This requires all public buildings, including public school buildings constructed after January 12026 to be designed to withstand category Cat 5 hurricanes and to be used as shelters in the event of an emergency.

    Good afternoon. Chair Zelefante McKelvey, Vice Chairs and Members of both committees. I'm Tommy Johnson, the Director of the Department of Corrections Rehabilitation. I'll just summarize my testimony. We stand in support of this measure. We do believe that all our correctional facilities should be able to withstand Cat 5.

    That's why we are looking at trying to replace the Oahu Community Correctional Center, KCCC and mccc. However, our capacity to hold other individuals to shelter other individuals would be limited. But. But we could make some space with planning. We would work with the emergency managers for the city and county in the state to do that.

    Okay. Can you hear me? Yep, we can hear you. Okay. I'm Dr. Keona Dudley. The point has been made that buildings which receive appropriations in this session will be caught without enough funding.

    So I would cross out the constructed after January 12026 and add and for which appropriations are made in the 2026 legislative and county Council sessions and in the years following. And I think we need to be more specific about wind speeds and access to bathrooms.

    To the words designed to withstand Category 5 hurricanes, I would add with wind speeds of 200 mph wind speed and have interior passages to bathrooms.

    Section 2D then would read, all public buildings, including public school buildings, that can reasonably be used as hurricane shelters and for which appropriations are made in the 2026 legislative and county Council sessions and in the years following shall be designed to withstand Category 5 hurricanes with winds of 200 mph and to have interior passages to bathrooms so that they can be used as shelters in the event of an emergency.

    As I mentioned before, we don't have quorum so we will be voting these on Tuesday. However, our good friends from public safety do and would like to move on these measures on their end today.

    So that the recommendation we have for 239 is to remove correctional facilities from sheltering the public, exempt structures from sheltering that are not fully enclosed or able to shelter a large population that is covered playgrounds or huge sheds, change public buildings to state buildings and then to go ahead and to go ahead and we're still going to leave the constructed after January 1, 2026 despite the suggestion of the appropriation language.

    And then we're also going to accept DAG's language as well. So that's what we tend to vote on and that's our recommendation for both committees.

General Ross, as we look at the history of what we do for the State of Hawaii, normal times of operation, we find ourselves in high crisis response mode in support for law enforcement. And in these times when we are in support of law enforcement, granted, our duties and responsibilities are to support and provide security.

    In certain instances, there are times when we do engage belligerent individuals. Some of these individuals may not be understanding of our role as National Guardsmen in support of law enforcement. And then an altercation may ensue. For those instances, it's a misdemeanor.

    Currently, as it states, class C felony is where it should be and providing us protection that we need in doing our duties in support of the State of Hawaii.
