Hearings

Conference Committee

April 22, 2025
  • Unidentified Speaker

    Person

    Two, one.

  • Scot Matayoshi

    Legislator

    Threw me off.

  • Scot Matayoshi

    Legislator

Good afternoon, everyone. We are reconvening the Conference Committee for the 1:30 agenda. It is Tuesday, April 22nd, 2025, in conference room 224. First up on the agenda, we have HB70, HD, SD1 related to condominiums. On behalf of the House we have myself and Representative Todd as co-chairs, Representatives Iwamoto and Pierick as members.

  • Jarrett Keohokalole

    Legislator

Thank you. And on behalf of the Senate, myself, as chair, managers Fukunaga and McKelvey present.

  • Jarrett Keohokalole

    Legislator

    Thank you.

  • Jarrett Keohokalole

    Legislator

    Okay.

  • Scot Matayoshi

    Legislator

Why don't we roll this one 24 hours to April 23rd, 1:30 p.m. in conference room 224.

  • Scot Matayoshi

    Legislator

And for this one we. I believe we are in agreement. We are going to be putting back in the good faith exemption in there. We are working on a CD and we'll get back to you when we can.

  • Scot Matayoshi

    Legislator

Okay, next up we have HB—oh, I'm sorry. I didn't let you introduce your Senate.

  • Jarrett Keohokalole

    Legislator

No, we did. We can move on.

  • Scot Matayoshi

    Legislator

Next up, we have HB 544, HD 1, SD 1, related to pet insurance. On behalf of the House, we have myself as chair, Representatives Chun and Pierick as members.

  • Jarrett Keohokalole

    Legislator

And for the Senate, myself as chair, Rhoads, co-chair, Fukunaga, Richards, Awa managers.

  • Scot Matayoshi

    Legislator

Yeah. For this one, I believe we have agreement on a conference draft on CD 1.

  • Jarrett Keohokalole

    Legislator

    Yes.

  • Jarrett Keohokalole

    Legislator

All right, so we do not have quorum in our Committee so we can roll to end of calendar or.

  • Scot Matayoshi

    Legislator

Yeah, why don't we revisit this one at the end of the agenda or do you think...

  • Jarrett Keohokalole

    Legislator

Let's defer action till the end of the agenda.

  • Scot Matayoshi

    Legislator

    Okay, that sounds good. Okay.

  • Scot Matayoshi

    Legislator

All right, last house one. We've got HB 850, HD 1, SD 1, relating to condominiums. This is one for Condominium Association electronic meetings, electronic voting. On behalf of the House, we have myself as chair, Representatives Chun and Pierick as managers.

  • Jarrett Keohokalole

    Legislator

And for the Senate, myself as Chair, Senator McKelvey, Co-Chair, Fevella, Member.

  • Scot Matayoshi

    Legislator

Okay. And on this one, we do have an agreement to—we are rolling back the effective date for electronic voting, just that section, one year. The rest of the, the, the rest of the Bill will become effective on the regular effective date.

  • Jarrett Keohokalole

    Legislator

So, we actually need a day to re-review the CD on this one, if you could oblige.

  • Scot Matayoshi

    Legislator

Yeah, of course. So, roll it to 4-23, 1:30 agenda, in Conference Room 224.

  • Jarrett Keohokalole

    Legislator

Okay, next measure is Senate Bill 752, SD 1, HD 1, relating to insurance. On behalf of Senate, myself as Chair, McKelvey, Co-Chair, Fuknaga and Awa, managers.

  • Scot Matayoshi

    Legislator

On behalf of the House, we have myself as chair and Representatives Chun and Pierick as managers.

  • Jarrett Keohokalole

    Legislator

I believe we also are amenable to the House position on this measure. Are you in receipt of the CD? I think we may have.

  • Scot Matayoshi

    Legislator

I don't think I have the CD for this one. I know we were—we, we wanted to make a couple other changes. I wanted to make sure that in the CD, when we get it, that certified mail was taken out just to make sure A and B are consistent with each other.

  • Scot Matayoshi

    Legislator

I think that is why you don't have the CD.

  • Jarrett Keohokalole

    Legislator

Okay, so can we roll this to tomorrow?

  • Scot Matayoshi

    Legislator

    Yeah, let's roll it.

  • Jarrett Keohokalole

    Legislator

Okay. 1:30 PM in this room, 224.

  • Scot Matayoshi

    Legislator

Are you guys okay with the—or do you need to have to look at it? The certified mail portion taken out.

  • Jarrett Keohokalole

    Legislator

On this one, I think we are working on it. So, we should have it to you hopefully by tomorrow.

  • Scot Matayoshi

    Legislator

Okay. Just let me know if you need to discuss the certified mail portion of it at all. Okay, thank you.

  • Jarrett Keohokalole

    Legislator

And the last measure on this agenda is SB 1048 SD2 HD2 relating to solicitation of funds from the public. We have the Senate: myself as Chair, Rhoads Co-Chair, Awa Manager.

  • Scot Matayoshi

    Legislator

On behalf of the House, we have myself and Representative Takenouchi as Co-Chairs, Representatives Iwamoto and Pierick as Managers.

  • Jarrett Keohokalole

    Legislator

If you're okay, then we can vote once we fix the typo from the House.

  • Jarrett Keohokalole

    Legislator

Thank you for this. The Senate is prepared to adopt the House position - except we found a typo in the House position, so we need to fix that. And then,

  • Scot Matayoshi

    Legislator

You know, my Vice Chair should have caught these things, I'm sorry.

  • Scot Matayoshi

    Legislator

As long as you're agreeing to all of the House's wise changes, that sounds reasonable to me.

  • Jarrett Keohokalole

    Legislator

I mean the ones that are grammatically correct.

  • Jarrett Keohokalole

    Legislator

Can we roll to...stop there if we can roll to tomorrow, 1:30 as well. April 23rd and conference room 224.

  • Scot Matayoshi

    Legislator

    Achilles heel...

  • Scot Matayoshi

    Legislator

    Sounds good.

  • Jarrett Keohokalole

    Legislator

Okay, thank you. We'll adjourn this.

  • Jarrett Keohokalole

    Legislator

    Okay, welcome back.

  • Jarrett Keohokalole

    Legislator

Welcome back. This is our Tuesday, April 22nd, 1:30 PM agenda, in conference room 224. First up is SB 102, SD 2, HD 2, relating to restaurants. On behalf of the Senate, myself as chair, Rhoads, co-chair, and Fukunaga McKelvey, Awa, managers.

  • Scot Matayoshi

    Legislator

On behalf of the House, we have myself and Representative Ta as co-chair and Representative Pierick as manager.

  • Jarrett Keohokalole

    Legislator

So, I believe we have agreement on the substance of the—we're sending you an updated CD 1 that you can review and then, we do need you to approve that updated CD.

  • Scot Matayoshi

    Legislator

There is one area that I spoke to Representative Hashimoto, the removal of the indemnity language. I'm not sure if we want to remove the indemnity language. It's basically preventing these third parties from requiring the restaurants to indemnify them.

  • Scot Matayoshi

    Legislator

I feel like that might weaken the Bill and the purpose of the Bill, but I'm taking another look at it to see whether it will or not. The other states that—a lot of the other states that have passed it don't have that. So, maybe not, but I don't know. Do you have any thoughts on?

