    Madam Speaker, this bill makes, excuse me, this bill strikes the existing HRS statute regarding the excess rental income formula entirely and establishes a new priority order putting the condo associations ahead of bank mortgage obligations.

    In addition to this new arrangement, this bill proposes condo associations that have title for a floor closed unit may retain rental income received prior to the appointment of a commissioner in a subsequent foreclosure and use such income for their benefit.

    However, depending on the outcome of a subsequent foreclosure by another Lienholder, say the bank, the commission and the commissioner's directive, the condo association would need to return this rental income.

    Maybe this makes sense to some, but for me this seems to add unnecessary complications and potential problems waiting to happen. Also, the most significant point of change is eliminating Lien hold Lien holder protections banks previously relied upon.

    Disregarding the bank mortgage obligations as a top priority, which has been the time honored policy currently established. Opposition testimony from the mortgage bankers association of Hawaii and Hawaii bankers association expressed concern that the bill would

    create instability in the secondary mortgage market and make it more difficult for high for Hawaii residents to secure affordable home loans. Although this bill is well intended, there was no testimony from the attorney general.
