    I'm gonna read it. So this bill modifies the alternative pathway within two one h to allow a project to qualify under two one h dash 38. If 80% of the units are deed restricted forever to require occupancy by individuals domiciled on the state, The current draft repeals the prohibition against qualified residents for HHFDC projects owning a majority interest in land, and the current draft adds an eligibility requirement to limiting total assets and property not to exceed the value of the unit they are purchasing.

    It, adds a requirement that buyers own no more than one other property and dispose of it within two years. It increases the owner occupancy requirement from one year to five years, and it makes the measure effective upon approval. Does that sound good to you guys? Alright.     Requires the director of human resource of the appropriate state jurisdiction or the human resource management chief executive of each county to include in their annual reports to the legislature details on the employment of retirements as school resource officers or investigators. If I can describe what this bill is attempting to do, it clarifies administrative driver's license or vacation procedures by specifying the effect of the notice of the administrative verification and conformity-related administrative with new and current positions. This bill is a needed bill as we're trying to make our roads that much safer.

    It clarifies the duties and responsibilities of the individual whose license is now revoked. It clarifies and clearly outlines the statutory duties now set forth by the individual, should they want to get the license back, and it allows judiciary a more streamlined process to make sure that these revocations stick with a new timeline in place and several other technical amendments. It largely has not changed from its last draft, just few technicalities and the days, I believe, we have it with them.

    So largely, this is another transportation measure, and I appreciate you as a Hawaii admin Senator willing to work on this measure, not just for Oahu folks but statewide. Under the Island Of Oahu, we allow the prohibited use of shoulder lanes and designated hours when, unfortunately, there are folks who use this in a dangerous fashion. So this carves out a kind of structure for the inappropriate use of shoulder lanes outside of their designated hours.

    They shall not also so I clarify that you can still use it in emergency.

    There was a part of the measure I think that folks had large concern about as they're related to registration, but upon further research, there is already a mechanism that allows law enforcement to actually remove a vehicle with expired registration. So it just clarifies it's actually just one or more consecutive years. It clarifies also the responsibilities and modern modernizes our updates of Julianna who is to do what after on the seizure and updating the fine to reflect.

    Because the last time this was amended was in 1997, I believe. Yes.

    And then the other penalty in this one, Senator, is something that you and I talk about a lot, that there has been this proliferation of out of state vehicles coming into the state. So this allows an HRS structure for law enforcement to site vehicles who are inappropriately not registered in the state of Hawaii with the minimum fine of $500 up to a fine of a thousand dollars.

    And then also updates our zipper lane and HOB penalty because currently, right now, the minimum Max the Maximum fine is actually $2.50. So this would set the minimum fine at $2.50. States like California and West Coast states find people up to $400 for a proper use of the HOB in the super league.

It authorizes the mayor of each county with a population of less than 500,000 to implement a pilot program to improve the speed, accountability, and quality of permit processing within the county through targeted staffing, performance incentives, and interdepartmental competition.

    I'll talk through it if that's okay. Yeah. Yeah. And, apologies for last minute. We've been trying to really grind this out, as best as we can.

    And, you know, I think to his credit, the Ways and Means chair has been consistently opposed to denying the working class the full benefits of the act 46 tax cuts. And after much consideration on how to simultaneously provide ongoing tax relief while balancing the budget in a responsible way.

    I just, you know, recently sent a proposal over that not only grants the full tax cut for all families who make less than $350,000, that's for joint filers, but also provides an additional $400,000,000 in additional direct income tax relief for those families. This would be paid for by a 1% tax rate increase on the top three brackets of income. For joint filers, that's $450,000 plus.

    If we're gonna make critical decisions around eliminating popular tax cuts or tax credits rather, including for rooftop solar, I think in our part, we cannot in good conscience do so if we're gonna be passing on hundreds of millions of dollars in tax benefits to those who need it least.

    In this way, if, if we're gonna be proposing that lapse, I personally feel more comfortable and the house feels more comfortable if we were to redirect some of that benefit directly to the working class families who need it most. You know, and I think in our mind that seems to align a little bit better compared to we were before and just look forward looking forward to a fruitful conversation going forward. Thank you.

    Sure. You know, I think it's difficult to pinpoint an exact dollar impact of a ramp down for the solar credit because, you're really just kind of moving a bunch of pieces. Right? You have the number of systems someone can claim. You have income thresholds.

    This is our best attempt to slowly walk it down over time. We would have the initial, phase, phase in of the sunsetting starting in 2028, limiting the, dollar value that can be claimed by high income individuals or on a large commercial systems as well as the number of systems that can be claimed.