  • Jarrett Keohokalole

    Legislator

We are amenable to that. Okay suggestion.

  • Scot Matayoshi

    Legislator

So, for putting it back in or, or to take it out, I mean?

  • Jarrett Keohokalole

    Legislator

    For putting it back in.

  • Scot Matayoshi

    Legislator

Okay. Okay. Yeah. Let me, let me, let me think about it a little more. Can I roll this one?

  • Jarrett Keohokalole

    Legislator

    Tomorrow.

  • Jarrett Keohokalole

    Legislator

    Let's go 1:31.

  • Scot Matayoshi

    Legislator

    Okay.

  • Jarrett Keohokalole

    Legislator

Okay. Tomorrow, April 23rd, 1:31pm In Conference Room 224. Sounds. Okay. Here we go. Next measure is SB 385, relating to condominiums. On behalf of the Senate, myself is Chair, McKelvey Co-Chair, Awa Manager.

  • Scot Matayoshi

    Legislator

Behalf of the House, we have myself as Chair, Representatives Chun, Iwamoto and Pierick as Managers.

  • Jarrett Keohokalole

    Legislator

Okay, this one...we like your changes. We're ready to vote.

  • Scot Matayoshi

    Legislator

Okay, so just agreeing to House position.

  • Jarrett Keohokalole

    Legislator

    Yes.

  • Jarrett Keohokalole

    Legislator

    ...effective date upon approval.

  • Scot Matayoshi

    Legislator

    Effective date...

  • Scot Matayoshi

    Legislator

Okay, is that...do we need a CD1 for it then, or is it just....

  • Jarrett Keohokalole

    Legislator

I believe we have a CD1 ready. If you're not in possession of it, we can vote for tomorrow if you'd like.

  • Scot Matayoshi

    Legislator

No, if you're in the favor of the House position with a clean date, then just upon approval, then I think that's fine.

  • Jarrett Keohokalole

    Legislator

Okay, let's vote. I don't have vote sheets, quick recess.

  • Jarrett Keohokalole

    Legislator

Okay, reconvening on this 1:30 p.m. Joint Agenda. Tuesday, April 22nd, 2025 in Conference Room 224, we are prepared to vote on SB 385 SD1 HD1 CD1. Recommendation is to pass with amendments. Chair goes aye. Co-Chair McKelvey?

  • Angus McKelvey

    Legislator

    Yes, aye.

  • Jarrett Keohokalole

    Legislator

Manager Awa is excused. May I take the vote on behalf of the House?

  • Scot Matayoshi

    Legislator

    Yes, please.

  • Jarrett Keohokalole

    Legislator

    Chair Matayoshi?

  • Scot Matayoshi

    Legislator

    Aye.

  • Jarrett Keohokalole

    Legislator

    Representative Chun.

  • Cory Chun

    Legislator

    Aye.

  • Jarrett Keohokalole

    Legislator

We have a Bill. Thank you very much.

  • Scot Matayoshi

    Legislator

    Thank you.

  • Jarrett Keohokalole

Thank you. This one, I believe is the one that we do have agreement on the CD. There is an appropriation that we need...

  • Scot Matayoshi

    Legislator

    I believe...

  • Jarrett Keohokalole

    Legislator

    approval on.

  • Scot Matayoshi

    Legislator

...I believe we're. We have. Yeah, that sounds right. We're still waiting for money release.

  • Jarrett Keohokalole

    Legislator

Okay, can we defer action on this until tomorrow at 1:31 p.m.?

  • Scot Matayoshi

    Legislator

    1:31 p.m., April 23rd in 224.

  • Jarrett Keohokalole

    Legislator

    In 224, yes. Thank you.

  • Jarrett Keohokalole

    Legislator

Okay, last bill. Housekeeping bill next. SB 1044, SD 2, HD 2, relating to the stabilization of property insurance. On behalf of the Senate, myself as Chair, Moriwaki Co-Chair, Fukunaga, excuse me, McKelvey, Awa Managers.

    Legislator

Okay, thank you for your work on this. We are drafting a CD that is not ready yet. So can we defer action on this measure until tomorrow, April 23rd, at 1:31pm in this room 224? Okay, great. We're still drafting a CD. We're fundamentally in agreement. The measure does need appropriation approval. Yes. 131. And that's it. We'll adjourn this agenda.

Thank you, Senator. On behalf of the House, myself, Representatives Chun, and Keohokapu-Lee Loy as Co-Chairs and Representative Alcos as Manager. I believe we are awaiting FIN and WAM clearance. Even though the money, there is no actual request.

  • Carol Fukunaga

    Legislator

However, it's safely in HB 300 I understand. So can we roll over to tomorrow afternoon at 1:40?

  • Gregg Takayama

    Legislator

So same time tomorrow. Thank you, Chair.

  • Carol Fukunaga

    Legislator

Okay, thank you. Second measure is Senate Bill 1373, relating to administrative licensure actions. Oh, location, sorry. In Conference Room 224, for Senate Bill 1373, Senate Draft 2, House Draft 2, relating to administrative licensure actions against sex offenders. On behalf of the Senate, myself as chair, Senator San Buenaventura as co-chair and member Awa.

  • Cory Chun

    Legislator

Thank you, Senator. On behalf of the House, myself and Rep. Perruso as chair, co-chairs, and Representative Pierick as manager.

  • Carol Fukunaga

    Legislator

Okay. I believe we have circulated a proposed CD 1 to everyone electronically. We do have hard copies which we can distribute and if those are acceptable, we'd like to defer action to tomorrow at 1:40 PM, as well.

  • Cory Chun

    Legislator

    Yes, thank you for that.

  • Carol Fukunaga

  • Scot Matayoshi

    Legislator

So we are still working on a CD1. We're also going to clarify the sunset language a little bit to make sure that everything's square. But we'll get that over to you soon for your review. Can we roll this one day, 24 hours to 2:30 p.m. August - oops, August. I'm doing it. April. April...

  • Scot Matayoshi

    Legislator

Whoa. Special session. Special session. Okay. April 23rd, 2:30, Room 224. Thank you. All right, next up we've got HB 1052, HD 1, SD 2, relating to the Universal Service Program. This is for telecommunications access. On behalf of the House, we have myself and Rep Takenouchi as Co-Chairs, Representatives Iwamoto and Pierick as Managers.

  • Carol Fukunaga

    Legislator

Okay. I'm so sorry, I haven't seen any material. Are you...

  • Scot Matayoshi

    Legislator

Oh, here. Here's a CD 1. But yeah, we're gonna... For your perusal. But yeah, why don't we roll it a day.

  • Carol Fukunaga

    Legislator

    Okay. Thank you.

  • Scot Matayoshi

    Legislator

Okay, so April 23rd, 2:30pm, Conference Room 224.

  • Carol Fukunaga

    Legislator

    Thank you.

  • Unidentified Speaker

    Person

Okay, and then last up we've got HB 1055 HD1SD1 making an emergency appropriation to the public. Public Utilities Commission. Well, it's right there in the title. House conferees. We have myself and Rep. Takenouchi as Co-Chairs and Rep. Pierick as a manager.

