Jenna, thank you very much. You know, this this sounds like an office bill. That's really an important bill. With a layperson who needs to pay their RMDs or pay any kind of taxes, they can either choose to wait till the end of the year or they can pay it upfront. And Hawaii is one of the few states that don't allow you to pay the state tax upfront.

You can pay the federal, but you can't pay the state. So when time comes for fifteenth, people stop me on the road and tell me, can't we do something about this? And so it is an important issue. K. The, intent of thiS Bill to SB 2848, and I think we circulated a conference draft, but, what we wanted to do is is still work on another version of it to include defeasement. We're taking out defeasement. It has to do with defeasing funds because we have properties that are funded through tax exempt bonds. But if we want to use, for example, cafeteria to generate revenue, we need to have taxable bonds.

So what we're doing is defeasing the having a fund that can defease, which means cancel that tax exempt bond status and then shifting it to taxable bonds so that we can collect the revenues. So what we're doing, because it is premature to have the fund when we don't know procedures, what we've done is added in a working group so that they can start looking at policies and procedures and how we might defeat funds. So, the description of the bill is for taxable years beginning 01/01/2027, it increases the maximum annual and total allowable deduction for contributions to individual housing accounts for income tax deductions and increases the maximum allowable contributions for for individual housing accounts to qualify for the income tax deductions, repeals outdated language applicable to first time home purchases made before 01/01/1990 by persons with an individual housing account.

The CD1 changes the proposed maximum changes the maximum deduction and contribution amounts to $20,000 for an individual taxpayer in a single taxable year, $40,000 dollars for a married couple filing jointly in a single taxable year, and $200,000 for the allowable limit for all taxable years in the aggregate, a lifetime limit. It also changes the effective date to upon approval.

We have been trying, to make sure that we have a draft, on this measure that is, both airtight and gives us the best chance to prevail in court and actually implementable given our Hawaii revised statutes and our existing legal framework here in the state. I think we both have, openly said multiple times this is, an important issue to address a bad holding, in the Supreme Court Citizens United case.

There are nuances in the chapters implicated by this bill, particularly in Chapter four fourteen and four fourteen d around the the structures of artificial persons that we're trying to work through to to harmonize and put the puzzle pieces together so that it works. I think on our side, the most important are reconsidering the corporate reset language because I don't think it's as workable. I think expressing our conditions of what it takes to be chartered in the state of Hawaii as artificial person is sufficient.

Clarifying that the attorney general or in, some cases depending on the formation, the DCCA would have the discretion to bring an action for dissolution of the organization if they choose to electioneer in violation of the proposed changes, or revocation of authority to conduct a business in the case of foreign entities, in the event of a violation.

And then again, language to reaffirm that, under four fourteen dash four thirty five, and four fourteen dash four sixty one, that foreign corporations are only granted the same privileges as domestic corporations if they intend to domicile here and are subject to the same restrictions.

And then we are trying to work on language to clarify to provide clarity for labor organizations because there are a number of different entity like structures that labor organizations take in Hawaii, and there's some, ambiguity around that that we wanna make sure is just clear for, everyone. So, yeah. In the in the hopes that we can measure twice and cut once since we, you know, you know, we hope not, but do anticipate potentially litigation afterward. That's that's where we are right now.

And I I genuinely do appreciate the Senate's work on this. I I think the house and Senate, like you said, are both in agreement that we'd like to make some progress towards overturning the Citizens United case or finding a workaround to it, which is what your bill is trying to do. The house has proposed a CD to the Senate, which is very different. It's a very different approach.

It's the same approach being taken in Maine right now, where instead of restricting the ability for a corporation or corporate entity to spend, which could be interpreted as, free speech.

It's restricting the corporation's ability to accept donations, over $6,000 per election cycle or per two year election cycle. So, both of them are two different ways, I think, of tackling the same problem. We the the house we feel the house position is stronger, but we do appreciate the Senate trying to, make its, position more tenable as well. I'm not gonna say our position is perfect either.

But, you know, it's two different approaches to try to tackle the same problem of vast overspending by political action committees to influence elections.

And I think the landscape is significantly different now than when Citizens United first passed. They're I think now we have evidence that this corporate money is flowing in and is influencing elections and ballot initiatives uncategorically. So we are in a different position now than I think we were back in 2010, 2012. I think I'm hoping that federal courts will see it differently, and that's why we proposed, our position to try to tackle the problem that way.

Okay, so for House Bill 1785. This would allow the superintendent to step in if a school bus contractor fails to provide service for five straight school days by hiring a interim contractor, and it uses the school bus revolving fund to cover that cost for the CD 1. I wanted to say, extend a Mahalo to the Senate for helping us with, the language.

This bill really helps to address our ongoing school bus crisis. Last year, the legislature passed Act 140, to provide student transportation options. But obviously, there's routes that remain unfilled. Cancellations are ongoing, and there's still too many students waiting to access transportation. For this bill, we would, that we're taking the Senate draft, which replaces the authority from the Governor to the Superintendent.

We are also allowing the department to work with an interim replacement provider. We're also holding contractors accountable when they fail to perform. And we are also, including emergency proclamation I mean, emergency procurement authority as well as the penalty that's aligned with this procurement law. So we could not find, an instance where there was tuition and fees, special funds directed to the cancer center. I believe last time you said it was to the tune of 5,000,000.

I believe last time when we discussed this last time, I had stated that I was not the house was not comfortable with dedicating or allocating tuition and fee special fund monies for this Hawaii tumor registry as important as it is, just being that the tuition and fee special fund is a collection of student tuition and didn't see the nexus there. So I believe you had said that there has been past instances where the university has indeed used that fund for a non related purpose.

When President Lassner was there, they gave, and we look at the, funds that went into the cancer center, and they get an infusion or they were getting an infusion of $5,000,000, for the cancer center, and it came out of the student, tuition fees.

And I remember questioning him that in public, and he said that because I said there is no students there, and why would you using tuition from he says that they use it for the entire university, and there are instances, and it benefits the entire university. So, yeah. So I don't know if you find anything thing in writing, but certainly that was his explanation, and if you go back to one of our hearings, you probably can see it on video.

Okay. Well, thank you for that explanation. Obviously you've been in this a little bit longer than I have in this role, but I appreciate that background. We do have a, that not withstanding, we do have a CD one for your consideration. Again, my concern is setting that precedent.

So we do, have a CD one with general fund revenues in the sum of 350,000. The bill is introduced, was asking for 1,550,000. There were some requests to cover cost shares, a tumor bio repository, also a statewide pathology reporting software. So the CD one we've proposed for your consideration is just a straight, general fund appropriation to offset the federal funding cut that has happened due to cuts in NIH, the National Institute for Health, grant that was funding this.

Well, the Senate very much supports the cancer center, because each year we do, provide funding for them. And we find that this tumor registry is certainly very important.

did, concern me during our hearing to learn that while this is also while this is a priority, it seems, for the cancer center that they never used the tobacco funds to to pay for it. They haven't used they've used the funds and they've used the $5,000,000 that the governor has provided to them as well, for the overall cancer center that they haven't really put it into the tumor registry. And so if this is a priority, I'm not sure why they're not doing that.

And again, they have used $5,000,000 from the tuition and student fees, so I'm not sure why they wouldn't cover this. And they've had a surplus for years and years and years, and they've used it all down to the point where last year they came in and they wanted us to give the raise the tax so so they could get more money, and we did raise the tax to go to the mortgage or to the
