is it okay with you if I could just describe the Bill and the proposed Amendments before I take the vote? So the Bill is just clarifying the 99 year leasehold program under HCDA. 60% of units will have to be income restricted and owner occupied.

    HCDA via rule can establish initial sales periods for the an initial sales period for the other units where they will require owner occupancy for a certain period, which will go away if the units remain unsold. This is to help ensure that the 99 year leasehold program is, successful and financially viable as a program. The proposed are agreed upon amendments will just delete language from, 2 separate sentences that says or any other person intending to live with the eligible buyer or owner.

    And that term AI companion means a system using artificial intelligence, generative artificial intelligence, or emotional recognition algorithms designed to simulate a sustained human or human like relationship with a user by retaining information on prior interactions or user sessions and user preferences to personalize the interaction and facilitate ongoing engagement with the AI companion.

    For minor users, we're increasing the frequency of disclosure requirement to minor users from every 3 hours to every hour and adding feature restriction to prohibit the AI companion from generating outputs to discourage disengagement. And amending the requirement to tools for user and parents to clarify that the tools are to manage screen time and account settings.

And because you have romance in the young adult section at Barnes and Noble, we need tighter definitions to make sure we don't veer into the content restriction territory that could put the Bill at risk.

A lot of the time, people will redo their kitchen and sell solar, not tell their insurance company. And then when a disaster hits, their insured amount won't rebuild that exact house or rebuild the house the insurance companies thought they had when they insured the house. So every two years, this requires insurance agents to ask the homeowner if they've made any significant improvements.

    They'll take that information, give it to the insurance company. If the homeowner, responds, which is not required by the homeowner, give it to the insurance company. The insurance company will reassess the value of the house and adjust the insurance amount offered accordingly.

These facilities remain subject to applicable state health and safety codes, disability accessibility requirements, general excise, and transit accommodation taxes, and we've agreed on an effective date upon approval.     Okay. First bill is 20, Senate Bill 2517, Senate Draft 1 relating to Public Safety. This was part of the law enforcement coalition package and had to do with effective orders, restraining orders. Where I thought we had, you know, some good language for the couple of CDW, which we submitted to, your countries a little bit earlier. And so we're, hopeful that you may see, some value in this.

    Thank you. I certainly see value in your good work. I just have a philosophical difference with it. I'm not prepared to move this bill out. I'd like to, pass out just for members to to see where I'm coming from.

    This is the testimony of the Office of Public Defenders on this measure on the SD1. You know, the proposed change is based on what I think is a false premise that a tougher penalty would actually serve as a deterrent to a situation which is usually highly emotional and involves different types of relationships that are under stress. Granting a TRO only requires that a request be made to a judge and that a hearing with all involved parties is usually done after the order is issued.

    So I agree with the public defenders that if that an individual who legally possesses or owns a firearm, who then becomes a respondent in a TRO or a protective order, can be subject to a misdemeanor offense for violating the order and at the same time, now be subject to a felony for merely possessing their legally owned firearm and not relinquish it to the police in a timely manner. I you know, the the term possessed is not well defined in the statute.

    Preamble, you know, states the person who becomes a respondent presents an increased risk of lethality and must relinquish any firearms, and and it already is illegal for someone. And it's a misdemeanor and I think that's appropriate. So it's a philosophical difference. I appreciate your good work on it, but I'm gonna be going with the recommendation of the public defenders and not moving forward on this measure, this session.

    So if, advocates of the law enforcement coalition wants to try again next year and we can discuss this matter and bring the public defenders into this, we can do that.

    Because frankly, I think the strict penalties and constitutional rights at stake here, it's gonna we're gonna see more litigation, and I I just think I don't wanna go down that path. So we can try again next year and I can consider more. Okay? So I'd like to defer this measure.

    See on the next measure, Senate Bill 2575 Senate draft 2 House draft 1, relating to Firearms. This measure also had to do with firearms and temporary restraining orders and other features. However, it had a broader range of factors in it. So we did provide a proposed one to be. And it was to replace the previously distributed proposed CD1.

So from that standpoint, we would prefer to wait until next year when we have a better sense of where we are with the department, its leadership, and hopefully the economic situation will be a little bit brighter.

    That makes sense. I mean, the Department of Law Enforcement needs to get leadership stabilized. We need to get funding stabilized, and then let's see if this is something we can consider next year. So let's defer on this measure. Okay.

So this version requires the Department of Agriculture and Biosecurity to adopt rules implemented program. The program allows for donations of meat from hunters who have completed a training and certification program to be developed by DAB with the assistance of DLH.

    It also makes confirming amendments to regulatory requirements to authorize the program. So the effective date of this measure will be upon approval. It'll provide DAB two years to come up with the rules as the program will not be effective until 07/01/2028, and it will be a five year pilot. And, unfortunately, due to the nonfiscal bill filing deadline today and the limited time, remaining, unfortunately, we need to defer this bill. And, with that said, I'll be working on the issue during the interim to address the legal and the regulatory concerns of authorizing hemp to be used in commercial animal seed. And I look forward to further discussions.