  • Jarrett Keohokalole

    Legislator

And on behalf of the Senate, myself, Vice Chair Senators Wakayan Aquino, co chairs Richards and O O O Members. Someone wrote that Fukunaga is. Zero, it might be changing. I don't know.

  • Unidentified Speaker

    Person

Anyway, I'm on the notice. No, no. Fin Wham. So roll it. Yes, please. Okay. April 23rd, 2:30pm Conference room 224. Thank you.

  • Unidentified Speaker

    Person

Okay, I believe that's the last bill. Yep. Yep. We are drained.

  • Carol Fukunaga

    Legislator

Good afternoon. Convening the conference on Senate Bill 332, Senate Draft , House Draft 3, relating to foreclosures. Today is Tuesday April 22nd. It's 3:20 PM in Conference Room 224. And on behalf of the Senate, myself as chair, Senator Chang as co-chair, and Senator McKelvey as a member.

  • Matthias Kusch

    Legislator

On behalf of the House, we have myself and Representatives Chun and Poepoe as co-chairs, and Representative Grandinetti and Muraoka as managers.

  • Carol Fukunaga

    Legislator

Yes. We'd like to propose that we defer one day. We had a imminent change in leadership on this Committee, which we just learned about five minutes ago. So, we'd appreciate the additional time.

  • Matthias Kusch

    Legislator

No problem at all, given the circumstances.

  • Carol Fukunaga

    Legislator

Okay. Can we roll it to tomorrow at 3:20 PM as well, in conference room 224?

  • Matthias Kusch

    Legislator

    Works perfect with us. Yep.

  • Matthias Kusch

    Legislator

    Thank you.

  • Carol Fukunaga

    Legislator

    Thank you so much. Aloha.

  • Greggor Ilagan

    Legislator

Good morning. We are—good afternoon. Thank you. Good afternoon. Here we are April 22nd, Tuesday, at 3:24. And we are conference room 224. At this moment, we have conferees chair Ilagan, co-chair Chun, and chair?

  • Jarrett Keohokalole

    Legislator

And this is for House Bill 1370. Right. On behalf of the Senate, myself as Chair, Wakai Co-Chair, Awa Member.

  • Greggor Ilagan

    Legislator

We have a CD 1, and we're still waiting for FIN release. Would you mind if we recess this till same place, same room, same time?

  • Jarrett Keohokalole

    Legislator

Okay. When would you... What's your pleasure?

  • Greggor Ilagan

    Legislator

    Wednesday, 3:20, Room 224.

  • Jarrett Keohokalole

    Legislator

Okay. Tomorrow, the 23rd, at 3:20. Thank you.

  • Greggor Ilagan

    Legislator

All right. Thank you. We're now recess.

  • Andrew Garrett

    Legislator

Right now convening a conference Committee meeting on again a series of higher education bills. Today is Tuesday April 22nd. It is 1:32 p.m. we are in Conference Room 229 at the state capital. Senator Day 2 of 5. Let's see. Up first we have House Bill 3 HD 2 SD 1.

  • Andrew Garrett

    Legislator

So this bill is relating to beach management on the North Shore of Oahu. For the House. I have myself, Rep. Hashem and Lamosa as co chairs and Member Shimizu for.

  • Donna Kim

    Legislator

The Senate you just have me. That's all we need.

  • Andrew Garrett

    Legislator

So for this one we did circulate a CD one for your consideration. Essentially just cleaning the effective date. Yes. Would you be amenable to that? Yes. Okay, great. So this one does not have an appropriation. It just extends the deadline for SEA grant to conduct this management study for the North Shore area.

  • Andrew Garrett

    Legislator

So we have circulated this for bin release but have not received it yet. Can we defer? This is tomorrow. Okay. You know right now we have a. Well right now we have a 3 p.m. and a 3:20 p.m. agenda. Do you want to split the difference at 3:10 for some others? 3:10.

  • Andrew Garrett

    Legislator

Okay, so we'll defer House Bill 3, HD 2, SD 1, till Wednesday 4/23, at 3:10 PM, in this room. And we'll hope that we have the money Committee's clearance by them. Okay, thank you. Up next, we have House Bill 442, HD 1, SD 1.

  • Andrew Garrett

    Legislator

This is relating to the University of Hawaii. For the House, myself and Rep. Holt as co-chairs, Members Miyake, Sayama, and Souza. Okay, so, okay, so this Bill I introduced earlier this session to essentially just fund the, the delta between what the Board of Regents approved for various nursing programs and what made the Governor's Budget.

  • Andrew Garrett

    Legislator

So, right now, we are preparing a CD 1 for your consideration, Senator, that would specify the amounts, as well as a clean date. So, just for your edification, this would fund several nursing related programs within the UH system. $447,936 for FY '25-'26 and FY '26-'27 for UH Manoa an UH West Oahu's Nursing Collaboration Phase 3.

  • Andrew Garrett

    Legislator

$111,984 for FY '25-'26 and FY '26-'27 for UHM online RN to BS program. 424—$364 for FY '25-'26 and FY '26-'27 for UH West Oahu's Pre Nursing Pathway. And then lastly, $297,500 for FY '25-'26 and $595,000 for FY '26-'27 for UH Hilos to increase its school's nursing cohort size.

  • Andrew Garrett

    Legislator

So, again, we will—we're working on a CD 1 for that, and we'll hope to have it to you shortly. Can we also defer this till 3:10 tomorrow? Do you have any comments on this Bill, Senator?

  • Donna Kim

    Legislator

Yes, we need some adjustments in the budget.

  • Andrew Garrett

    Legislator

    Okay.

  • Andrew Garrett

    Legislator

Okay, thank you. 3:10 tomorrow, yes, in this room. And we'll make sure we're not overlapping with the budget that was passed to see if there's any monies in there.

  • Andrew Garrett

    Legislator

Okay. Up next is House Bill 549 HD3 SD1 relating to an early learning apprenticeship grant program. For the House, myself and Reps. Martin and Holt as Co-Chairs, Members Amato and Souza.

  • Donna Kim

    Legislator

Senate, myself as Chair, Kidani and Kanuha as Co-Chairs, and DeCorte as Member.

  • Andrew Garrett

    Legislator

Okay, thank you, Senators. So for this Bill, I mean you know, having a background in HR, I do feel like the apprenticeship model is fairly underutilized. And you know, as many facilities as we build, that's only half the equation. You know, we do have to factor in workforce needs for early learning.

  • Andrew Garrett

    Legislator

For this Bill, the fiscal impact was fairly high in terms of the grants that would be administered by the UH's College of Education. I believe over the fiscal biennium we're looking at approximately 6.25 million per year.

  • Andrew Garrett

    Legislator

So I just need to consult with the Finance Committee in light of the budget closing yesterday, if this is something that we could still fund as a standalone item. So this one, it might take a little bit of time. So can we defer this one till Thursday?

  • Andrew Garrett

    Legislator

Okay, so I believe we have a 1:30 slot targeted for Thursday. Yes, I'm getting the thumbs up over there. So that'll be Thursday, April 24th at 1:30 p.m. in this room 229.

  • Donna Kim

    Legislator

    [Inaudible]

  • Andrew Garrett

    Legislator

Thank you Senator. The last House Bill on our agenda for the 1:30 agenda is House Bill 1300 HD1 SD1 relating to cancer.

