This bill authorizes HHFDC to off approve and certified general excise tax exemptions for certain housing development projects developed under county housing incentive programs. Requires any equity purchased by HHFDC under the Dwelling Unit Revolving Fund Equity Pilot Program to be in a for sale housing development project within a transit oriented development zone.

The CD1 extends the program until 2031, and it includes a new definition of a TOD zone. It mean TOD zone means for a county with a population of 500,000 or more, a transit oriented development infrastructure improvement program area pursuant to Section 206E-243 HRS, or for a county with a population of less than 500,000, a county designated transit area, an area situated along major bus routes, or an area within one half mile radius of a bus stop as defined by the respective county.

The, funding request, the amount the pilot program can spend is capped at $20,000,000, and the effective date has been changed to upon approval.

This bill amends the down payment loan assistance program by removing the prohibition on combined loan to value ratios, clarifying the Hawaii Housing Finance and Development Corporation's authority to establish interest rates and allow payment waivers and interest forgiveness, authorizing financial institutions, mortgage lenders, and other loan originators to originate down payment loans, and reducing the borrower's required personal contribution towards the down payment.

Authorizes borrowers to use a portion of a down payment loan to pay for closing costs, prepaids, and reserves the purchase of the residential property for which the down payment loan is provided. And the agreement that we have is, the CD1meffective upon approval. Is that right?

So, so I think we have a tentative agreement on language. We're going through one last, CD1 drafting request, which will get you folks that draft as soon as we get it back. Hopefully, in the next few hours, at which time we can probably both put in maybe a revised finished land release request, because the language has changed a little bit. The changes in the draft that are ongoing was based partially on county feedback.

I think we're addressing all the concerns brought to us by by counties.

And then, WHAM, in a lot of ways, I think, made the bill better when it went through that committee and that they took out a lot of the the harsher language. And what the bill really is asking now is just for sort of disclosure on how a county got to their affordable housing requirements. And so I think what we're amending the preamble just to reflect that the bill has changed significantly, and and it's really just a disclosure and transparency study bill.

Is it okay with you if I could just describe the Bill and the proposed Amendments before I take the vote? So the Bill is just clarifying the 99 year leasehold program under HCDA. 60% of units will have to be income restricted and owner occupied.

HCDA via rule can establish initial sales periods for the an initial sales period for the other units where they will require owner occupancy for a certain period, which will go away if the units remain unsold. This is to help ensure that the 99 year leasehold program is, successful and financially viable as a program. The proposed are agreed upon amendments will just delete language from, 2 separate sentences that says or any other person intending to live with the eligible buyer or owner.

And that term AI companion means a system using artificial intelligence, generative artificial intelligence, or emotional recognition algorithms designed to simulate a sustained human or human like relationship with a user by retaining information on prior interactions or user sessions and user preferences to personalize the interaction and facilitate ongoing engagement with the AI companion.

Asking unprompted or unsolicited emotion based questions that go beyond a direct response to a user prompt. And sustaining an ongoing dialogue concerning matters personal to the user. There are no exceptions to this AI companion definition. We think it is sufficiently detailed and pretty narrow to to account for the type of system that we're really worried about here.

For all users, we'll require operators to institute reasonable measures to prevent the AI companion from generating outputs that encourage the user to cause serious bodily injury to another person, which is a new standard that we're adding that's in place in Canada. And we're adding the definition serious bodily injury from the state criminal code so that there's clarity about what it is we're talking about.

For minor users, we're increasing the frequency of disclosure requirement to minor users from every 3 hours to every hour and adding feature restriction to prohibit the AI companion from generating outputs to discourage disengagement. And, deleting requirements for operators to institute measures relating to the service being a human or sentient being.

Representations related to romantic or sexual relations and related definitions and manipulative techniques and mental health services because the Senate position is that those provisions were not sufficiently articulated. They're just too broad, and we think that the narrowed definition with no exceptions at the beginning of the Bill is sufficient to account for the danger represented there. And amending the requirement to tools for user and parents to clarify that the tools are to manage screen time and account settings.

And replace the DCCA with the Department of Health's Behavioral Health Administration as the agency to which operators must submit an annual report. Removing the civil penalties provisions.

And because you have romance in the young adult section at Barnes and Noble, we need tighter definitions to make sure we don't veer into the content restriction territory that could put the Bill at risk.

So, the house made some significant changes to this bill. It's to make sure that everyone has adequate replacement value coverage on their homes. A lot of the time, people will redo their kitchen and sell solar, not tell their insurance company. And then when a disaster hits, their insured amount won't rebuild that exact house or rebuild the house the insurance companies thought they had when they insured the house. So every two years, this requires insurance agents to ask the homeowner if they've made any significant improvements.

They'll take that information, give it to the insurance company. If the homeowner, responds, which is not required by the homeowner, give it to the insurance company. The insurance company will reassess the value of the house and adjust the insurance amount offered accordingly.

It authorizes cash transactions to be rounded up or down to the nearest 5¢, following rounding rules everybody learned in elementary school. On purpose, so that it's easy for the public to understand and for our small businesses to be able to account for the fact that pennies are going out in commerce and they are not coming back into the the small businesses.

These facilities remain subject to applicable state health and safety codes, disability accessibility requirements, general excise, and transit accommodation taxes, and we've agreed on an effective date upon approval. This is the testimony of the Office of Public Defenders on this measure on the SD1. You know, the proposed change is based on what I think is a false premise that a tougher penalty would actually serve as a deterrent to a situation which is usually highly emotional and involves different types of relationships that are under stress. Granting a TRO only requires that a request be made to a judge and that a hearing with all involved parties is usually done after the order is issued.

So I agree with the public defenders that if that an individual who legally possesses or owns a firearm, who then becomes a respondent in a TRO or a protective order, can be subject to a misdemeanor offense for violating the order and at the same time, now be subject to a felony for merely possessing their legally owned firearm and not relinquish it to the police in a timely manner. I you know, the the term possessed is not well defined in the statute.

Preamble, you know, states the person who becomes a respondent presents an increased risk of lethality and must relinquish any firearms, and and it already is illegal for someone. And it's a misdemeanor and I think that's appropriate. So it's a philosophical difference. I appreciate your good work on it, but I'm gonna be going with the recommendation of the public defenders and not moving forward on this measure, this session.

Describe the Yeah. So you have come to a post city one. And so with the proposed city one, it will establish an access deer meat donation pilot program from Mali. So this version requires the Department of Agriculture and Biosecurity to adopt rules implemented program. The program allows for donations of meat from hunters who have completed a training and certification program to be developed by DAB with the assistance of DLH.

It also makes confirming amendments to regulatory requirements to authorize the program. So the effective date of this measure will be upon approval. It'll provide DAB two years to come up with the rules as the program will not be effective until 07/01/2028, and it will be a five year pilot. So the sunset is on 06/30/2033, and it will require parts of the legislature. Yes.

This measure has been a pleasure working with you and we have come to a happy compromise on this measure. I'd like to describe the guts of this bill, which requires a statewide permitting data standard developed collaboratively by the Office of Planning and Sustainable Development, permitting agencies, and the Chief Data Officer. It also requires each county to publish a monthly update of building and civil engineering permit data in accordance with that standard. Also requires a report to the legislature and appropriates funds for the CD one.
