Clarifies the process and time frame by which a claimant may accept or reject a contractor's offer to settle and authorize repairs.

    So that is blank in this. In this version we are working off of the SD2. We adopted many of the corrections or, or this SD2 position from the comparison chart.     So we've adopted some of that language so that we can make sure that anyone who might be hired under I believe it's Act 209 will then be able to stay on and then it will carry over and transition with the Commission taking, becoming active following that and that person being able to stay on.

    So that language we adopted, we took the language from the AGs from salaries and expenses from their memo that was provided to us on that. Instead of the advisory board, we adopted the Senate's position for the State Fire Marshal Selection Commission.     Something that we had tasked the State Fire Marshal office to do, to a discretionary task. We move that into discretionary tax. Something else that got picked up in this that I have not had a chance to talk with you, Chair, but it's.

    It's partially in here, is that your draft created a special Fund that is similar to a special Fund that is moving in Senate Bill 223. In 223, it's called the Community Fuels Reduction Project and a Fund that was created there.

    And so the "caused solely by." And the important word is "solely." So if there's any other motivation, then you could still charge them, but I just wanted to have a narrow little carve out for people who are really desperately poor.

    ...recklessly cause serious bodily injury or substantially bodily injury to another person, and an actor has previously engaged in a pattern or practice of physically abusing the other person person, or knowingly subjects a minor or vulnerable person to a list of acts on three or more occasions within a period of two years.

    And that would be a class A felony. And it does not require proof of the victim suffered pain. And these acts can include depriving a minor or vulnerable person of necessary food, water or, clothing.

Largely, the first windshield tinting law was passed in the 1980s with Governor Ariyoshi. But I think one thing that was always left out was that there was something different for cars and the way that everything was treated.

    So this kind of just brings everything into conforming that the vehicles that are and classified as sedans can adopt the same requirements and what allows tinting on the rear windows.

    So just so we're clear, if you folks don't mind in indulging me just to clear what we're adopting to CD1 in the CD1, we are going to that no motor vehicle shall have tinting that does not meet the requirements of federal motor vehicle standards in effect with the conjunction of sunscreening devices.

    We are also prohibiting mirrored high reflective finishes that produce red, yellow, amber, blue appearances as viewed from the exterior motor of the vehicle. Also, this notwithstanding any subsection, all drivers and passengers of motor vehicles with applied tint on any vehicle shall fully roll down their windows when stopped by a law enforcement officer at a traffic stop.

    The subsection shall not apply to individuals unable to do so with physical disabilities. Mechanical failure provided the driver communicates or cooperates through other means available. A driver's passenger's failure to comply with the subsection may be cited as a non criminal traffic infraction.

    Also, we are adopting on in the section in Same section paragraph 8, sunscreen devices that are front windows and wing windows necessary driving ability that are adjacent to the driver necessary for driving that when used in conjunction with glazing material have a light transmittance of no less than 35% plus or minus 6%.

    In paragraph nine, adopting rear windows, including the rear windshield on sedans, vans, minivans, trucks, buses or other motor vehicles and side windows largely in the CD1, we are increasing the fines for non compliance from up from 250 to 300 and no more than 550, which is up from 500 and then for the violation of installers up from 500 to 700 and no more than 1200 from 1000.

    Also at that the Department of Transportation may adopt rules pursuant to Chapter 91 to establish standard criteria for visual references and enforcement of tint color reflectability and prohibitions and the absence of the certificate for safety check shall constitute evidence of installer non compliance.     For the purpose of this section, license plate flipping device means a manual, electric and mechanical device designed or adapted to install on a motor vehicle that switches between two or more license plates.     We'll also be adopting a part. Obstruction of a license plate is prohibited. The use of a cover shield installed on a vehicle's license plate, regardless of transparency or intent, shall be prohibited.     Each day of violation shall constitute a separate offense. For the purpose of this section, cover or shield means a device, material, film, weather, clear tinted, mirrored, reflective or otherwise installed.