  • Andrew Garrett

    Legislator

For the House, myself, Rep. Keohokapu Lee-Loy as co Chairs and Member Alcos.

  • Donna Kim

    Legislator

Can we roll this one over also to Thursday?

  • Andrew Garrett

    Legislator

Yes, at 1:30. Okay. Okay, so with that I'll turn it over to you. For the two Senate bills.

  • Donna Kim

    Legislator

Relating to dementia. I forget what was the. For the Senate myself here, Akino as number.

  • Andrew Garrett

    Legislator

Okay. And for the House, myself and Poultice co chairs, Members La Chica, Miyake and Souza.

  • Donna Kim

    Legislator

I'm working on language in. In the draft, the show language to the Draft.

  • Andrew Garrett

    Legislator

    Okay.

  • Donna Kim

    Legislator

Okay, so can you put also this one on Thursday?

  • Andrew Garrett

    Legislator

  • Donna Kim

    Legislator

Final Bill is Senate Bill 162. The conferees is myself, Hashimoto as co-chair, and Fevella as member.

  • Andrew Garrett

    Legislator

Okay. And for the House, myself and Rep. Holt as co-chairs, members Amato, Lamosao, and Souza.

  • Donna Kim

    Legislator

This one also we are working—been in contact with the University and so, we are working on a conference draft, and I will try to get that to you...

  • Andrew Garrett

    Legislator

Okay, that sounds good. So, SB 1502, to Thursday 4/24 at 1:30 PM. So, I guess we're adjourned with that one and we have to sit tight for five minutes for the next one. Thank you, Senator.

  • Andrew Garrett

    Legislator

Right now, reconvening Conference Committee on a series of House and—House bills and a Senate Bill that we initially heard yesterday.

  • Andrew Garrett

    Legislator

Today is Tuesday, April 22, 2025. It is 1:46 p.m. in Conference Room 229 Center. If we can just get right into it. House Bill 1169 HD1SD2 relating to the University of Hawaii Conference center revolving Fund. For this Bill as well as well as the next two. We did not receive fin release yet.

  • Andrew Garrett

    Legislator

So for this one would you be. I'm hoping to get it by the end of the day today, early tomorrow. You want to just do it the Thursday then or do you want to roll the dice and try for tomorrow? I know that the non appropriation stuff is supposed to get fast tracked but your.

  • Andrew Garrett

    Legislator

Okay, Thursday it is. Okay, let's play it safe. Let's go. Thanks. We just stop all the gambling.

  • Andrew Garrett

    Legislator

Yeah, yeah, I just gave a speech against that. Okay, let's do Thursday just to play safe at 1:30. Would that work? Okay, thank you. Okay, so House Bill 1169 HD1 SD2 Thursday 424 at 1:30 in this room. Okay. Hospital 1170. Oh, I'm sorry, I didn't say. Do I need to say who the conferees are? I guess I should.

  • Andrew Garrett

    Legislator

So I'm sorry. HB 1169 HD1 SD2 for the house, myself and Rep Holt as co Chairs and Members Amato and Muraoka. Okay, so again 1169 we deferred till Thursday. Hospital 1170 HD1SD1 relating to the University of Hawaii resident tuition fee for the house, myself and Rep Holt's co chairs Members Amato and Muraoka.

  • Andrew Garrett

    Legislator

I did it kind of backwards. No, no, but that was for. Yeah, I think they're actually the same for the three. Okay, again waiting on release for this one. So can we defer this till Thursday, April 24th at 1:30 p.m.? Okay, thank you. Next bill.

  • Andrew Garrett

    Legislator

House Bill 1171 HT2SD1 relating to the University of Hawaii relief funding for the House, myself and Repultos co chairs Members Amato and Muraoka. I should have just said that. That's why I'm the rookie here. Okay, may we also defer this till Thursday, April 24th at 1:30 p.m. thank you. Okay.

  • Andrew Garrett

    Legislator

Hospital 718 HD1 SD1 relating to positions at the John Abraham School of Medicine for the House, myself and Rep. Holt as co Chairs Members Miyake, Sayama and Souza. Okay, so for this bill we did circulate a CD one for your consideration. So we did include the appropriation amount.

  • Andrew Garrett

    Legislator

It was a total of 763,000 in each fiscal year for a total of 4.0 FTEs as well with a clean effective date. So hoping we can circulate this for money approval or money Committee approval. I believe that was a rhetorical question. So.

  • Donna Kim

    Legislator

For the people here. Yes. Okay, so we are rolling that one over.

  • Andrew Garrett

    Legislator

Yes. Should we try Thursday as well? I know that agenda is getting kind of full.

  • Brandon Elefante

    Legislator

And great afternoon, Chair on behalf of the Senate is Senators Elefante as Chair. Co Chair, Senator Hashimoto, Senators Wakai, and Decorte are Members.

  • Della Au Belatti

    Legislator

Chair we have. We're working on a proposed draft Conference draft. The intent is to remove budget and finance from the reporting process and ask that Department of Defense, Administrator of Hyema and the Governor's Office be the reporting entities to the Legislature.

  • Della Au Belatti

    Legislator

If you would indulge us, I will have that draft done and hopefully have something to pass across to you tomorrow.

  • Brandon Elefante

    Legislator

Okay. Yeah, that works for us. You want to reconvene on this?

  • Della Au Belatti

    Legislator

Yes, if we can reconvene Tomorrow, same time, 1:30 p.m. in this room, Wednesday, April 231:30.

  • Brandon Elefante

    Legislator

And room 16. Yep, that works for us.

  • Della Au Belatti

    Legislator

All right, we are adjourned. Recess.

  • Brandon Elefante

    Legislator

    Adjourned.

  • Della Au Belatti

    Legislator

    Adjourned. We are adjourned.

  • Della Au Belatti

    Legislator

Good afternoon. Opening our Conference Committee meeting here on Tuesday, April 22, 2025, 1:45pm in Conference Room 16 for House Bill 1064, House Draft 2, Senate Draft 2. For the House, we have myself as Co-Chair, along with Chairs Tarnas and Lamosao, and Members Ichiyama and Souza.

  • Brandon Elefante

    Legislator

And on behalf of the Senate, Senator Elefante as Chair. Co-Chairs are Senator Aquino, Lee. That's Chris Lee. Rhoads, and Members Wakai and DeCorte.

  • Della Au Belatti

    Legislator

Thank you, Senator, for opening up on this conference. We don't have a House Draft for this very important bill concerning State Fire Marshal, as well as state mitigation, state wildfire preventions. And I have to apologize. When I completed the comparison sheet, there were a lot of moving pieces and some mistakes. So what I'd like to pass across to you for you and your Members is a corrected comparison sheet.

  • Della Au Belatti

    Legislator

If we're able to, we'll place it on the computer systems. But I did want to give you a hard copy of this. So, based on this comparison sheet, there really are three major policy questions that we're trying to answer. First is the placement of the Office of the State Fire Marshal, whether it should be in the Department of Law Enforcement or within the Office of the Governor.

