Hearings

Senate Standing Committee on Judiciary

February 19, 2025
  • Karl Rhoads

    Legislator

Welcome everyone to the Judiciary Committee decision making-only agenda, 9:45. We have 12 bills to vote on today. First up on this list is SB 1202. This allows campaign funds to be used for candidates' childcare and vital household dependent care costs under certain conditions.

  • Karl Rhoads

    Legislator

The Campaign Spending Commission has already ruled that childcare costs can be considered campaign expenditures, but this would make it statutory. Our recommendation is to pass unamended. Questions or concerns? If not, thank you, Senator San Juan Buenaventura, for taking votes today.

Thank you very much. Next up is SB 30. This requires all moped drivers to wear a safety helmet when driving a moped, regardless of age. Recommendation here is also to pass unamended. Questions or concerns? If not, Senator and what happened to our...sorry.

Thank you. Next up is SB 55. This relates to administrative rules beginning in January 1, 2027. Requires all state agencies to make the full text of their rules available on the website of the Office of Lieutenant General in a digit—digitally—accessible and searchable format that meets or exceeds certain federal standards.

  • Karl Rhoads

    Legislator

Recommendation here also is to pass as is. Questions or concerns, if not Acting Vice Chair.

    Legislator

Thank you. Next up is SB 106, relating to pedestrians. Authorizes pedestrians to act contrary to the statewide traffic code when a reasonably careful pedestrian would determine that there's no immediate danger of a collision with a moving vehicle if the pedestrian is more than 200 feet from a crosswalk. Recommendation here—it already has a bad date on it—is to pass unamended. Questions or concerns? If not, Senator San Buenaventura.

    Legislator

Thank you very much. Next up is SB 344. This requires all skateboard users under the age of 16 to wear a helmet while operating a skateboard. A recommendation here is to pass unamended. Questions or concerns? If not, Acting Vice Chair.

  • Karl Rhoads

    Legislator

Okay, thank you. Next up is SB 1048, relating to solicitation of funds from the public. Recommendation on this one is to pass with some amendments. Let me find them here. We do have prior concurrence to accept the AG suggestion to remove the ministerial exception. So, if you're not in good standing, you can't raise money this way.

  • Karl Rhoads

    Legislator

And also, per the Attorney General suggestion, removing exemptions from—oh, wait a minute. Is that the way that was phrased? Do you have the? Let's see now. I was just going to pull up to your, how you, how you'd given it to...oh, sorry. Sorry. Okay, so then we'll delete the proposal, the proposed new Provision, in Section 47—467 B-12.5 A.

  • Karl Rhoads

    Legislator

All charitable organizations, charitable fundraising platforms, and charitable platform charities should be required to file written contracts with the Department before commencing charitable solicitations with the state. And that was also an AG's suggestion. And I do—we do have prior concurrence. Otherwise, we'll leave it alone. Any questions or concerns?

  • Karl Rhoads

    Legislator

    If not, Senator San Buenaventura.

  • Joy San Buenaventura

No, I didn't. We didn't ask him. Okay. Yeah, that's okay. That's it. Just those two amendments.

  • Karl Rhoads

    Legislator

Thanks very much. Next up is SB 1511. This prohibits vessels longer than 75 feet from entering Hanale Bay. The recommendation here is to pass unamended. Questions or concerns? If not, Senator San Buenaventura.

  • Karl Rhoads

    Legislator

Thank you. Next up is SB 1337. This clarifies requirements to establish a quorum to do business and invalidate acts of this stadium authority. Would require a majority of voting members for quorum and then a majority of the voting members to concur with actions. Recommendation's to pass as is. Questions or concerns? If not, Senator San Buenaventura.

  • Karl Rhoads

    Legislator

Thank you. Next up is SB 109. This requires that the Hawaiian version of the law be held binding if the law in question was originally drafted in Hawaiian and meets certain criteria. Our recommendation here is to pass with an amendment suggested by the Judiciary.

  • Karl Rhoads

    Legislator

The prior Committee made it so that if the law was originally written in Hawaiian and then amended, translated and then amended in English, then the English would be the binding one. This one—this amendment—would be the other way around. So, we accept the Judiciary's amendment to apply the same rule.

  • Karl Rhoads

    Legislator

But if it was written in English and then translated into Hawaiian and then amended, then the...Hawaii version would be the binding one. Questions or concerns? If not, Senator San Buenaventura.

  • Karl Rhoads

Thank you. Next up is SB 268, relating to burial—island burial councils. Decreases the size of the island burial councils from 9 to 7. Removes the requirement for the councils to include members having development and large property owner interests. Recommendation is to pass as is. Questions or concerns? If not, Senator San Buenaventura.

  • Karl Rhoads

    Legislator

Thank you. Next and last is SB 66. This requires counties to grant building permits within 60 days of the completed application is stamped and certified by a licensed engineer and architect and other certain conditions are met. Well, initially, I was just going to put a bad date on it.

  • Karl Rhoads

    Legislator

But the Chair of the Committee—of the Housing Committee—is also on this Committee. What would you prefer? Do you want it to go out clean or do you want a bad date?

  • Brenton Awa

    Legislator

    Defer to your, uh, judgment.

  • Karl Rhoads

    Legislator

Okay, we'll go ahead and put a bad date on it. April 23, 2057.

  • Karl Rhoads

    Legislator

Other than that, as is. Questions or concerns? Seeing none. Acting Vice Chair.

  • Karl Rhoads

    Legislator

Okay, my—can we just roll into our 10:00 agenda?

  • Joy San Buenaventura

    Legislator

    Yes, that's okay.

  • Karl Rhoads

    Legislator

Okay, so we—we're done with the 9:45 decision making-only agenda. We'll go ahead and move to our 10 o'clock agenda, which has one deferred Bill from, I don't remember, weeks ago.

  • Karl Rhoads

    Legislator

SB 1312, relating to offenses against public health and morals. Clarifies that the definition of profits from prostitution includes any money or property accepted or received from the proceeds of prostitution activity, even if it's accepted or received as a reimbursement or repayment of a debt.

  • Karl Rhoads

    Legislator

So, we had some questions about this, and my attorneys have analyzed it, and we think that it actually does make sense. So, recommendation is to pass with text. Questions or concerns? Seeing none. Senator San Buenaventura.

  • Joy San Buenaventura

    Legislator

    [Roll Call]