    And we would have a subsequent change in 2030 with a full phase out, for the actual installation that can be claimed in 2034 and a full phase out of the claims that can be made on those installations in 2036 to allow for some rollover and trail on the back end. Our estimate is that this would save roughly $300,000,000 through the course of the financial plan, but it is subject to mark market conditions and it can be difficult to pinpoint exactly.

It does so by preserving all the tax breaks, including the standard deduction increases and lowering the tax brackets for joint filers making less than 250,000, tens of households making less than $262,500 and single filers making less than 175,000. The Senate also appreciates the house looking at creative ways to further reduce taxes for Hawaii's working families.

    This draft incorporates the house proposal to reduce the brackets two and three tax rates to two point five and five percent. With this additional tax relief, we believe the expansion of other tax credits, including their earned income tax credit, food excise tax credit, and the child dependent care tax credit are not needed.

    The Senate position has consistently been that putting money into working families' pockets every pay period is better than waiting until the end of the year for tax credit. According to the 2024 UHERO report in 2021, over 15,300,000 went to unclean went unclean for the refundable food excise income tax credit. This includes 17,787 tax filings. This means over 17,000 people who filed taxes simply failed to take the credit.

While rates do fluctuate, it underscores the difficulty of relying on tax credits to provide tax relief for wealthy families. The Senate also agrees with the house to push forward the sunset on the tax credits for capital goods excise, technology infrastructure renovation, and ship repair industry tax credits to 01/01/2028. We appreciate the house shift proposal to keep cup to to help cover revenues lost from the increased tax relief.

    This draft keeps the 01/01/2029 sunset for the eighth high-tech high technology business investment, renewable fuels production, and research activities tax credits.

    The Senate further agrees with the language proposed by the house to limit the renewable energy technologies tax credit to those making under 250,000 as joint filers to wrap down this tax credit. The Senate further refined this proposal by setting an aggregate cap of 35,000,000 and restricting its use to joint filers making less than 350,000 and single filers making less than 175,000. This cap will be ramped down by $10,000,000 each year until the credit fully sunsets in 01/01/2030.

    This cap was determined based on the DOTAX data of filers for the credit in the last five years and targeting it to ensure working and middle income households benefit the most. As it currently exists, the renewable energy technologies income tax credit has no guardrails.

And according to DOTAX's data, Hawaii's highest taxpayers earning over 350,000 heavily benefit from the credit as they are able to pay for the upfront cost of installing a PV system. Out of the 58,200,000 credits claimed in 2023, dollars 26,000,000 was issued to filers earning $350,000 or more. This number includes joint filers and individual filers. This is in line with the house and Senate Committee commitment to targeting tax benefits to Hawaii's working families.

    In total, the sunset of tax credits bring an estimated 971,000,000 back into the financial plan. This is integral to helping balance the financial plan and ensure our shared goal of income tax relief for Hawaii's working and middle income families. The Senate proposal proposes to further provide relief for working and middle income households in this area by providing funding to the green Hawaii Green Infrastructure Authority to provide low interest or in some cases, forgivable loans to help cover the cost of installing solar units.

    Hawaii's working families need relief from the unpredictable swings in fuel prices, but they do not have the upfront money needed to take advantage of of the tax credit. This program proposal will bring down the home electricity bills for families that previously could not benefit from residential solar.

First, I just wanna highlight your, attention to the green infrastructure proposal and really really really the idea ideas, gotta sit with it and maybe kinda explore what it looks like, but I think that's a nice one for working class people. Your income cap that you set out for the solar credit at $3.50 and $1.75, we're gonna agree to.

    We have a proposed, alternative to the wind down, for you to consider. We would take that first December thirty first twenty twenty six cap of 35 and go up to 75 for reconsideration.

    The next one, try to push it out a little bit. So stagger them by two year increments. So '28 at 60, 2030 at forty, end of 2032 full sunset where we were at twenty thirty six prior. We have to we're trying to look into this language over here just to kind of check into it on page seven. So we just sit with that for a little bit, assess.

    And then, we would kinda reflect that 2032, December 31 sunset on the top end. On the brackets, we like that you kept in, some of the working class assistance. We would propose a new bracket with a a million dollar threshold for joint income earners. So this would be not tied to any current brackets that are in place. That's something new.

    So at at income over 1,000,000, it would be at 13%, but everything in excess. So nothing prior to that million. For, joint for single, filers, it would be at 500 and at federal household at $7.50 for your consideration. One or two things on the back end and then we're close. The sunsets that you've included for the remaining credits, We're already in alignment on capital goods, and we would agree to the sunsets you've included on the other credits, with those timelines.

It requires the name and address of a person who applies for an identification card or driver's license as and is registered to vote to be automatically updated on the person's voter registration record unless the person affirmatively declines, effective 01/01/2027.