  • Della Au Belatti

    Legislator

The second big policy question is whether or not we should have a selection process whereby... Your position, Senator, is the creation of a State Fire Marshal Selection Commission whose members would be selected in part by advice and consent by the Senate. Our position on the House is to have an advisory board.

  • Della Au Belatti

    Legislator

The third major policy area that we have to resolve is whether or not there's going to be the creation of a community risk special reduction fund. So with these pieces in motion, what I'd like to propose is I need to go talk back, go and speak with various Members in my committee. And if I could propose, I hope to have a draft to be able to propose to you tomorrow. Is that fine?

  • Brandon Elefante

    Legislator

    Yep, that works for us.

  • Della Au Belatti

    Legislator

So if we could reconvene this conference and roll it over to the 1:30pm slot on Wednesday, April 23, 2025 in the same room, that would be something that we could notice right away.

  • Brandon Elefante

    Legislator

Yep, that works for us. We'll see you then.

  • Della Au Belatti

    Legislator

See you then. We are adjourned.

  • Jackson Sayama

    Legislator

I am convening this joint conference Committee hearing. It is Tuesday, April 22, 2025. 3 p.m. we're in Conference Room 16 opening on HB 806 HD1SD2. Relating to fireworks for house conferees. We have myself, Rep. Todd and Lee as co Chairs, Garrett, Souza as managers. Thank you.

    Legislator

And on behalf of the Senate is Senator Elefante as Chair. Co chairs are Rhodes and Kim and Members Wakai and Favella.

  • Jackson Sayama

    Legislator

Thank you. So we are currently working on a CD for this. We'll be getting that to you shortly and then we could proceed with fin Wham approval from there. Okay, that sounds good. • Jackson Sayama

    Legislator

    We are adjourned.

  • Brandon Elefante

  • Lisa Marten

    Legislator

  • Troy Hashimoto

    Legislator

Yep, we're ready to go. I think we appreciated your draft. And no further amendments at this time.

  • Lisa Marten

    Legislator

Okay. This is my first one I'm voting on, so please bear with me. If I remember how this goes. I haven't heard it yet this session, so I am recommending that we pass the proposed CD1 that we've both seen. And I believe it just gives an effective date. I think that's the only change. Is that right?

  • Lisa Marten

    Legislator

Can you check for me so I don't make a mistake?

  • Troy Hashimoto

    Legislator

    Yep, I believe that's correct.

  • Lisa Marten

    Legislator

Okay. All right, so that is my recommendation and I will vote yes. [Roll Call]

  • Troy Hashimoto

    Legislator

Yeah, sorry, real quick, can we. Can we take a quick recess?

  • Lisa Marten

    Legislator

Yes, we can. We are voting on HB 1098 HD1 SD1 Conference Draft 1 which only changed the date, made a real date. And Chair Tarnas. Yes. Okay, thank you very much. All right, we have a Bill.

  • Troy Hashimoto

    Legislator

Great. Thank you. Thank you. Thank you. Thank you. Thanks for being here.

  • Lisa Marten

    Legislator

We just needed to sign. Yes. So you want to. Want to go back so we can. Vote on that one? That's the only one that we're going to be able to vote on.

  • David Tarnas

    Legislator

No, no, I just need Senator Fevella to go next door with me. Oh, okay. Yeah. Convenient.

  • Lisa Marten

    Legislator

    Convenient.

  • Troy Hashimoto

    Legislator

    Sorry to keep you waiting.

  • Lisa Marten

    Legislator

And all right, next up we have HB 280, HD 3, SD 1, relating to the Community Outreach Court. We have myself and Tarnas as Chairs, Morikawa also as Chair, and then Co-Chairs Olds and Garcia.

  • Karl Rhoads

    Legislator

Thank you. For the Senate, myself as Chair, Senator Moriwaki Co-Chair, and Fevella as manager.

  • Lisa Marten

    Legislator

And I believe we have agreement on the content, but we do not have release.

  • Karl Rhoads

    Legislator

We don't have the... We don't have the proposal. I mean, I know it's just the date.

  • Lisa Marten

    Legislator

Oh yeah, it's just a... Yeah. The language is fine. It's just to make it a real date.

  • Karl Rhoads

    Legislator

For our request to Ways and Means, we need the proposed... Oh, we do have them. Okay, I'm sorry. I stand corrected. We just got it, and we will make our request to WAM. But we don't have WAM of sign off yet.

  • Lisa Marten

    Legislator

Yeah, my apologies. Okay. So can we roll this over? When would you like to roll it to?

  • Karl Rhoads

    Legislator

    When are your other agendas?

  • Lisa Marten

    Legislator

We can do it tomorrow. We can do it the day after. Same time, same place. And I don't know how long it will take them to process it. I don't want to make you...

  • Karl Rhoads

    Legislator

I don't know. Let's go ahead and do it tomorrow if that's okay with you.

  • Lisa Marten

    Legislator

Okay. Okay. So we will reconvene on this one Wednesday, April 22nd, 1:30pm, Conference Room 329. 23rd as I meant to say. Yep.

  • Karl Rhoads

    Legislator

At 1:30 in this room, 329. Okay. Okay.

  • Lisa Marten

    Legislator

That is for 280. Okay. Okay. And next up, we have HB874, HD3, SD2 relating to child performers. And on the House side, we have myself, Sayama, and Marioshi as chairs. And we have Chun, Lee, and Garcia as members, co-chairs.

  • Henry Aquino

    Legislator

Thank you very much, Chair. Senate confrees are myself as chair, Senators Rhoads and Keohokalole as co-chairs, and manager Fevella.

  • Lisa Marten

    Legislator

And so we are. I believe this one just needed a real date, and we are fine with the Senate draft. So, do we have agreement on this one? Are we able to vote?

  • Henry Aquino

    Legislator

Yes. Would like the introducer like to mention anything regarding this bill?

  • Lisa Marten

    Legislator

So the only thing we did to change it in the proposed conference draft is that it takes effect upon approval. So if we're in agreement.

  • Lisa Marten

    Legislator

    Yes.

  • Lisa Marten

    Legislator

    Yes.

  • Lisa Marten

    Legislator

We have enough people to vote.

  • Lisa Marten

    Legislator

On the House side, we do have our, we don't have Matayoshi, but we have a majority because we have you and I.

  • Lisa Marten

    Legislator

Okay, so we should be good. So, Senator, is it okay if I take the vote?

  • Lisa Marten

    Legislator

Matayoshi is excused. Chun is excused. Representative Lee?

  • Lisa Marten

    Legislator

Okay, so I propose to adopt the conference draft that both sides have seen. That is basically the same language as the SD2, but with the effective date upon approval. And with that, I vote aye. Sayama?

  • Lisa Marten

    Legislator

Thank you very much. May you take the vote for the second?

  • Mike Lee

    Legislator

    Aye.

  • Lisa Marten

    Legislator

    And Representative Garcia?

  • Jackson Sayama

    Legislator

    Aye.

  • Henry Aquino

    Legislator

    Yes, please.

  • Diamond Garcia

    Legislator

    Aye.

  • Lisa Marten

    Legislator

    Chair Rhoads.

  • Karl Rhoads

    Legislator

    Aye.

  • Lisa Marten

    Legislator

Mike, is this your first one? Okay, great.

  • Lisa Marten

    Legislator

All right, next up we have HB 713, HD 1, SD 1, relating to a rate study for home health services. House conferees are myself and Morikawa, Co-Chairs Amato, Olds, Garcia.

  • Henry Aquino

    Legislator

Okay, thank you very much, Chair. Senate conferees are myself as Chair, Senator Moriwaki as Co-Chair, and managers Hashimoto and Fevella.

  • Lisa Marten

    Legislator

And I think we have agreement. We are fine with the SD 1. Just needed to add in the appropriation and a clean date. But we do not have release from Finance. Am I accurate in understanding that? Otherwise we have agreement?

  • Henry Aquino

    Legislator

Yes. We'd like to see the conference draft, if possible.

  • Lisa Marten

    Legislator

Okay, here it is. Sorry that you didn't have it when you should have had it.

  • Henry Aquino

    Legislator

Yeah. No, but thank you very much. So we'll review and then like to request for us to reconvene.

  • Lisa Marten

    Legislator

Yeah. So would you like to do that same place, same time tomorrow or the next day after that?

  • Henry Aquino

    Legislator

    We could do Thursday.

We have come to an agreement, effective date upon approval. And I have received release from Finn to vote on this measure.

  • Karl Rhoads

    Legislator

On this one. Can we just roll this until the end of our agendas and then we'll revisit it and see if we've got. We don't have release formally and I have to have my co chair to vote anyway. So if we could just roll it and sure. Move on to the other agendas. So.

  • David Tarnas

    Legislator

Yes, that's fine. We can stick around. Let's move this to the end of the agenda.

  • Karl Rhoads

    Legislator

Okay, great. Thank you. Next up is HB 369. This is relating to campaign spinning cash contributions. On HB 369, it's myself as chair, co-chair Hashimoto, and manager Fevella.

  • Unidentified Speaker

    Person

  • David Tarnas

    Legislator

Did we send a CD 1 to them?

Thank you. We have prepared a CD 1, and we have shared it with you. We based it on the information we received from the Attorney General. We did make some corrections in the case numbers and the names, which were incorrect in the Attorney General's memo. So we've corrected that. All the dollar amounts are correct, but... So we've sent that to you. We have initiated the process to get Fin approval, but we have not yet received it.

  • David Tarnas

    Legislator

So, if it's okay with you, I'd like to reconvene on this tomorrow at 2:15 PM, Wednesday, April 23rd, in room 325. Okay, thank you. There being no further business on this agenda.

  • David Tarnas

    Legislator

Thank you. On this measure, we've sent you a proposed CD1. I appreciate you considering it. I understand that you're looking at making some slight adjustments to it. So we look forward to hearing back from you and hopefully coming to some agreement. And we would prepare a revised proposed CD1 based on your input.

  • David Tarnas

    Legislator

So if it's okay with you, I'd like to roll this to tomorrow at our 2:15pm agenda, Wednesday, April 23rd, room 325. Okay, thank you. Next, House Bill 134, House Draft 1, Senate Draft 1, relating to elections. On behalf of the House, we have Tarnas and Kitagawa as Co-Chairs, Matsumoto as Member.

  • Karl Rhoads

    Legislator

For the Senate, myself as Chair, Co-Chair Kim, and Manager Fevella.

  • David Tarnas

    Legislator

Thank you. On this measure, we have requested FIN release based on our CD 1 that we've discussed. We do have... We've corrected the CD 1 so that it's got the January 1st, 2028 date on it and then 150,000 in aid funds. So we've used that to initiate the process to request FIN release, and we're still awaiting that release.

  • Karl Rhoads

    Legislator

Yes, I don't believe that we have WAM release either. So yeah, let's go ahead and roll this.

  • David Tarnas

    Legislator

So let's go ahead and reconvene on this measure to Tomorrow at our 2:15pm agenda, Wednesday April 23rd in room 325. Thank you. Okay, let's move to the next measure. • Karl Rhoads

    Legislator

As Member for the Senate, myself as Chair, Hashimoto Co Chair and Fevella Manager.

  • David Tarnas

    Legislator

Thank you. On this. We have prepared a conference draft one and I think we just made some slight adjustments to it and we've sent that. So we did make some slight adjustments to it based on conversation between the two of us and also with the Office of or with the Campaign Spending Commission.

  • David Tarnas

    Legislator

We've sent that to you and then we've begun the process of requesting release on this. But we have not yet received fin release.

  • Karl Rhoads

    Legislator

Okay. Because it wasn't clear to us that if we read your draft correctly, it wasn't clear whether the change that you made would result in a higher cost overall.

  • David Tarnas

    Legislator

In speaking with the campaign spending Commission, the additional change that we made, which would be to increase the individual candidates expenditure limits. If there was. If there was participation in every race in both elections, it would require more funds than is being appropriated in this measure. Historically, there has never been.

  • Karl Rhoads

    Legislator

Okay, so basically they're saying that it's enough to run the program even with that change.

  • David Tarnas

    Legislator

That's my. Yes, that's my determination is that we would move forward with the appropriation that we have, but we would increase the expenditure limit for each candidate. And if they end up having participation in every race, well, we'll be surprised. And then they'll run out of money.

  • Karl Rhoads

    Legislator

I think they have a mechanism for dealing with that already.

  • David Tarnas

    Legislator

That could happen now. Yeah. Yes. And that could happen right now as well. So I didn't want to risk asking for more funds because I really would like to get this thing through.

  • Karl Rhoads

    Legislator

    Okay.

  • David Tarnas

    Legislator

So that's my cons. That's. That's my proposal to you.

  • Karl Rhoads

    Legislator

Okay, Can. Can we just go ahead and roll it till tomorrow?

  • David Tarnas

    Legislator

Yes, please. Let's do that. Thank you for your consideration on that. Let's reconvene on House Bill 370 tomorrow, 2:15 p.m. Wednesday, April 23, here in room 325.

  • Karl Rhoads

    Legislator

Thanks. I'll just add one more note on that. I don't believe I'll have any trouble with that. So we'll probably coordinate with you. Make the ask to the. To Chair Yasha and Chair. Yes, this afternoon sometime.

  • David Tarnas

    Legislator

I'd be happy to sign that memo for you.

  • David Tarnas

  • David Tarnas

    Legislator

Thank you. We have proposed Conference Draft 1 at the $50 level with an appropriation of $684,385 per fiscal year, effective date July 1, 2025. Thanks. For 396, I'm the chair and Moriwaki's co-chair, and Awa's manager.

  • David Tarnas

    Legislator

Thank you. On this measure, our proposed CD 1 includes an appropriation request, 2.89 million in FY '25-'26 and the same in FY '26-'27, effective date July 1, 2025. • Karl Rhoads

    Legislator

Chair, I think your finance chair is here for 1001. Did you want to skip forward to that so he can do whatever he needs to do? Is that acceptable?

  • David Tarnas

    Legislator

Yes, we do want to do that, but do you have, do you have quorum on your side?

  • Karl Rhoads

    Legislator

    Oh, that's a good point. No, I don't. I'm sorry, Kyle. I tried.

  • David Tarnas

    Legislator

Okay, so no, we're going to vote as soon as they get quorum, so if you could stay momentarily.

  • David Tarnas

    Legislator

No, I, I, I—we're trying to move as quickly as we can. Oh, we got, so we, you have.

  • Karl Rhoads

    Legislator

We don't actually need...we need Wakai.

  • David Tarnas

    Legislator

    They need another one.

  • Della Au Belatti

    Legislator

Oh, they need one more. They need quorum.

  • Karl Rhoads

    Legislator

Okay, go ahead. I'm sorry, I tried.

  • David Tarnas

    Legislator

No, that was good. You tried. Oh, here he is. Here's Wakai. Here's Wakai. Ah, take a bow. Take a bow. Okay, let's go back to—or not go back. Let's go to the end of the agenda today to take up take up House Bill—thank you, Senator Elefante, for your patience.

  • David Tarnas

  • David Tarnas

    Legislator

Thank you. So, we have circulated a conference draft on this. We have agreement and we have release from Finance Committee to vote on this. Do you have release from Ways and Means to vote on this?

  • Karl Rhoads

    Legislator

    I believe so. No. Maybe.

  • Karl Rhoads

    Legislator

Did you want to, because it's an important bill, did you want to describe it a little more fully?

  • David Tarnas

    Legislator

Oh, I will absolutely do that.

  • Karl Rhoads

    Legislator

Or if you want me to, I can.

  • David Tarnas

    Legislator

No, it's a House Bill. That's my responsibility. So, this measure is an essential measure to establish the Maui Wildfire Settlement Trust Fund to be administered by the Attorney General, and it appropriates funds to fund the settlement of claims related to the 2023 Maui wildfires.

  • David Tarnas

    Legislator

And there's appropriation of $400,000,000, at that, $400,000,000, in fiscal year '25-'26, and $407,500,000 in '26-'27, or so much thereof as may be necessary.

  • David Tarnas

    Legislator

And those monies will be deposited into the Maui Wildfire Settlement Trust Fund to fund the state's contribution to the settlement of claims related to the 2023 Maui wildfires and for the payment of administrative expenses related to the Maui Wildfire Settlement Agreement.

  • David Tarnas

    Legislator

And these sums are appropriated and shall be expended by the Department of the Attorney General for the purposes of this act. And the act was—will take effect July 1st, 2025.

  • Karl Rhoads

    Legislator

    Okay.

  • David Tarnas

    Legislator

That's what we're doing. This is a very important measure, and I appreciate the support of the Finance Committee to approve this and the Senate and your Ways and Means Committee to approve this as well. So, if it's okay with you, let's go forward with the vote.

  • Karl Rhoads

    Legislator

    Yes, please.

  • David Tarnas

    Legislator

    [Roll Call]

  • David Tarnas

    Legislator

We have a Bill, a very important Bill. Thank you very much.

  • Karl Rhoads

    Legislator

    Thanks, Brenton.

  • David Tarnas

    Legislator

Okay, let's go back to the agenda. House Bill 648, House Draft 1, Senate Draft 1, relating to guardianship and conservatorship services. On behalf of the House, we have Tarnas and Kitagawa as Co-Chairs, Belatti, Marten, and Shimizu as Members.

  • Karl Rhoads

    Legislator

Thank you. For the Senate, it's myself as Chair, Senator Elefante Co-Chair, Awa as Manager.

  • David Tarnas

    Legislator

Thank you. On this measure, we have prepared the CD 1, sent it to you. It has appropriations to both probate and family court to carry out the purposes of this program. And we have agreement to move forward, and I have FIN release. Do you have WAM release?

  • Karl Rhoads

    Legislator

    Yes, we do.

  • David Tarnas

    Legislator

Great. So if it's okay, I'd like to take this to a vote. And let me read the summary. House Bill 648, House Draft 1, Senate Draft 1, which we're passing as a Conference Draft 1. Establishes a two year pilot program in the probate court and family court of the first circuit to fund certain guardianship and conservatorship related court resources in situations where the respondent does not have sufficient funds to pay for one or more the resources and the court has deemed the resource or resources beneficial.

  • David Tarnas

    Legislator

It requires the Judiciary to submit reports to the Governor and Legislature and it appropriates funds. And the House Finance Committee and Senate Ways and Means Committee has approved the following appropriations for the conference draft purposes. Probate court would get 50,000 in FY 26 and 50,000 in FY 27. Family court would get 50,000 in FY 26 and 50,000 in FY 27. And those are both A funds.

  • Karl Rhoads

    Legislator

That's not what my memo says.

  • David Tarnas

    Legislator

This came from Senator Dela Cruz.

  • Karl Rhoads

    Legislator

Yeah, we have $100,000 total. Well, maybe I'm reading it wrong.

  • Mike Gabbard

    Legislator

Aloha, Maikakou. We are reconvening the conference committee hearing on Tuesday, April 22nd, 2025 and we're hearing conference room 325, 9:31am agenda. On the House we have myself and Kusch as co chairs, Perruso, Quinlan and Matsumoto as managers.

  • Mike Gabbard

    Legislator

And on the Senate, myself as chair, DeCoite as co chair, Richards and Awa as members.

  • Kirstin Kahaloa

    Legislator

Thank you Chair. On this measure we did find out in the passage of the budget yesterday evening that 500,000 was appropriated for each fiscal year to fund this program. So we're really excited about that and that it is in the labor budget and it was moved from agr.

  • Kirstin Kahaloa

    Legislator

So it is not in the Department of Ag Budget, but it is in the budget. So therefore I request your support to defer this measure at this time since the funding is in the budget. Okay, sounds good.

  • Kirstin Kahaloa

    Legislator

Thank you. Moving on to HB773, HD1, SD1 relating to agriculture. On the House, we have myself and Kusch as co-chairs and Perruso, Todd, and Matsumoto as managers.

    Legislator

And for the Senate, myself as chair. DeCoite is co-chair, and Richards and Awa as members.

  • Kirstin Kahaloa

    Legislator

Thank you, Chair. With this bill, it was also put in the budget two grant writer positions, one in A funds and one in F funds. So we're really excited that this got funded, so the Department of Ag can generate revenue through grant writer positions and the current position they already have. So this is exciting news.

  • Mike Gabbard

    Legislator

    Sounds good.

  • Mike Gabbard

    Legislator

You're on a roll, Chair. Keep going.

  • Kirstin Kahaloa

    Legislator

But on that note, we do not need this bill. If that is okay with you, I move to defer this measure.

  • Kirstin Kahaloa

    Legislator

    Thank you, Chair.

  • Kirstin Kahaloa

    Legislator

I know. I want to say hip, hip, hooray. But we don't have a bill. But we have budget. Exciting news.

  • Kirstin Kahaloa

    Legislator

And then last, lastly on HB984, HD2, SD1 relating to agricultural loans, House conferees are myself and Representative Kusch as co-chairs, Representative Perruso, Quinlan, and Matsumoto as managers.

  • Mike Gabbard

    Legislator

And for the Senate, myself as Chair, Aquino as co-chair, and Richards and AWA as members.

  • Mike Gabbard

    Legislator

Okay. You want to roll it till.

  • Kirstin Kahaloa

    Legislator

And this bill, like we said before, we have agreement on the measurement. We did just submit finance release. I think we need to send you information to make sure we do the WAM release. So we're waiting on the budget chairs for this measure, and we're waiting on requests.

  • Kirstin Kahaloa

    Legislator

If we can roll this measure? If you are okay to roll it to Wednesday, April 23rd, on the 9:31 a.m. agenda. Is that okay with you?

  • Mike Gabbard

    Legislator

    That's fine.

  • Kirstin Kahaloa

    Legislator

Okay, thank you, Chair. I'll hand over the lead to you.

  • Mike Gabbard

    Legislator

    Okay, thank you.

  • Mike Gabbard

    Legislator

And for the next one is SB140, SD2, HD1 relating to invasive species. For the Senate, myself as Chair, Keohokalole as co-chair, Richards and Awa as members.

  • Kirstin Kahaloa

    Legislator

Yes. And on the House side, myself and Matayoshi as co-chairs, Representative Kusch and Pierick as managers.

  • Mike Gabbard

    Legislator

Okay. So the purpose of this measure is to prohibit the importation of firewood into the state unless the firewood is heat-treated or authorized by the Department of Ag. And then after conferring with the Chair, I think we have agreement on the measure.

  • Kirstin Kahaloa

    Legislator

    Yes.

  • Mike Gabbard

    Legislator

We'll be effecting the effective date to upon approval and adopting the amendments that were proposed to the House Committee on Consumer Protection and Commerce by the Department of Ag. Each House and Senate manager should have a copy of the CD1 and the testimony. So, we do have agreement?

  • Mike Gabbard

    Legislator

    Senator Richards.

  • Tim Richards

  • Mike Gabbard

    Legislator

    Rep Kusch.

  • Mike Gabbard

    Legislator

Rep Kush. Aye. And Rep Pierrick is excused. We have a bill.

  • Scot Matayoshi

    Legislator

    Aye.

  • Matthias Kusch

    Legislator

    Legislator

And Rep Pierick is excused. We have a Bill.

    Rep Matayoshi.

  • Mike Gabbard

    Legislator

    Aye.

  • Kirstin Kahaloa

    Legislator

    Yay. Thank you, Chair.

  • Mike Gabbard

    Legislator

Thank you very much. And then moving on to SB1304 relating to pesticide drift monitoring.

  • Kirstin Kahaloa

    Legislator

    Three thrity, Senator.

  • Mike Gabbard

    Legislator

    Pardon me.

  • Kirstin Kahaloa

    Legislator

    SB330.

  • Mike Gabbard

    Legislator

Oh, I'm sorry. Got ahead of myself there. On SB.330, authorizing the Department of Ag to enforce federal quarantines for the Senate, myself as chair, Senator Rhoads as co-chair, Senator Richards, and Awa as members.

  • Kirstin Kahaloa

    Legislator

And on the House side we have myself, Representative Ilagan, Representative Poeopoe as co-chairs, and Representative Todd, Representative Matsumoto as managers.

  • Mike Gabbard

    Legislator

Okay. And so on this one, the purpose of the measure is to authorize the Department of Agriculture to enforce federal quarantines. And so for this measure, we'll be affecting the defective date to upon approval. And do we have agreement?

  • Kirstin Kahaloa

    Legislator

    Yes, we do, Chair.

  • Mike Gabbard

    Legislator

Great, we have. So I'll take the vote now for the Senate on SB330. Oh, okay. We need Rhoads.

  • Kirstin Kahaloa

    Legislator

Would you like to recess, Chair, or.

  • Mike Gabbard

    Legislator

Yeah, let's just recess. I'm not sure how long it's going to take. We'll recess.

  • Kirstin Kahaloa

    Legislator

So I, I don't know if we're able to continue this hearing or not, but I just got a message they cannot hear anything you were saying. Oh, audio is good. Audio is good.

  • Mike Gabbard

    Legislator

Okay. We have five minutes before Senator Rhoads will be here. He's in another hearing.

  • Mike Gabbard

    Legislator

    Last five minutes. Yeah. Okay.

  • Kirstin Kahaloa

    Legislator

Since our recess, no one could hear us apparently. And now they can. So we don't have to redo the vote or the other measures. But I'm getting message that we need to redo the 1304. So if we want to pretend we're starting again.

  • Mike Gabbard

  • Nicole Lowen

    Legislator

All right, welcome. We are reconvening Conference Committee. It is Tuesday, April 22, 10:00am, Room 325. On the agenda today we have House Bill 1051 relating to energy efficiency portfolio standards. I think we have agreement and are ready to vote.

  • Nicole Lowen

    Legislator

This Bill would just extend out the energy efficiency portfolio standards to 2045 to allow PUC to continue their work around energy efficiency. And the only changes we are making to the Senate Draft 1 is cleaning up the date to make it effective upon approval, so.

  • Glenn Wakai

    Legislator

Sounds fantastic. Do you want to introduce your Members?

  • Nicole Lowen

    Legislator

Oh, I'm sorry, yes. On behalf of the House is myself as Chair, Matayoshi Co-Chair, and Members Kapela, Perruso and Pierick.

  • Glenn Wakai

    Legislator

On behalf of the Senate: myself as Chair, Keohokalole as Co-Chair, and Fevella as a Member.

  • Nicole Lowen

    Legislator

Okay, thank you. Sorry about that. We just do conference once a year, so.

  • Glenn Wakai

    Legislator

I can tell you're so excited about this Bill.

  • Nicole Lowen

    Legislator

I know. All right, shall I...I will take the vote. So we are voting on House Bill 1051, House Draft One, Senate Draft One with a conference draft. Recommendation of the House is to pass with amendments. I vote aye. Rep. Matayoshi?

  • Nicole Lowen

    Legislator

    Rep. Kapela?

  • Scot Matayoshi

    Legislator

    Aye.

  • JeannĂ© Kapela

    Legislator

    Aye.

  • Nicole Lowen

    Legislator

    Rep. Perruso?

  • Amy Perruso

    Legislator

    Aye.

  • Nicole Lowen

    Legislator

And Rep. Pierick is excused. And may I take the vote for the Senate? Chair Wakai?

  • Glenn Wakai

  • Jarrett Keohokalole

  • Kirstin Kahaloa

    Legislator

That works for me, Chair. Thank you. And next measure we have is HB 427, HD 2, SD 2, relating to biosecurity. Today, for the House, we have myself, Representative Tarnas, Representative Yamashita as co-chairs. And Quinlan as—and Matsumoto—as managers.

  • Darius Kila

    Legislator

None of these will be voted on, and the intent is to roll these all to reconvene tomorrow, same room, same time. So this will be Wednesday, April 23rd at 10:30am here in Conference Room 329 at the Hawaii State Capitol. But I will announce them as we go, measure by measure. But that's the intent today.

  • Chris Lee

    Legislator

Yeah. To be clear, we have a number where there is agreement and the intent was to be voting right now. But just because in the Senate Judiciary Committee we have a number of Members who are in the midst of a confirmation hearing, they will not be joining us this morning and we need them as Co-Chairs.

  • Chris Lee

    Legislator

So apologize to everybody and appreciate everyone's patience. But we'll go through the agendas and note those as they come up. So starting our 10:30am agenda on Senate Bill 21, relating to water carriers. On behalf of the Senate, myself as Chair, with Senators Keohokalole as Co-Chair, Inouye and DeCorte Members.
